About this file

This document is an Annual Required Affidavit for Bidders, Offerors and Contractors issued by the Commonwealth of Kentucky, effective for a maximum one-year period. The affidavit serves as a mandatory compliance document for all entities seeking to bid on or enter into contracts with the state of Kentucky. Bidders and offerors must certify under penalty of perjury their compliance with various Kentucky state laws and regulations, including campaign finance laws (KRS 45A.110 and 45A.115), lobbyist restrictions, disclosure requirements, and boycott prohibitions. The affidavit applies to all general bids and contracts, with additional requirements applicable to non-bid contracts such as sole-source, non-feasible-to-bid, and emergency contracts. The document requires a duly authorized representative to sign and have the affidavit notarized, with an acknowledgment that the Commonwealth relies on the accuracy of stated information for contract award decisions.

The affidavit imposes multiple compliance certifications without specifying pricing terms or set-asides, as it functions as a prerequisite compliance document rather than a procurement specification. Key requirements include confirmation that neither the bidder nor affiliated entities have violated Kentucky campaign finance laws; proper registration with the Kentucky Department of Revenue for sales and use tax collection; current good standing on all state taxes and fees; non-participation in trade boycotts as defined by KRS 45A.607; and compliance with executive agency lobbyist restrictions under KRS 11A.236 for the preceding ten years. For non-bid contracts specifically, additional restrictions apply regarding campaign contributions to gubernatorial slates and elected officials with jurisdiction over the contract. The Commonwealth reserves the right to request updated affidavits at any time, and any non-compliance during the affidavit effective period must be immediately reported to the Finance and Administration Cabinet, Office of Procurement Services, with potential consequences including contract termination and repayment of funds.
