About this file
This is an Annual Required Affidavit for Bidders, Offerors and Contractors mandated by the Commonwealth of Kentucky under KRS 45A.110 and 45A.115. The affidavit is effective for one year from the date of execution and must be submitted by an authorized representative of any bidder, offeror, or contractor seeking to be awarded a contract or for contract renewal with the Commonwealth. The form requires the authorized representative to complete an attestation, have it notarized, and return the completed affidavit to the Commonwealth. No specific products, services, project scope, quantities, response dates, or contract terms are defined in this document, as it serves as a standardized compliance form applicable across all state contracting opportunities.
The attestation requires the contractor to swear under penalty of perjury that the bidder has not knowingly violated Kentucky campaign finance laws and that awarding the contract will not violate any provision of those laws. The term "knowingly" is defined as awareness or reasonable awareness of a violation's existence. The form must be executed by an authorized representative with notarization before a notary public, and the Commonwealth retains the right to request an updated affidavit at any time during the contract period. This affidavit is a mandatory compliance requirement with no pricing terms, set-asides, or funding considerations addressed within the document itself.
