About this file

This is a Data Use Agreement (DUA) between the Defense Manpower Data Center (DMDC) and State Education Agencies (SEAs) for the MEDALS (Military Enlistment Data Access to Lift Student Success) pilot program. The agreement establishes a framework for secure data sharing between DoD and state education agencies to enable states to track high school graduates who enlist in the U.S. Armed Forces and incorporate military service into post-secondary success accountability reporting.

Under this DUA, SEAs will submit annual files containing prior-year high school graduates' names, dates of birth, and de-identified match IDs to DMDC, which will match this data against its internal enlistment records and return only yes/no responses to confirm enlistment status. Both parties commit to strict compliance with the Privacy Act, FERPA, and DoDI security standards including encryption, secure transmission protocols, personnel clearance requirements, and data destruction within one calendar month of match completion. The agreement prohibits unauthorized disclosure, third-party sharing, and use of data for purposes outside the stated objective; requires notification to DMDC within one hour of any breach; and mandates corrective action plans for violations. Data must be handled exclusively by U.S. citizens with appropriate clearances, stored only within U.S. borders, and protected according to NIST and OMB guidance. This pilot DUA represents a proof-of-concept approach for establishing a standardized, replicable multi-state data-sharing methodology between federal and state education agencies.

DEFENSE MANPOWER DATA CENTER 4800 MARK CENTER DRIVE, SUITE 04E25-01 ALEXANDRIA, VA 22350-6000

DATA USE AGREEMENT BETWEEN DEFENSE MANPOWER DATA CENTER (DMDC)

AND

<<State>> EDUCATION AGENCY (SEA) FOR MEDALS DATA SHARING AGREEMENT NUMBER: <<nnnnn>> This is a Data Use Agreement (DUA) between the Defense Manpower Data Center (DMDC) and the <<State Name Education Agency>>, also referred to as the State Education Agency (SEA). When referred to collectively, the DMDC and the SEA are referred to as the “Parties.”

BACKGROUND:

In order to properly protect data containing information protected by the Federal Privacy Act and other laws, and to maintain the confidence of the American public regarding the confidentiality of information collected and maintained by the Federal government, DMDC requires requestors and recipients of information and data provided by DMDC to adhere to those laws and agree to comply with the conditions set forth in this DUA. These requirements apply to the use of the data file released or any data derived from such file.

The <<State Name>> Education Agency (SEA) is the state agency that oversees primary and secondary public education. It is headed by the <<commissioner/secretary>> of education and seeks to improve outcomes for all public school students in the state by providing leadership, guidance, and support to school systems. AUTHORITIES: DoDI 4000.19, Support Agreements, December 16, 2020; DMDC 02 DoD, Defense Enrollment Eligibility Reporting System (DEERS), December 2, 2019, 84 FR 65975; DMDC 01, Defense Manpower Data Center Data Base, October 16, 2019, 84 FR 55293; Family Educational Rights and Privacy Act (FERPA), 20 U.S.C. 1232g and its implementing regulations at 34 C.F.R. Part 99; <<Insert state specific regs as appropriate. >>

PURPOSE:

On April 1, 2024, the U.S. Department of Defense (DoD) officials led by Assistant Secretary of Defense for Manpower and Reserve Affairs Ronald Keohane met with representatives of the Council of Chief State School Officers (CCSSO), the national nonpartisan, nonprofit organization representing state and territorial leaders of elementary and secondary education, and the Kansas Department of Education. In this meeting, CCSSO committed to convene a collaborative working group. The purpose of the group was to bring together state educational agency leaders, DoD officials, and other relevant entities to advance voluntary data-sharing agreements and identify potential IT Solutions with the eventual outcome of producing a secure, replicable, common, and standardized methodology for sharing military affiliation data with state education agencies. The overall deliverable of the project will securely add state-specific enlistment and service data into state education data systems. The outcomes of the working group include the following:

· Ongoing Commitment Affirmation: Establishment of a clear commitment between the Department of Defense and K-12 state education agencies that reiterates the importance of military service as a viable postsecondary pathway, allows military readiness to be included in the state education accountability plans, and provides a safe, secure, ongoing data-sharing between state and federal agencies related to military service.

· Development of a data matching and sharing protocol: Co-creation of a protocol to securely enable the necessary data thereby allowing states and territories to count military service as a viable postsecondary pathway. The protocol would include required data elements and a data sharing/match methodology meeting applicable procedural, security, retention, and privacy regulations.

· Creation of a standardized/universal data sharing structure: Co-creation of a standardized sharing structure that allows any state or territory to match against DoD data and obtain information on their students.

The objective of this DUA is to provide a “proof of concept” and minimally viable uniform, multi-state approach to match and transfer data between the DMDC and multiple agencies. The <<SEA>> requires matched graduating student data from DMDC in order to confirm the number of high school graduates enlisting into the U.S. Armed Forces.

The initial proof of concept pilot use of this data is for demonstrative purposes to prove that multiple SEA’s can successfully match a prior year high school graduate cohort with DMDC datasets and receive military enlistment information for their state. The project goals are to (1) assist state education agencies in determining the number of students that enlist in the U.S. Armed Forces following high school, and (2) improve the state education agencies’ calculations of post-secondary success for accountability reporting.

STUDENT DATA PRIVACY:

In accordance with FERPA, 20 U.S.C. § 1232g(b)(1)(C), (b)(3), and (b)(5) and 34 C.F.R. §§ 99.31(a)(3) and 99.35, DMDC is an authorized representative of <<SEA >> for the purposes of an audit or evaluation of Federal or State supported education programs.

To avoid Privacy Act infringement, the <<SEA>> will send DMDC a file each prior year (annually), which will include the First, Middle, and Last Name, Date of Birth (DoB), of prior year K-12 state-wide high school graduates including a de-identified unique match id for use to reassociate the returned recordset at the SEA. For this DUA, a single SEA match file of 2023-2024 state graduates will be used for the match. To accomplish this action, DMDC will match the data received from the <<SEA>> against their internal enlistment source data, and will release either a yes or no for each entry listed on the file the SEA provides. Such purpose and approach is consistent with applicable authority.

UNDERSTANDINGS OF THE PARTIES:
