About this file
This document is a Maryland Living Wage Requirements Affidavit of Agreement from the Maryland State Finance and Procurement Article, effective July 2024. The affidavit requires contractors to affirm whether they are exempt from or will comply with the state's Living Wage Law for state contract activities. Contractors must either check exemption criteria (such as being a nonprofit, public service company, or having fewer than 10-11 employees depending on contract value) or commit to paying covered employees at least the living wage rate for hours spent on state contract activities.
The document outlines specific conditions for wage compliance, including paying the current living wage rate, ensuring subcontractors also comply, and submitting payroll reports to the Commissioner of Labor and Industry. Additional exemptions may apply for employees working less than half-time on the contract, employees 17 years or younger, or those working less than 13 consecutive weeks. The Commissioner reserves the right to request payroll records to verify these affirmations at any time, and contractors must submit this completed affidavit with their bid or proposal.
