Statement of Work (SOW)
STATEMENT OF WORK (SOW)
for
Richardson Ground Squirrel Control
Malmstrom Air Force Base
MONTANA
9 May 22
SECTION 1
DESCRIPTION OF SERVICE
1. GENERAL REQUIREMENTS
1.1. The certified applicator (a.k.a the contractor) shall provide all labor, rodenticide, chemicals, fumigants, equipment, and incidentals necessary to perform rodenticide treatments, extermination and carcass removal of Richardson Ground Squirrels for approximately 672 acres of main base area and 328 acres of housing area on Malmstrom AFB. The certified applicator shall apply control measures to include EPA and DoD approved fumigants, rodenticides, smoke applications, and traps, in accordance with the Safety Data Sheet (SDS) and product label. All fumigants, smoke applications, rodenticides and chemicals must be approved by the Malmstrom AFB Pest Management Consultant before use. FUMIGANTS AND SMOKE APPLICATIONS MUST NOT BE
APPLIED INTO A BURROW SYSTEM THAT IS WITHIN 100 FEET OF A
BUILDING THAT IS, OR MAY BE, OCCUPIED BY HUMANS, AND/OR
DOMESTIC ANIMALS. Placement of placards must be visible to the public when fumigants/chemicals/rodenticides are in use or present in the area.
1.2. SUMMARY OF WORK
1.3. Work will be conducted in accordance with the following regulatory requirements, DoD Directive 4715.1E, “Environmental Safety and Occupational Health”, Department of Defense Instruction (DODI) 4150.07, DOD Pest Management Program, 29 May 2008;
Armed Forces Pest Management Board (AFPMB) Technical Guide (TG) No. 11, Hydrogen Phosphide Fumigation with Aluminum Phosphide, March 2013; AFPMB TG No. 15, Pesticide Spill Prevention and Management, August 2009; AFPMB TG 21:
Pesticide Disposal Guide for Pest Control Shops, July 2002; Administrative Rules of Montana (ARM) 4.10: Agricultural Sciences Division (including Pesticide- related rules);
MCA 80-8-2: Pesticide Registration & Licensing.
1.4. The certified applicator is responsible for a written Fumigation Management Plan (FMP). The FMP will follow state, county, and local authorities’ specific requirements.
The FMP must be written PRIOR TO ENTRY treatment, including fumigation for burrowing pests. In addition to the plan, the applicator must read the complete label which includes the container label and Applicator’s Manual. Follow the directions and abide by all restrictions.
1.5. The Contractor must notify Balfour Beatty where control measures will be completed one week prior to the start of the operation. This gives Balfour Beatty the opportunity to notify the residents where work will be completed in both housing and main base.
2. PERIOD OF PERFORMANCE
2.1. Treatment period will be April 1 through September 30 each year.
2.2. Hours of Operation. Perform ground squirrel control a minimum of 3 days of week during normal duty from 7:30 a.m. to 4:30 p.m., Mondays through Fridays, excluding federal holidays, unless otherwise required in the contract or approved by the CO. There may be situations that require the contractor to work at times other than normal working hours. When the contractor’s work schedule conflicts with an Air Force mission requirement, advise the CO and reschedule the work to minimize disruption. When workload requires, the contractor may work in addition to the normal duty hours in order to perform to the standards outlined in this PWS.
2.3. Recognized Holiday’s. The contractor is not required to provide service on federal holidays, except in emergency situations; the holidays are:
• New Year’s Day
• Martin Luther King Day
• Washington’s Birthday
• Memorial Day
• Juneteenth
• Independence Day
• Labor Day
• Columbus Day
• Veteran’s Day
• Thanksgiving Day
• Christmas Day
If these holidays fall on Saturday, the preceding Friday will be observed. If these holidays fall on Sunday, the following Monday will be observed. If a holiday falls on a scheduled service day, the Contractor will be responsible for rescheduling services for the first day post the holiday observance.
2.4. Base Closures. Work scheduled but not accomplished because of base closure due to weather, exercises, or actual alert, will be accomplished as soon as possible after reopening the base.
3. CONTRACTOR EMPLOYEES
3.1. Employee Certifications. Applicator shall have valid applicator’s license with the State of Montana. A certified applicator must be physically present, responsible for, and maintain visual and/or voice contact with all fumigation workers during the application of the fumigant.
4. ENVIRONMENTAL, SAFETY, AND HEALTH
4.1. Environmental Hazards. Comply with the highest degree of environmental protection or safety practices where any disagreements between requirements exist. Use of fumigants in a manner that may kill or otherwise harm an endangered or threatened species or adversely modify their habitat is a violation of Federal laws. Before using any fumigant, rodenticide, or pesticide, you must obtain the PESTICIDE USE BULLETIN FOR PROTECTION OF ENDANGERED SPECIES for the county in which the product is used.
4.2. Specific Safety Requirements.
4.2.1. When fumigants are used in athletic fields or parks, the applicator shall post a sign at entrances to the treated site containing the words: DO NOT ENTER/NO ENTRE, FIELD NOT FOR USE, the name and EPA registration number of the fumigant, and a 24- hour emergency response number. Placards may be removed 2 days after the final treatment.
4.2.2. When fumigants are used to a site other than an athletic field or park, the applicator shall post a sign at the application site containing the signal word DANGER/PELIGRO skill and crossbones, the name and EPA registration number of the fumigant, and a 24-hour emergency response number. Signs may be removed 2 days after the final treatment.
4.2.3. When trapping is in progress, the contractor must post signs in the area stating “Caution Trapping in Progress”. Signs can be removed once all traps have been retrieved.
4.3. Contractor Liability. The applicator shall be liable and responsible for all costs resulting from non-compliance, whether accidental or intended resulting from:
4.3.1. Hazardous Chemical Discharge. Any discharge or spills resulting from contractor negligence.
4.3.2. Non-Compliance with Environmental Regulations. Failure to follow any Federal, State, local laws or regulations.
4.3.3. Fines and Corrective Actions. Any fines or corrective actions assessed by any regulatory or governing agency due to the actions or omissions of the contractor in carrying out his/her duties.
5. MISHAP NOTIFICATION AND REPORTING. The contractor/applicator shall immediately report any and all injuries and damage involving contractor, Air Force civilian or military personnel to the QAE and the Wing Safety Office.
5.1. Cooperate fully and assist government personnel in any government investigation of the mishap, until released by the mishap investigative authority through the CO. Safety personnel shall have the right, at any time, to investigate and report all mishaps involving Air Force personnel and property. The CO and contractor Safety representative may accompany Air Force mishap investigation personnel but may not release information regarding the mishap without written approval of the AF Safety investigating official or senior installation commander.
5.2. Maintain records of contractor employee’s occupational injuries, illnesses, and other related activities as required.
6. FIRE PREVENTION. Establish and implement procedures to ensure careful handling and storage of flammable and combustible products IAW National Fire Protection Association (NFPA) Standard 30 and National Fire Codes.
7. SECURITY REQUIREMENTS
7.1. Anti-Terrorism Awareness Training. In accordance with DoDI O-2000.16v1_AFI 10-245-O, Antiterrorism (AT) Program Implementation, ensure Level I - AT Awareness Training is completed by all contractors within 30 days of requiring access, and annually thereafter. The training will be provided by the government. The objective of the training is to provide personnel with requisite knowledge necessary to remain vigilant and enable employment of AT tactics, techniques, and procedures.
7.2. Force Protection. Contractor personnel are required to abide by all real world Force Protection Condition (FPCON) measures, random anti-terrorism measures (RAMs), shelter-in-place orders, evacuations and lock-down notices as directed. Examples include mandatory badge or ID checks, facility single points-of-entry and searches of hand carried items.
8. HOUSEKEEPING AND CUSTODIAL SERVICES. The contractor must maintain the contractor assigned areas in a clean, safe, and sanitary condition. Remove trash from all the work areas and store all flammables in an approved flammable storage container and ensure the area is left in an orderly manner at the end of the duty day.
8.1. Sanitary Facilities. The Contractor’s employees may use the nearest sanitary facilities.
The Contractor shall not use facilities in controlled or restricted areas IAW security requirements.
8.2. Refuse Collection. Waste generated by the Contractor in performance of the services specified with this SOW shall be disposed of by contractor off base in compliance with State and Local ordinances, including hazardous materials in which proper disposal instructions shall be complied with. All trash, debris, and refuse caused by the job shall be removed and disposed and shall be deposited in an approved receptacle or container furnished by the Contractor. The job site shall be cleaned at the end of each workday.
9. ADMINISTRATIVE RECORDS. All records, documents, and associated papers provided by the government and generated during the period of this contract become government property and will remain in place upon contract termination or completion. During the period of the contract, records, documents, and associated papers shall be available for review.
9.1. Contractor will provide a monthly report of all chemical used along with how many holes have been serviced.
10. INSPECTION.
10.1. Quality Assurance Evaluator. The 341st Civil Engineering Squadron will provide a Quality Assurance Evaluator (QAE) to verify accomplishment of work. Controversies between the QAE and the Contractor will be resolved by the Contracting Officer. If, for some reason, a change in the primary or alternate QAE is required, the Contractor will be notified in writing by the Contracting Officer. The Contractor shall coordinate Contractor activities with the 341st Civil Engineering Squadron.
10.2. Final Inspection. The Contractor will notify the QAE of their estimated work completion date at least 3 days in advance, to verify accomplishment of work and receive contractor work report. Any deficiencies found shall be rectified by the Contractor and the Contractor shall inform the QAE upon completion.
