1. Requirements

1.1. Background. Whiteman Air Force Base (WAFB) is seeking a government contractor that provides Portable Toilet services. Details are as follows:

· Provide up to 15 routine Portable Toilet services upon requested

· Provide up to 20 emergency Portable Toilet services upon requested

· Provide to 10 handicapped Portable Toilet services upon requested

· Provide weekly service/cleaning and provide supplies for requested units

1.2 Scope. The contractor shall provide all supervision, personnel, equipment, tools, transportation, travel, materials, supplies-including chemicals and other items, and services necessary to operate Portable Toilets.

2. Tasks

2.1. Portable Toilet Parameters. The contractor shall provide equipment that is uniformly manufactured with industry standard finishes, accouterments, and colors (acceptable colors include earth tone and sky tone colors i.e., blue, beige, white; unacceptable colors include yellow, orange, and pink). Portable toilets colors must be approved prior to contract start. The contractor shall meet or exceed all stated minimum requirements. Each unit shall have a hand sanitizer dispenser located on the interior of the unit.

2.1.1. Portable Toilets. The contractor shall provide portable toilets manufactured in accordance with industry standards. The door shall have an occupancy usage indicator and coat hook. The portable toilet shall have ample ventilation as designated by health codes. A toilet seat with lid shall be provided. The toilet paper dispenser shall hold sufficient rolls of toilet paper to ensure it does not run out between cleanings. The holding tank shall have at least a 60-gallon capacity or equal with a vent stack sized in accordance with health codes.

2.1.2. Portable Handicapped Toilets. The contractor shall provide portable handicapped toilets specifically designed and manufactured for handicapped individuals in accordance with the Americans with Disabilities Act (ADA). The interior space shall be large enough to provide maximum wheelchair maneuverability with non-skid flooring. The door opening shall easily be able to accommodate a wheelchair. The door shall have an occupancy usage indicator and coat hook. The portable handicapped toilet shall have ample ventilation as designated by health codes. A toilet seat with lid and two 24” assist bars shall be provided. The toilet paper dispenser shall hold sufficient rolls of toilet paper to ensure it does not run out between cleanings. The holding tank shall have at least a 35-gallon capacity or larger with a vent stack sized in accordance with health codes.

2.1.3. Service Requirements. All portable toilets used on Whiteman Air Force Base must use earth friendly products for servicing. There will be no FORMALDEHYDE products used in servicing portable toilets on Whiteman AFB. All portable toilets and portable handicapped toilets shall be serviced at least one time per week. The Government reserves the right to increase or decrease the service frequency of each unit per usage. The servicing of the portable toilets and portable handicapped toilets shall include but not be limited to: the complete removal of wastewater and debris such as cans, bottles, etc., in the waste tank; the cleaning of grease, scum, and grit in the waste tank interior; the recharging of the waste tank with sufficient quantity of chemicals to ensure that units shall be free of objectionable odors; the cleaning of the toilet seat with commercial grade cleaner; the flushing of the urinal with sufficient quantity of chemicals to insure that units shall be free of objectionable odors; the cleaning of the walls, floors, hand rails and door handles is required on a weekly basis at minimum. Contractor will provide all toilet paper and ensure the stocking of the toilet paper dispensers as well as supplying hand sanitizer and ensuring the receptacle is full. The floors may require additional cleaning during inclement weather conditions.

2.1.3.1. Task 1 Routine placement of toilets. The contractor shall place portable toilets at locations as directed by the COR within 24 hours of notification. The contractor shall ensure that the portable toilets are placed on firm stable ground and sufficiently weighed to prevent them from toppling over. The contractor shall be responsible for protecting any toilets from high winds, as well as for cleaning and restoring any toilets to an upright position that may fall within 24 hours of notification. The portable toilets shall be placed in such a manner as to facilitate easy access for personnel and servicing.

2.1.3.2. Task 2 Toilet paper: Contractor will provide all toilet paper and ensure during servicing that all dispensers are stocked when placing, setting, and servicing portable toilets.

