About this file
This is an Appendix to a Department of General Services (DGS)-controlled procurement contract outlining electronic transaction fee requirements for statewide and agency-specific contracts administered by the State of Maryland. The appendix establishes mandatory fee submission procedures and reporting obligations for contractors engaged in sales under DGS contracts. Contractors must remit an electronic transaction fee equal to one percent (1%) of the total invoiced amount for all sales completed during each reporting period, calculated on the gross invoice amount less returns or credits. Payment is due no later than forty-five (45) calendar days after the end of each reporting period and may be submitted via Automated Clearing House (ACH) transfer or check payment to the Department of General Services, Fiscal Services Division in Baltimore, Maryland. The appendix becomes effective January 2026.
Contractors are prohibited from charging the electronic transaction fee directly to customers or itemizing it as a separate line item, surcharge, or fee on invoices; instead, the fee must be incorporated into contract unit prices. Simultaneously with fee payment, contractors must submit a Monthly Usage Report in Microsoft Excel format to the designated state email address documenting all contract sales during the applicable period. Failure to timely and accurately remit electronic transaction fees constitutes material default under the contract. ACH payments must include notation in the comments section identifying the payment as a "DGS 1% Fee," and all submissions must follow the state's prescribed reporting template.
