About this file
This is an Annual Required Affidavit for Bidders, Offerors and Contractors issued by the Commonwealth of Kentucky, specifically by the Cabinet for Health and Family Services (CHFS) Office of Administrative and Technology Services (OATS) Division of Procurement Services. The affidavit document establishes mandatory compliance requirements that bidders and contractors must acknowledge and certify under penalty of perjury prior to contract award. The affidavit is effective for a maximum length of one year and must be notarized and signed by a duly authorized representative of the bidding entity.
The affidavit requires bidders and contractors to affirm compliance with multiple Kentucky statutes and executive orders, including: campaign finance laws under KRS 45A.110 and 45A.115; disclosure requirements under KRS 45A.485 regarding subcontractors; sales and use tax registration under KRS Chapter 139; state tax and fee payment obligations; prohibitions against boycotts of open-trade jurisdictions as defined in Executive Order 2018-905; and restrictions outlined in KRS 11A.236. For non-bid contracts (sole-source, not practical to bid, or emergency contracts), additional affirmations are required regarding campaign contributions to gubernatorial candidates and elected officials with jurisdiction over the contract, with specified limits of $5,000 in aggregate contributions and a $30,000 aggregate solicitation threshold. The affiant must certify full awareness of all statements' accuracy and acknowledge that the Commonwealth relies on the truthfulness of these representations for contract award decisions.