2.1.3.3. Task 3 Extra service cleaning. Extra servicing may be required by the mission. The COR will request extra cleanings at any time and will notify the contractor of their locations. The contractor shall complete all extra servicing of toilets within 24 hours of notification by the COR. It is incumbent upon the contractor to maintain the portable toilets and collection tanks in accordance with local, state, and federal health regulations and codes.

2.1.3.4. Task 4 Emergency placement of toilets. The contractor shall be required to place and or relocate portable toilets on short notice due to urgent mission requirements. The contractor shall place these units within 4 hours of notification by the COR.

2.1.3.5. Task 5 Transport of Portable Toilet Waste Material. The contractor has the option to use the WAFB Wastewater Treatment Plant (WWTP) at no cost to the contractor, or an off-base site for wastewater disposal at no additional cost to the government. Contractor may empty contents from portable toilets and collection tanks at Whiteman AFB wastewater treatment plant (WWTP) provided the following conditions are met. The contractor’s mobile storage tank was emptied of all wastes prior to arriving to Whiteman AFB. The tank has not been used for anything other than hauling domestic wastes. No off-base wastes will be accepted. Failure to comply with these conditions shall result in denial of access for any future disposal at the Whiteman AFB WWTP. The contractor shall notify plant operator prior to dumping. The WWTP is located about ½ mile south of Spirit gate on SR 23, the service access is located on the right hand side of drive about 200 feet from plant gate the alternate dumping site is on base next to building #115. Portable toilet wastes shall be free from large debris such as plastic/glass bottles, diapers, and other such items prior to arriving at WWTP for disposal.

The contractor shall provide all required transportation manifests to the COR and CO within five days of delivery if applicable. The contractor shall be a Missouri State certified licensed waste hauler. The contractor shall also maintain their licensing and certification for the entire period of performance of the contract, with copies of any renewals being supplied to the COR and CO within five business days of receipt.

2.1.3.6. Task 6 Offloading of Waste Material. The contractor shall provide the proper tank truck/equipment required for the servicing and transporting of wastewater in accordance with (IAW) industry standards. The contractor shall be held responsible for cleaning up of all spills and / or leaks at no additional cost to the government. In the event of a reportable spill, the contractor is responsible for any violations issued by any regulator including payment of fees, fines, penalties, or damages assessed. All disposals will be documented in accordance with all local, state, and federal laws. The contractor has the option to use the WWTP or an off-base disposal site at no additional expense to the government. When offloading at the WWTP, the contractor shall insure that debris are not offloaded into the treatment stream. After offloading, the contractor is responsible to rinse down the dump basin, remove any debris, and provide the amounts and types of wastes offloaded in the administrative building’s logbook. In the event the WWTP is inoperable, the contractor shall be notified whenever possible in advance by the COR. If waste has been collected when the WWTP is not operational, then the contractor will be required to dispose of waste collected at an appropriate off base disposal site at no additional expense to the government.

2.1.3.7. Task 7 Invoicing. The Contractor shall submit a full and complete invoice in Wide Area Work Flow (WAWF) within 30 days of service. The invoice description in WAWF shall include the date(s) the service was provided.

2.1.4. CONTRACTOR IDENTIFICATION

2.1.4.1. Identification of Contractor Employees: All contractor personnel attending meetings, answering Government telephones and working in other situations where their contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression that they are Government employees. The contractor shall ensure that all documents or reports produced by contractor personnel are suitably marked as contractor products or that contractor participation is appropriately disclosed. The contractor’s status as a “contractor” shall be predominantly displayed in all correspondence types (to include signature blocks on e-mail) and dealings with Government or non-Government entities.

2.1.4.2. Contractor Required Identification: The contractor is required to provide identification badges or logoed clothing for their employees. Contractor personnel shall wear identification badges or logoed clothing distinguishing themselves as such. All contractor personnel shall wear these badges or logoed clothing while on duty on the government site. Badges are required to identify the individual, company name, and be clearly and distinctly marked as “contractor”, displayed on their outer clothing, and visible to the casual observer.

2.1.4.3. The contractor shall be responsible to submit and maintain current Entry Authorization List for base IDs. All identification media (including vehicle passes) shall be returned to the COR when employees terminate work for any reason.

2.1.4.4. Contact Information: Within 10 days of contract award, and within 10 days of each option year, the Contractor shall provide a list of primary and alternate contact phone numbers. This list will be kept up-to-date and submitted to the CO and COR. Within 10 days of contract award, 10 days after exercise of each option year, and every time an employee or vehicle update is required, the Contractor shall provide and keep current all information required for entry and access to the base.

2.1.4.5. Estimated workload requirements for portable toilets: This information is provided for historical background only. It is not a guarantee of workload quantities.

2.2. ENVIRONMENTAL

2.2.1. Compliance. The contractor is required to comply with all applicable base, local, state, and federal environmental laws and regulations, including Air Force Instructions in effect at the time of performance. The contractor shall be responsible for obtaining and complying with any required operating permits. The contractor shall be responsible and liable for penalties, fines, or environmental damage claims that may be required or assessed by the local, state, or federal governments as a result of the contractor’s performance, or failure to perform, during the course of this contract. The government will inspect for environmental compliance at its discretion and will notify the CO of any discrepancies found. In addition, contractor may be subject to contractual sanctions for environmental non-compliance including, but not limited to, termination, suspension, debarment, and adverse past performance assessment. Any damages by the contractor’s operation or negligence shall be restored to their original condition by the contractor, at no additional cost to the government.

2.2.2. Disposal of Waste. The contractor is responsible for the proper handling and disposal of solid waste. The contractor shall also be responsible for any enforcement action that may be taken by the State of Missouri, other state or the federal government related to handling, transportation and the proper disposal of solid waste materials. If notification, certifications, documentation, manifests, permits, or any other written materials are required by law to be obtained, prepared and/or submitted. The contractor shall prepare same and provide a written copy to the CO and COR. Any action, which violates permit requirements for compliance, must be reported to 509 CES/CEIE at (660) 687-6347 immediately.

2.2.3. Notification of Environmental Spills. In the event the contractor spills or releases any unpermitted substance, hazardous substance or hazardous waste into the environment, the contractor shall immediately report the incident to the CO and COR. The contractor shall be liable for the costs of clean up and remediation of any spills or the release of such substance into the environment. The government shall provide the contractor with the following utilities: electricity and water. The government will only provide reasonable amounts in accordance with the scope of the PWS.

2.2.4. Materials. All materials used in the performance of services on the installation shall be in compliance with industry standards, local, state, and federal laws, and will be used according to manufacturers' recommendations. Materials will be used for intended purposes and will be stored and utilized in accordance with industry standards.

3. Service Summary/Quality Assurance

3.1. Service Summary (SS): The contract service requirements are summarized in performance objectives that relate directly to mission essential items. The performance threshold briefly describes the minimally acceptable levels of service required for each requirement. The SS and the contractor’s Quality Control Plan provide information on contract requirements, the expected level of contractor performance, and the expected method of Government surveillance and confirmation of services provided. These thresholds are critical to mission success. During the first initial 30 days of the contract, two additional errors on each task shall be allowed in an effort to identify normal phase-in problems. This SS includes performance objectives the Government will use to determine contractor performance and will compare contractor performance to the Acceptable Quality Level (AQL).

3.2. Customer Complaints

All valid customer complaints shall be re-performed if applicable, as soon as possible after notification, but prior to the next service period. Re-performance; however, does not eliminate the customer complaint and it still applies against the contractor’s performance threshold. If the contractor challenges the validity of the complaint and the COR and contractor cannot come to agreement, the customer complaint will be forwarded to the CO for resolution. Customer complaints will be tracked and if the performance threshold is exceeded, action will be taken by the CO IAW the applicable inspection/acceptance clause.

