52.212-2 Evaluation-Commercial Products and Commercial Services. (Nov 2021)

As prescribed in , the Contracting Officer may insert a provision substantially as follows:12.301(c)

Evaluation-Commercial Products and Commercial Services (Nov 2021)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

1. Ability to comply with the requirements of the Statement of Work/Performance Work Statement (pick one) as evidenced by providing a complete description of the equipment to be provided; and

Technical Evaluation - Acceptable/unacceptable rating based on the ability to comply with the requirements of the Statement of Work (SOW) as evidenced by providing a complete description of the Supply to be provided. Spec sheets are encouraged for evaluation.

Price - Determination of a fair and reasonable price based on market research and independent government estimates. For all offers which are rated "acceptable" for all factors other than cost or price, the Government then selects the offer with the lowest evaluated price.

Past Performance - Acceptable/Unacceptable rating based on relevant performance history that provides offerors an opportunity to identify past or current contracts (including Federal, State, and local government and private) for efforts similar to the Government requirement. This includes review of prior CPARS ratings if applicable. Unfavorable CPARS ratings will result in an unacceptable rating.

(b) . The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Options Government may determine that an offer is unacceptable if the option prices are significantly unbalanced.
