About this file
This is a Brand Name Only Justification document for a federal contract action by the Department of Indian Affairs, Office of Justice Services (OJS). The requirement is for twenty-five (25) Motorola Mobile & Portable Radios for OJS Law Enforcement Officers, with a delivery date of 90 days after receipt of order (ARO). The purchase request number is 44034486, and the J&A Control Number is JA26-00068. The acquisition is structured as a Firm-Fixed Price contract and will be set aside for Indian Small Business Economic Enterprises (ISBEEs).
The justification for brand-name-only procurement under FAR 13.106-1(b)(1)(i) is based on operational compatibility and safety requirements. Currently, 250 Motorola radios are in use across all OJS Districts to provide public safety communications interoperability with BIA Law Enforcement Officers. The document establishes that switching to a different brand would necessitate retraining officers, creating officer and community safety risks, and would require new training procedures, technician retraining, and procurement of new software and programming equipment. Additionally, existing parts and accessories would become incompatible. Market research identified 311 Native American-owned businesses and 79 Native American-owned small businesses under NAICS Code 334220. The contracting officer will determine fair and reasonable pricing based on previous purchase orders for OJS Land Mobile Radio equipment, government discounts, and adequate price competition, or comparison to manufacturer's published commercial catalog pricing if only one quote is received.

Motorola equipment is utilized by all OJS Districts to provide public safety communications interoperability with BIA Law Enforcement Officers. The Motorola Portable Radio is compatible with existing training procedures and equipment that is in service in all OJS Law Enforcement vehicles. Utilizing this equipment greatly enhances officer and public safety.
Currently there are 250 of these radios in use and issuance of a different brand would require retraining officers to use new equipment creating an officer/community safety risk. None of the current parts and accessories for portable radios could be used. Technicians would need to be re-trained and new software and programing equipment would need to be procured.
The Brand Name Justification will be included with the Combined Synopsis/Solicitation published on SAM.gov. There are Indian Small Business Economic Enterprises (ISBEEs) available for competition; therefore the set-aside will be ISBEE.

7. A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.
I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable. This determination is based on the following:
8. A description of the market research conducted (see Part 10) and the results or a statement of the reason market research was not conducted.
9. Any other facts supporting the use of justification of other than full and open competition, such as:
10. A listing of the sources, if any, that expressed, in writing, an interest in the acquisition.
11. A statement of any actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.
Contracting Officer will determine fair and reasonable based on previous Purchase Orders for OJS LMR, Government discounts, and adequate price competition or, if only one quote is received, comparison to the manufacturer’s published commercial catalog pricing.
A search conducted on the BIA Native American Vendor Dashboard utilizing NAICS Code 334220 displayed 311 businesses. A search conducted on the Small Business Administration (SBA) Dynamic Small Business Search for Native American Owned businesses with the same NAICS Code, displayed 79 businesses.
