2.1 BASIS OF AWARD

1. The Government intends to issue a single award BPA based on those results from this solicitation to the responsible Offeror whose quotation represents the best value to the Government in accordance with the factors set forth in this RFQ.

2. Best Value Determination – Determining the best value of the quotation includes the following Factors:

Factor A – Technical Factor B – Past Performance Factor C – Price Factor D – Section 508 Compliance (VPAT)

3. Each of the four (4) factors will be evaluated on a stand-alone basis. Factor A will be evaluated on an adjectival basis, see Evaluation Factors below. Factor B will be evaluated on an “acceptable” or “unacceptable” basis, and Factor C will be evaluated on a total price basis and reasonableness including all options and review of the proposed price schedule.

4. Factor A - Technical is more important than Factor B – Past Performance. When Factor A – Technical, Factor B

– Past Performance. and Factor D - Section 508 Compliance are combined, they are significantly more important than Factor C – Price.

2.2 EVALUATION FACTORS

Factor 1 – Technical; will be evaluated on an adjectival basis. When using this methodology, evaluators will assign an adjective descriptor – Outstanding, Good, Acceptable, Marginal or Unacceptable – to each Non-Price Factor in the Non- Price Quotation. That adjective represents evaluators’ conclusions as to the quality of the proposal.

RATING STANDARDS FOR THE NON-PRICE PROPOSAL

Adjectival Rating Description Outstanding Proposal meets requirements and indicates an exceptional approach and understanding of the requirements. Strengths far outweigh any weaknesses. Risk of unsuccessful performance is very low.

Good Proposal meets requirements and indicates a thorough approach and understanding of the requirements. Proposal contains strengths, which outweigh any weaknesses. Risk of unsuccessful performance is low.

Acceptable Proposal meets requirements and indicates an adequate approach and understanding of the requirements. Strengths and weaknesses are offsetting or will have little or no impact on contract performance. Risk of unsuccessful performance is no worse than moderate.

Marginal Proposal does not clearly meet requirements and has not demonstrated an adequate approach and understanding of the requirements. The proposal has one or more weaknesses, which are not offset by strengths. Risk of unsuccessful performance is high.

Unacceptable Proposal does not meet requirements and contains one or more deficiencies. Proposal is not awardable.

The conclusions will have a written narrative identifying the associated strengths, weaknesses, deficiencies, risks, and uncertainties. The strengths or weaknesses are the findings that support the assigned adjective rating.

Support Description Significant Strength

An aspect of an offeror's proposal that has appreciable merit or appreciably exceeds specified performance or capability requirements in a way that will be appreciably advantageous to the Government during contract performance.

The Government will conduct a past performance evaluation of the Offeror’s past performance as well as that of its subcontractors (if applicable). Past performance consists of past performance relevancy and performance confidence; thus, the Offeror will be assigned two (2) ratings for past performance: First, the Government will evaluate the Offeror’s past performance references to determine how relevant a recent effort is to the current requirement for source selection.

Common aspects of relevance include similarity of service/support, complexity, magnitude of effort, dollar value, and contract type. Second, the Government will evaluate the Offeror’s past performance to determine the quality of work performed and assess the level of expectation that the Offeror can successfully perform the required effort.

Rating Definition

Very Relevant Present/past performance effort involved essentially the same scope and magnitude of effort and complexities this solicitation requires.

Relevant Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.

Somewhat Relevant Present/past performance effort involved some of the scope and magnitude of effort and complexities this solicitation requires.

Not Relevant Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.

Rating Description

Exceptional Confidence Based on the Offeror’s recent/relevant performance record, the Government has very high expectations that the offeror will successfully perform the required effort.

Very Good Confidence Based on the Offeror’s recent/relevant performance record, the Government has very good expectations that the offeror will successfully perform the required effort.

Unsatisfactory Confidence Based on the offeror’s recent/relevant performance record, the Government has no expectation that the Offeror will successfully perform the required effort.

Unknown Confidence (Neutral)

No recent/relevant performance record is available, or the offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned.

The Government reserves the right to obtain information for use in the evaluation of past performance from any and all sources, including sources outside of the Government.

If an offeror’s past performance is determined Unacceptable, the quotation may not be selected for award.

Performance Confidence Assessment Standards

2.2.3 Factor C - Price

Price will be calculated and determined either Acceptable or Unacceptable per the following:

1. In order for the Offeror’s Price Quotation to be rated “Acceptable”, the CO must determine that the proposed pricing is fair, reasonable, and supportable, based on the Offeror’s price schedule. The proposed pricing must be advantageous to the Government.

2. The Government will evaluate the overall total price quotation, which contains quoted prices for all line items, including all options. Additionally, the Government will evaluate the table of labor categories, hourly rates and unit pricing being proposed for the BPA. All other information required in the price quotation will be evaluated for completeness and accuracy. The Government reserves the right to clarify any discrepancies discovered during the evaluation.

3. The Government will consider and evaluate the level of effort (labor categories and number of hours in Attachment D), hourly rates, and unit pricing being proposed to determine the feasibility of completing the required services at an overall fair and reasonable price.

4. The Government will evaluate the price quotations for Call Order One (Attachment E) developed using the Offeror’s Price Quote (Attachment D).

If an Offeror’s assigned a rating of “Unacceptable” for Factor C – Price, the Offeror will not be considered for award since the price reasonableness of the quotation cannot be determined and/or the Government cannot confirm that what is quoted corresponds with what is contained in the Offeror’s price schedule. The Government will also consider clarity and adequacy of the price quotation offered by the Offerors.

2.2.4 Factor D - Section 508 Voluntary Product Accessibility Template (VPAT), version 2.1 or later, will be evaluated based on the following:

The evaluation of the VPAT is independent from the other factors and will be based on the demonstrated capabilities of the prospective Offeror to meet the requirements of all the applicable Section 508 standards as listed in the attached HHSAR clause: 352.239-74 Electronic and Information Technology Accessibility. Alternatively, Offerors may propose goods or services that provide equivalent facilitation. Such offers will be considered to have met the standards of the Access Board’s standards for the feature or component providing equivalent facilitation. If none of the Offerors propose goods or services that fully meet all of the applicable Access Board’s standards, those Offerors whose products or services meet some of the applicable standards will be considered eligible for award.

ICT vs. EIT

Procurement documentation from HHS or other agencies may contain references to “EIT” (Electronic and Information Technology) and “ICT” (Information and Communications Technology). HHS considers these terms to be interchangeable, and “EIT” should always be interpreted to be “ICT” in any HHS procurement.
