About this file
This is an Addendum A document detailing Federal Grant Compliance Requirements between the Maine Department of Transportation (Maine DOT) and vendors for a project involving 26,500 new treated rail cross-ties. The addendum establishes mandatory compliance obligations for all vendors and subcontractors working on this Federal Railroad Administration (FRA)-funded project. Vendors must adhere to all applicable FRA regulations, policies, procedures, and directives, along with standards set by AREMA, AASHTO, and AAR. The document requires vendors to provide debarment and suspension certifications and comply with drug-free workplace requirements under DOT regulations. All vendors must acknowledge and comply with the Program Fraud Civil Remedies Act of 1986, recognizing potential federal penalties for false claims or fraudulent statements. The FRA and Maine DOT retain the right to concur in dispute settlements and maintain a proportionate share of any third-party recovery proceeds based on the federal funding percentage allocated to the project.
Additional compliance requirements include environmental protection measures requiring all facilities to limit water and air pollution in accordance with federal, state, and local standards, with vendors certifying that no facilities appear on the EPA's List of Violating Facilities. Vendors must comply with Buy America provisions requiring steel, iron, and manufactured goods be produced in the United States, with limited waiver exceptions for goods exceeding $100,000 in project costs. The agreement mandates compliance with all civil rights laws, including Title VI of the Civil Rights Act of 1964, Title IX of the Education Amendments of 1972, Section 504 of the Rehabilitation Act of 1973, the Age Discrimination Act of 1975, ADA accessibility requirements, and Executive Order 11246 regarding Equal Employment Opportunity. Vendors must also advance Disadvantaged Business Enterprise (DBE) and Women's Business Enterprise (WBE) participation in subcontracts and permit site visits by Maine DOT, FRA, U.S. DOT, and the Comptroller General representatives. All compliance requirements must flow down to subcontractors, with vendors required to provide full access to records for audit and examination purposes.

The Buy America requirements described in this section shall only apply to projects for which the costs exceed $100,000.
No Government Obligation to Third Parties – Vendor agrees that, notwithstanding any concurrence by the Federal Government in or approval of the solicitation or award of any underlying contract, absent the express written consent of the Federal Government, the Federal Government is not a party to such Agreement, and shall not be subject to any obligations or liabilities to Vendor or any Vendor or other parties in connection with the Agreement or the project.
