About this file

This is a Certification of Workers' Rights document issued by the Washington Department of Fish and Wildlife (WDFW) for the Samish River Unit Tree and Shrub Planting Project. The document establishes compliance requirements with Executive Order 18-03 regarding workers' rights in state contracts. Bidders are required to certify whether their firm mandates employees to sign mandatory individual arbitration clauses or class or collective action waivers as a condition of employment. The certification must be completed by an authorized representative of the firm, signed under penalty of perjury under Washington state law, and include the firm's legal entity name, the signatory's printed name and title, the date signed, and the location where signed.

Firms that certify they do NOT require employees to sign mandatory individual arbitration clauses or class or collective action waivers are eligible to receive a 3% bid preference under the best value evaluation criteria. This preference incentivizes bidders to adopt worker-friendly employment practices aligned with state policy objectives. The certification is a mandatory submission component for any firm seeking to bid on this tree and shrub planting project and constitutes a binding declaration subject to the penalties of perjury under Washington law.
