About this file

This is an Administrative Regulation document issued by the City of Phoenix Human Resources and Payroll Department establishing mandatory Personal Protective Equipment (PPE) policies for all City employees. The regulation covers four primary categories of PPE: high visibility safety apparel (Class 2 or 3 ANSI/ISEA 107-2004 approved vests, t-shirts, and jackets for employees working in roadway rights-of-way or near vehicular traffic, with exceptions for Police and Fire personnel); prescription safety eyeglasses (meeting ANSI/ISEA Z87.1 standards with fixed side shields, reimbursable once every two years for employees with eye hazard exposure, covering frames and lenses only); safety hard hats (ANSI/ISEA Z89.1 compliant for construction projects and head injury danger areas); and safety footwear (ASTM F2412-05 and F2413-05 certified, leather construction required unless variance granted, mandatory whenever foot injury risk exists). The regulation became effective November 18, 2013, and was revised to incorporate federal safety regulation updates and references to the International Safety Equipment Association standards.

The regulation establishes that the Human Resources Department, Safety Section maintains a qualified products list for approved safety apparel and manages the prescription safety eyeglass reimbursement program. Department heads retain primary responsibility for program management and approval of reimbursements. Employees are limited to one prescription eyeglass reimbursement every two years, with the City covering replacement costs only when damage occurs on duty without employee negligence; damage accompanied by workers' compensation claims is handled through the City's Workers' Compensation Program. Safety footwear costs are charged to each department's budget through a voucher system, with employees responsible for any costs exceeding the voucher value. The regulation emphasizes that supervisors must ensure employee compliance with all PPE requirements, with failure to comply subject to disciplinary action. All PPE must comply with applicable OSHA standards and state law requirements.

The purpose of this regulation is to establish rules and guidelines for the use of high visibility safety apparel, safety prescription eyeglasses, hard hats, safety footwear, and when applicable, reimbursement of PPE costs to employees.

1. HIGH VISIBILITY SAFETY APPAREL

A.A. 2.313 revised Human Resources and Payroll

A. Many workers throughout the nation are killed each year in occupational pedestrian accidents. This includes law enforcement officers, highway construction workers, engineers, sanitation workers, water department workers, etc. The City of Phoenix has had various accidents where employees were struck by vehicles when working in the street. The additional visibility provided by an American National Standards Institute (ANSI) and the International Safety Equipment Association (ISEA) approved Class 2 or 3 retro-reflective safety apparel, vest, t-shirt, jacket, etc. will help eliminate or minimize these accidents.

B. In order to make full use of this apparel and to afford maximum protection, all City employees, including Police and Fire personnel, whenever working within the right-of-way of a roadway, or when otherwise exposed to danger from vehicular or equipment traffic, shall be required to wear an ANSI/I SEA 107-2004 approved Class 2 or 3 safety apparel, vest, t shirt, jacket, etc., (ANSI 207-2006 for emergency personnel) except:

1. Where the use of such vests by Police personnel would conflict with Police Department policy and practices, such as during stakeouts, pursuits, etc.

2. Where Fire Department policy and practices requires Fire personnel to wear reflective turnout gear.

C. Specifications for High Visibility Garments

High-visibility safety apparel is defined as personal protective safety clothing that is intended to provide conspicuity during both daytime and nighttime usage, and meets the Performance Class 2 or 3 requirements of ANSI/I SEA 107-2004 (ANSI 207-2006 for emergency personnel).

The Human Resources Department, Safety Section, has established product specifications and will maintain a qualified products list of approved safety apparel, vests, t-shirts, jackets, etc.

The minimum acceptable form of safety eye protection is the latest ANSI/I SEA standard Z87.1, "American National Standard for Occupational and Educational Eye and Face Protection devices" and have "fixed" side shield protection.

C. Safety regulations require that appropriate eye protection be provided to and worn by employees whose jobs expose them to eye hazards.

D. Normal prescription glasses do not provide adequate protection from injury to the eyes and do not meet the latest ANSI/ISEA Z87.1 eye protection specifications.

E. An allowance for prescription safety glasses will be provided when:

A.R. 2.313 revised Human Resources and Payroll

G. Only those employees who are exposed to potential eye injuries will be eligible for the reimbursement program. In all cases, reimbursement will be made if approved by department management.

H. Employees will be limited to one reimbursement every two years. Those employees requiring prescription changes sooner will be responsible for those costs.

I. Prescription safety glasses will not be replaced (at City cost) if they are damaged because of employee negligence. Chargeability or non-chargeability because of accidental damage will be determined by departmental management.

J. Prescription glasses will be replaced (at City cost) in those situations where damage to the glasses occurred on duty and was not caused by negligence of employee. The damage must have occurred while working.

A. The foot protection standard requires that employees wear protective footwear when working in areas where there is a danger of foot injuries.

B. The purpose of this program is to establish the process for obtaining appropriate safety footwear for City employees who work in areas where foot hazards are present. The cost of the safety footwear is charged to each department's budget through a voucher system.

C. Employees are responsible for paying any cost of their safety footwear that exceeds the value of the voucher. Any excess cost to the employee above the value of the voucher is not reimbursable. The procedure for using the voucher program can be found on the Human Resources I Safety Section's web page.
