1 Introduction The 129th Rescue Wing, California Air National Guard (CA ANG), is located on Moffett Air National Guard Base (ANGB), California, and operates a combat search and rescue mission.

Equipped with MC-130P Combat Shadow variants of the C-130 Hercules, HH-60G Pave Hawk rescue helicopters, and the Guardian Angel weapon system, the 129th has performed a wide variety of civilian search and rescue missions, including distressed persons aboard ships, lost or injured hikers, and medical evacuations, emphasizing the Wing's motto "that others may live."

1.2 Scope

The Contractor shall furnish and install an electric motorized 2.5-ton capacity top running single girder crane with trolley mounted hoist in Vehicle Management Facility (VMF) Building 668 at Moffett ANGB, Santa Clara County, California, to permit the safe lifting and movement of materials (e.g., engines, drums, etc.) throughout the shop. The Contractor shall provide all necessary plant, labor, transportation, materials, tools, equipment, appliances, and supervision to effect a complete, usable, safe, and workmanlike equipment installation.

2 General Requirements

2.1 Non-Personal Services

All services rendered in support of this contract are exclusively non-personal in nature. The Government shall neither supervise contractor employees nor control the method by which the contractor performs the required tasks. Under no circumstances shall the Government assign tasks to, or prepare work schedules for individual contractor employees. It shall be the responsibility of the contractor to manage its employee’s hours and tasks and to guard against any actions that are of the nature of personal services, or give the perception of personal services. If the contractor believes that any actions constitute, or are perceived to constitute personal services, it shall be the contractor's responsibility to notify the Contracting Officer immediately.

2.2 Business Relations

The Contractor shall successfully integrate and coordinate all activities needed to execute the requirements of this SOW. The Contractor shall manage the timeliness, completeness, and quality of problem identification. The Contractor shall provide corrective action plans, proposal submittals, timely identification of issues, and effective management of subcontractors (if applicable). The Contractor shall seek to ensure customer satisfaction and professional and ethical behavior of all Contractor personnel.

2.3 Contract Administration and Management

The following subsections specify requirements for the contract, management, and personnel administration.

2.3.1 Contract Management

The Contractor shall establish clear organizational lines of authority and responsibility to ensure effective management of the resources assigned to the requirement. The Contractor must maintain continuity between the support operations at the worksite and the Contractor's corporate offices.

2.3.2 Contract Administration

The Contractor shall establish processes and assign appropriate resources to effectively administer the requirement. The Contractor shall respond to Government requests for contractual actions in a timely fashion. The Contractor shall identify and submit for approval a single point of contact (POC) between the Government and Contractor personnel assigned to support contracts. Any changes to the Contractor’s POC must be submitted in writing to the Contracting Officer for approval. The Contractor shall assign work effort and maintain proper and accurate time keeping records of personnel assigned to work on the requirement.

2.4 Subcontract Management

The Contractor shall be responsible for any subcontract management necessary to integrate work performed on this requirement and shall be responsible and accountable for subcontractor performance on this requirement. The prime contractor will manage work distribution to ensure there is no Organizational Conflicts of Interest (OCI).

2.5 Contract Personnel, Disciplines, and Specialties

The Contractor shall accomplish the assigned work by employing and utilizing qualified personnel with appropriate combinations of education, training, and experience. The Contractor shall match personnel skills to the work or task with a minimum of under/over employment of resources. The Contractor shall provide the necessary resources and infrastructure to manage, perform, and administer the contract.

2.5 Location and Hours of Work

All work performed under this SOW shall be accomplished primarily at Building 668, Moffett ANGB, California. Work performed under this SOW may be accomplished during the Government’s normal duty hours of Monday through Friday, 0600 to 1630, excluding Federal holidays and other non-duty days as identified by the Government. Work outside of these hours requires the prior written consent of the Contracting Officer.

3 Work to be performed All work performed under this contract shall be accomplished in accordance with (IAW) this SOW and the plans and specifications provided by the Government. The Contractor shall utilize the documents specified in Appendix A to design and constructed the cranes systems that meet all the requirements identified herein for the project.

Conflicts between existing conditions and this SOW will be brought to the attention of the Government for resolution as soon as is practicable. No work will continue in the affected area until a response has been provided by the Government.

4 Special Requirements

4.1 Security and Safety

The Contractor is cautioned that Moffett ANGB is a United States Air Force installation wholly contained within Moffett Federal Air Field (Moffett Field) which is operated by the National Aeronautics and Space Administration (NASA). Access to Moffett Field is controlled by NASA Protective Services while access to Moffett ANGB is controlled by the 129 Security Forces Squadron (SFS).

