About this file

This document contains the Answers to Questions received for a state and local contract opportunity related to the procurement of All Season Cold Patch in the state of Nevada, specifically for the jurisdictions of Carson City. The contract allows for the award to the lowest responsible bidder, and the agency will not consider allowing awards to all vendors or providing for price escalation/de-escalation clauses during the contract term. The contract will require firm pricing for the duration of the agreement.

The contract term, renewals, and other specific details are not provided in the document. Funding requirements and sources, set-asides, and current incumbent information are also not included.

UPMHPM
Allow Awarding bid to all vendors
Many State agencies allow bids to be open and awarded to all vendors allowing for the most optimal material to be purchased for any given location vs all or nothing low bid. Would you consider changing wording of this bid to allow all to be awarded and then choose who you will buy from?
No, unless a bid is noted as "multiple award", statute requires us to award to the lowest responsible bidder. This is also the way the using agency prefers the award to be made to avoid confusion within their many statewide stockrooms.

UPMHPM
Allow for Price escalation/de-escalation
Will you consider including a clause that would allow price adjustment up or down based on say the Nevada Asphalt index or some other index such as the Industrial PPI, etc.
No, Prices must remain firm for the term of the contract.