3.3. Quality Control/Quality Assurance

Post Award Conference/Periodic Progress Meetings: The Contractor agrees to attend any post award conference convened by the contracting activity or contract administration office in accordance with Federal Acquisition Regulation Subpart 42.5. The Contracting Officer (CO), Contracting Officer’s Representative (COR), Government Subject Matter Expert (GSME), and other Government personnel, as appropriate, may meet periodically with the contractor to review the contractor's performance. At these meetings, the contracting officer will apprise the contractor of how the Government views the contractor's performance and the contractor will apprise the Government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the government. Meetings may be held in person, by conference call, or by email.

3.3.1. Contract Manager (CM): The contactor shall designate a CM who shall ensure performance under this contract. The name of this person, and an alternate, who shall act for the contractor when the CM is absent, shall be designated in writing to the CO. The CM or alternate shall have full authority to act for the contractor on all contract matters relating to daily operation of this contract. The CM shall work through the COR to resolve issues, receive technical instructions, and ensure adequate performance of services. The CM shall ensure that contractor employees do not perform any services outside the scope of the contract without an official modification issued by the CO. The CM shall ensure contractor employees understand services performed outside the scope of the contract are performed wholly at the expense of the contractor.

3.3.2. COR Surveillance with QASP: The government, through the COR, shall periodically evaluate the contractor’s work performance in accordance with the specific contract performance requirements. The Government will evaluate the contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan (QASP). This plan is primarily focused on what the Government will do to ensure that the contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and acceptable quality level(s) or defect rate(s). The COR is the primary contact for surveillance and contract performance. The COR does not have the authority to make any contract changes or authorize additional work.

4. Government Responsibilities

4.1. Disaster Response Work: In the even that Government property is damaged, or in imminent danger by causes of natural or man-made disaster, the CO and/or the COR will determine the emergency action necessary to protect the Government and personal property and will direct the Contractor to do emergency work to the extent necessary.

5. General Information

5.1. Information: The following description shall serve as general information along with performance objectives as required by the Government. Unmentioned tasks shall not limit the contractor’s obligation to conform to all state and local regulations (to include safety and environmental) in accordance with standard industry and commercial practice. The contractor shall provide all travel, personnel, transportation, equipment, tools, materials, supervision, and quality control necessary as defined in this Performance Work Statement (PWS).

5.2. Travel and Transportation: The Contractor is responsible for mobilization of personnel and equipment to and from all individual facilities including all shipping, delivery of materials, loading and offloading of materials, tools, and necessary equipment, including storage, to perform the required activities to accomplish the PWS.

5.3. Period of Performance (PoP)/Hours of Service/Holidays

5.3.1. PoP: Performance shall be one base year of 12 months and four 12-month option years for a total period of five years. An extension of 6 months at the end of this period of performance may be determined to be in the best interest of the Government, see FAR 52.217-8. The award document will call out the PoP and is the definitive performance period.

5.3.2. Hours of Service: The contractor shall provide services between the hours of 7:00 AM to 4 PM, Monday through Friday.

5.3.3. Federally Recognized Holidays. The contractor is not required to provide normal service, except for emergencies, on the following days:https://www.opm.gov/policy-data-oversight/pay-leave/federal-holidays/#url=2024. The CO and COR must approve in advance, excluding legal holidays, any exceptions to the normal work hours and designated workdays. Contractor may be required to work weekends for extra servicing of portable toilets and for special events.

5.3.4. Performance of Services during Crisis Declared By the National Command Authority or the local Installation Commander. This service does not meet the criteria for continuation of performance during a crisis in accordance with Department of Defense Instruction (DODI) 1100.

5.3.5. Restricted Area Escorts. The government shall provide escort services for contractor employees to provide maintenance services within base restricted areas. The contractor shall coordinate the necessary government escort services with the COR.