The Contractor shall comply with all applicable installation/facility access and local security policies and procedures, which may be obtained from the Contracting Officer’s Representative

(COR). The Contractor shall also provide all information required for background checks to meet installation access requirements to be accomplished by the 129 SFS, Director of Emergency Services or local Security Office. The Contractor shall ensure compliance with all personal identity verification requirements as directed by DoD, HAF and/or local policy. Should the Force Protection Condition (FPCON) change, the Government may require changes in contractor security matters or processes.

Contractor and all associated sub-contractors employees shall comply with adjudication standards and procedures using the National Crime Information Center Interstate Identification Index (NCIC-III) and Terrorist Screening Database (TSDB) (AFI 31-101 and AFI 10-245), applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by the COR).

In case of emergency, contact the 129th Rescue Wing’s Base Defense Operations Center (BDOC) at (650) 603-9111. The BDOC will in turn notify the applicable responding agency.

Notify the Contracting Officer and/or COR after notifying the BDOC.

4.2 Safety

Contractor Compliance: The Contractor and its subcontractors shall comply with Public Law 91- 596 (Occupational Safety and Health Act (OSHA)) and the Environmental, Safety, and Occupational Health (ESOH) (DODD 4715.1E). These requirements shall be incorporated into the Contractor’s safety and health program. The Department of Defense (DoD) participates in the OSHA Voluntary Protection Program (VPP). Contractor personnel performing services on a DoD installation shall participate in the local VPP. Information on the VPP is available at http://www.osha.gov/dcsp/vpp/index.html.

Mishap Notification and Investigation: The Contractor and its subcontractors (if applicable) shall promptly report pertinent facts regarding mishaps involving Government property damage or injury to Government personnel and to cooperate in any resulting safety investigation. The Contractor shall notify (via telephone) the cognizant contracting officer, the contracting officer’s representative, and/or other applicable members within four (4) hours of all mishaps or incidents. The Government person notified by the contractor will in-turn notify the Safety office.

Contractor notifications made after duty hours shall be reported to the Base Defense Operations Center (BDOC) by calling (650) 603-9111. If requested by the cognizant contracting officer, the contracting officer’s representative, and/or the cognizant program manager, the Contractor shall immediately secure the mishap scene/damaged property and impound pertinent maintenance and training records until released by the investigating safety office. If the Government investigates the mishap, the Contractor and the subcontractors shall cooperate fully and assist the Government personnel until the investigation is completed.

4.3 Government Furnished Materials

The Government shall only provide the materials specified by this SOW and all utilities necessary for completion of work under this SOW. Utilities shall only be provided to the point of discharge (i.e., hose bib or electrical outlet). The Contractor remains responsible for conveying the utility to the worksite by hose, cable, or other means. Waste removal, telephone, or postal services shall not be provided.

4.4 Quality Control

The Contractor shall establish and maintain an effective quality control (QC) system. QC consists of plans, procedures, and organization necessary to produce an end product which complies with the SOW requirements, covers all operations, both onsite and offsite, and is keyed to the proposed work sequence.

The project superintendent will be responsible for the quality of work and is subject to removal by the Contracting Officer for non-compliance with the quality requirements specified in the contract. In this context the highest level manager responsible for the overall construction activities at the site is the project superintendent. The project superintendent must maintain a physical presence at the work site while work is being performed and is responsible for all activities at the work site.

4.4.1 Quality Control Plan

No later than seven (7) calendar days after receipt of order (ARO), the Contractor shall submit to the Contracting Officer the Contractor’s Quality Control Plan (QCP) proposed to implement the requirements of the SOW. Work will be permitted to begin only after the Contracting Officer’s acceptance of the QCP.

4.4.2 Content of the QCP

Include, at a minimum, the following to address all work operations, both onsite and offsite, including work by subcontractors, designers of record, consultants, architect/engineers (AE), fabricators, suppliers, and purchasing agents:

A description of the quality control organization, including a chart showing lines of authority and acknowledgment that the CQC staff will implement all aspects of the work specified.

Procedures for scheduling, reviewing, certifying, and managing submittals, including those of subcontractors, designers of record, consultants, architect engineers (AE), offsite fabricators, and suppliers.

Control, verification, and acceptance testing procedures for each specific test to include the test name, feature of work to be tested, test frequency, and person responsible for each test.

Procedures for tracking preparatory, initial, and follow-up control phases and control, verification, and acceptance tests including documentation.

Procedures for tracking construction deficiencies from identification through acceptable corrective action. Establish verification procedures that identified deficiencies have been corrected.

Reporting procedures, including proposed reporting formats.

A list of the definable features of construction work. A definable feature of work is a task which is separate and distinct from other tasks, has separate control requirements, and may be identified by different trades or disciplines, or it may be work by the same trade in a different environment. Although each section of the SOW may generally be considered as a definable feature of work, there are frequently more than one definable feature under a particular requirement.

Meetings may be called by either party to address deficiencies in the QC system or procedures which may require corrective action by the Contractor.

