About this file

This is a Questions and Answers document addressing contractor inquiries regarding a DEA roofing repair and replacement solicitation based on a Statement of Work requirement.

The Government will provide a Moisture Intrusion Study report identifying existing roofing system failures (flashing and seam failures, ponding, cracking, and surface degradation) as part of the RFQ documentation. For small business set-asides, prime contractors must complete at least 51% of the work, though subcontracting roofing installation, labor, materials, and related construction work to qualified commercial roofing contractors is permitted while the prime retains overall contract management and performance responsibility. Payment will be issued through performance-based payments in accordance with FAR Overhaul Clause 52.232-32, with final payment issued within 30 days of invoice receipt, inspection, and acceptance. The Government prohibits assignment of claims under 32.803(b), meaning contractors cannot utilize commercial financing or accounts-receivable factoring companies to finance eligible contract receivables, invoices, or progress payments through third-party providers. This is a new requirement with no incumbent contractor currently performing similar work; vendor names and contract numbers are not available for disclosure.

QUESTION GOVERNMENT RESPONSE

Section 2.2 of the Statement of Work references a Moisture and Water Intrusion Assessment Report that was previously conducted and identified failures in the existing roofing system (flashing and seam failures, ponding, cracking, and surface degradation). Would it be possible to obtain a copy of that report, or any associated roof inspection findings, in advance of a potential follow-on solicitation?

ANSWER: Yes. The Moisture Intrusion Study will be included in the RFQ.

Are there any limitations or specific requirements regarding the use of subcontractors for this requirement? Specifically, would the prime contractor be permitted to subcontract the roofing installation, labor, materials, and related construction work to a qualified commercial roofing contractor while retaining overall responsibility for contract management, supervision, coordination, compliance, and performance?

ANSWER:

a)If the requirement is a small business set-aside at least 51% of the work must be completed by the Prime contractor.

b)Yes.

If this requirement proceeds to solicitation and award, does the Government anticipate providing progress payments based upon ordering of materials, completed work, milestones, percentage of completion, or other periodic invoicing, or should contractors anticipate receiving payment only after the entire project has been completed and accepted? Also how long after completion should we anticipate payment?

ANSWER:

a) No. in accordance with FAR Overhaul Clause 52.232-32, Performance-based Payments will be offered

b) Once the final invoice has been submitted, inspected and accepted, payment will be issued within 30 days of receipt of a proper invoice.

Would the resulting contract permit the prime contractor to utilize a commercial financing or accounts-receivable factoring company to provide working capital for project expenses such as materials, subcontractor labor, and other costs incurred during performance? We are specifically interested in understanding whether the Government has any restrictions on assigning or financing eligible contract receivables, invoices, or progress payments through a third-party commercial financing provider.

ANSWER:

a) No

b) In accordance with 32.803(b), the Government is prohibiting the assignment of claims for this requirement.

Is the work outlined in the RFI a new requirement which the DEA is looking to procure, or whether there is an incumbent contractor in place who is currently performing similar work. If there are any incumbents, is it possible to learn the names of the vendors and any corresponding contract or task order numbers?

ANSWER:

a) No.

b) No.

c) Not applicable
