About this file
This document contains a comprehensive set of answered questions related to a Request for Proposal (RFP) issued by the San Luis Valley Boys & Girls Club for a Phase 1 Environmental Site Assessment (ESA) for their proposed Early Care and Learning Center in Alamosa, Colorado. The RFP seeks a consultant to complete a NEPA Environmental Assessment (EA) per HUD's 24 CFR Part 58 requirements, with a notice of award date of August 29, 2024, and a study completion target of October 31, 2024. The project is specifically tied to accessing a Community Development Block Grant (CDBG) from the Colorado Department of Local Affairs (DOLA), with construction contingent on meeting HUD requirements and releasing funds.
The environmental assessment will involve evaluating all potential contaminants and toxic substances at the project site, following specific HUD regulations. The RFP allows for electronic or paper proposal submissions, and while the timeline is expedited, the organization will remain flexible to meet HUD requirements. The project involves a ceremonial groundbreaking anticipated in Fall 2024, and the Boys & Girls Club already possesses a No Further Action (NFA) letter from 2022. The environmental review is primarily a procedural requirement to secure CDBG funding, with the previous environmental clearance suggesting minimal additional environmental work will be needed. The selected consultant will need to submit a Part 58 Environmental Assessment Form with attachments, including a full Phase 1 Report.

Answered Questions: Boys & Girls Club SLV ECL Phase 1 RFP
1. The RFP seems to be looking for a consultant to perform a Phase 1 ESA, but the description of the project in the Scope of Work on page 2 of the RFP is a description of a NEPA
Environmental Assessment (EA). The link to the required HUD form on Page 2 of the RFP is also a link to a NEPA EA form. Can we get confirmation whether the Club is looking for a firm to perform, A, just a Phase 1 ESA per the ASTM 1527 Standard; B, a NEPA EA; or C, a Phase I
ESA per the ASTM 1527 Standard in addition to the NEPA EA required by HUD for the CDBG from DOLA?
a. The Environmental Review required by HUD is the NEPA Environmental Assessment
(Or Part 58 Environmental Assessment). The Phase 1 will need to be completed and included in the NEPA EA. The Phase 1 report will be included as an attachment to the NEPA EA as proof of compliance for the specific factors that are being reviewed.
Oftentimes on these projects, one firm will do a Phase 1 and another will do the EA but some projects just have one firm complete both. The choice is up to you.
2. On the required HUD form for the NEPA EA, one of the requirements is an assessment of contaminants and toxic substances. To satisfy that requirement, for what kinds of contaminants or toxic substances will the Club want the site investigated? Asbestos?
Lead-based paint? Petroleum hydrocarbon releases? Etc
a. All potential contaminants/toxic substances must be evaluated. The specific regulation for contaminants/toxic substances can be found at 24 CFR Part 58.5(i). I have also attached a HUD Worksheet that is specific for compliance with contamination/toxic substances for your reference. This link has worksheets that go over each compliance factor and what you need to be in compliance. If any of the bidders have questions about the other compliance areas, these are great resources to see what it will take for the EA but you can always reach out with more specific questions.
3. Using HEROS to deliver the report? Using the HEROS worksheets but submitting using the current EA Part 58 forms (Attached) in PDF/hardcopy? Or Using the 4128 form (or other form) and submitting in PDF/Hardcopy?
a. The Part 58 Environmental Assessment Form and the Environmental Review Partner
Worksheets are hyperlinked. Only the Part 58 Environmental Assessment needs to be submitted but the partner worksheets can help you complete the Environmental
Assessment. · The Part 58 Environmental Assessment Form will be emailed to me with the necessary attachments (this will likely include the full Phase 1 Report) once https://urldefense.com/v3/__https:/www.hudexchange.info/resource/3140/part-58-environmental-assessment-form/__;!!NLb8tKzEWkjbfA!iqNK44U-F4Fg-1XVF7lDR0jp3iswjAOd_TUtqi6blhT0b4Lj0yw3KW-x8OXjT8zSmsNJdEDg7_9bU773lF8$ https://urldefense.com/v3/__https:/www.hudexchange.info/resource/5119/environmental-review-record-related-federal-laws-and-authorities-partner-worksheets/__;!!NLb8tKzEWkjbfA!iqNK44U-F4Fg-1XVF7lDR0jp3iswjAOd_TUtqi6blhT0b4Lj0yw3KW-x8OXjT8zSmsNJdEDg7_9bX_N6IJY$ https://urldefense.com/v3/__https:/www.hudexchange.info/resource/5119/environmental-review-record-related-federal-laws-and-authorities-partner-worksheets/__;!!NLb8tKzEWkjbfA!iqNK44U-F4Fg-1XVF7lDR0jp3iswjAOd_TUtqi6blhT0b4Lj0yw3KW-x8OXjT8zSmsNJdEDg7_9bX_N6IJY$ https://urldefense.com/v3/__https:/www.hudexchange.info/resource/3140/part-58-environmental-assessment-form/__;!!NLb8tKzEWkjbfA!iqNK44U-F4Fg-1XVF7lDR0jp3iswjAOd_TUtqi6blhT0b4Lj0yw3KW-x8OXjT8zSmsNJdEDg7_9bU773lF8$ completed. However, I will look at drafts prior to the final version to make sure the final version is compliant and can receive a Release of Funds.
4. Has a pre-existing phase one, geotechnical surveys, historical documents exist for the property?
a. No
5. If so, we they be available in an addendum?
a. N/A
6. As instruction state electronic submission and/or paper copy, is an email proposal only acceptable?
a. Yes
7. Can you please clarify if the RFP is for: A Phase I Environmental Site Assessment per ASTM
International’s E1527–21 ‘‘Standard Practice for Environmental Site Assessments: Phase I
Environmental Site Assessment Process";or for An Environmental Assessment per
"Environmental Assessment Determinations and Compliance Findings for HUD-assisted
Projects 24 CFR Part 58"?
a. An Environmental Assessment per "Environmental Assessment Determinations and
Compliance Findings for HUD-assisted Projects 24 CFR Part 58"?
8. The notice of award date is August 29, 2024, with a study completion date of October 31, 2024 (around 60 days). EA’s typically include an 30-day agency scoping period as well as a
30-day public comment period. Are these comment periods included in the overall schedule, or is HUD waving these comment periods for your project?
a. We have not received a waiver, this timeline is the quickest that was advised by
HUD. We will be flexible with dates in order to meet HUD requirements. October
31st is a tentative goal and included in the RFP to stress how expedited the study needs to be so we can access CDBG funds.
9. Since groundbreaking is anticipated in the Fall of 2024, have any required environmental permits already been acquired, or is it the intent of the RFP to also include all necessary environmental permitting in the same 60-day time period?
a. We have some previous environmental assessment documents including the NFA letter from 2022. The RFP should include all permitting in the same period. It is a ceremonial groundbreaking. Construction is contingent on the release of the CDBG funds and construction will commence when HUD requirements are met. The previous environmental clearance that was approved by OPS and the history of the site itself leads us to believe that there will be no further environmental work needed. The Phase 1 is being completed to meet the CDBG funding requirement.