5 Deliverables

5.1 Safety and Injury Prevention Plan

Within seven (7) calendar days ARO, the Contractor shall prepare and submit a Safety and Injury Prevention Plan that shall be reviewed and approved by the COR. Contractor employees shall adhere to Air Force Instruction (AFI) 91-202, The Air Force Mishap Prevention Program.

FEDOSHA, CAL-OSHA and other applicable State & Federal Standards/Requirements. The Contractor shall brief and ensure subcontractor adherence to the Contractor’s Safety Plan and applicable standards and requirements.

5.2 Submittal Register

Within seven (7) calendar days after receipt of order (ARO), the Contractor shall furnish to the Contracting Officer a Submittal Register to indicate the Contractor's scheduled submittals and submittal dates. The Register shall contain all items (shop drawings, manufacturer's literature, certificates of compliance, material samples, guarantees, etc.) that the Contractor shall submit for review and approval.

5.3 Project Schedule

Not later than fifteen (15) calendar days ARO, the Contractor shall furnish to the Contracting Officer and COR a proposed project schedule identifying forecasted milestone dates for all key elements of the project.

6 Related Documents

6.1 Request for Information

Procedure: Immediately on discovery of the need for interpretation of the Contract Documents, prepare and submit an RFI in the form specified. RFI’s shall originate with Contractor; RFI’s submitted by entities other than Contractor will be returned with no response. Coordinate and submit RFI’s in a prompt manner so as to avoid delays in Contractor's work or work of subcontractors.

Content and form of the RFI: Include a detailed, legible description of item needing interpretation and the following:

Project name Date Name of Contractor Name of COR RFI number, numbered sequentially Field dimensions and conditions, as appropriate Contractor's suggested solution(s). If Contractor's solution(s) impact the Contract Time or the Contract Sum, Contractor shall state impact in the RFI Contractor's signature Attachments: Include drawings, descriptions, measurements, photos, Product Data, Shop Drawings, and other information necessary to fully describe items needing interpretation.

Government Action: The Government will review each RFI, determine action required, and return it. Allow ten (10) working days for Government response for each RFI. RFI’s received after 1:00 p.m. will be considered as received the following working day.

The following RFI’s will be returned without action:

Requests for approval of submittals Requests for approval of substitutions Requests for coordination information already indicated in the Contract Documents Requests for adjustments in the Contract Time or the Contract Sum Requests for interpretation of Government actions on submittals if Incomplete RFI’s or

RFI’s with numerous errors.

Government action may include a request for additional information, in which case

Government time for response will start again.

If Contractor believes the RFI response warrants change in the Contract Time or the Contract Sum, notify the Contracting Officer in writing within 10 days of receipt of the RFI response.

Review response and notify Government within seven (7) days if Contractor disagrees with response.

7 Definitions and Acronyms

7.1 Definitions

CONTRACTOR. A supplier or vendor awarded a contract to provide specific supplies or service to the Government. The term used in this contract refers to the prime.

CONTRACTING OFFICER (KO). A person with authority to enter into, administer, and or terminate contracts, and make related determinations and findings on behalf of the Government.

Note: The only individual who can legally bind the Government.

CONTRACTING OFFICER'S REPRESENTATIVE (COR). An employee of the U.S. Government designated by the KO to monitor contractor performance. Such appointment shall be in writing and shall state the scope of authority and limitations. This individual has authority to provide technical direction to the Contractor as long as that direction is within the scope of the contract, does not constitute a change, and has no funding implications. This individual does NOT have authority to change the terms and conditions of the contract.

DEFECTIVE SERVICE. A service output that does not meet the standard of performance associated with the Statement of Work.

DELIVERABLE. Anything that can be physically delivered and includes non-manufactured things such as meeting minutes or reports.

KEY PERSONNEL. Contractor personnel that are evaluated in a source selection process and that may be required to be used in the performance of a contract by the Key Personnel listed in the SOW. When key personnel are used as an evaluation factor in best value procurement, an offer can be rejected if it does not have a firm commitment from the persons that are listed in the proposal.

PHYSICAL SECURITY. Actions that prevent the loss or damage of Government property.

QUALITY ASSURANCE. The Government procedures to verify that services being performed by the Contractor are performed according to acceptable standards.

QUALITY ASSURANCE SURVEILLANCE PLAN (QASP). An organized written document specifying the surveillance methodology to be used for surveillance of contractor performance.

QUALITY CONTROL. All necessary measures taken by the Contractor to assure that the quality of an end product or service shall meet contract requirements.

SUBCONTRACTOR. One that enters into a contract with a prime contractor. The Government does not have privity of contract with the subcontractor.

WORK DAY. The number of hours per day the Contractor provides services in accordance with the contract.

WORK WEEK. Monday through Friday, unless specified otherwise.
