About this file
This is an Annual Affidavit form required by the Commonwealth of Kentucky for all bidders, offerors, and contractors on state and local contracts. The affidavit establishes compliance requirements and certifications that must be sworn under penalty of perjury. For all bids and contracts in general, entities must certify compliance with Kentucky campaign finance laws (KRS 45A.110 and KRS 45A.115), acknowledge awareness of requirements under KRS 45A.485 regarding subcontractor disclosures, confirm registration with the Kentucky Department of Revenue for sales and use tax collection, attest to non-delinquency on state taxes and fees, confirm non-participation in boycotts of jurisdictions with which Kentucky maintains open trade (KRS 45A.607), and pledge compliance with prohibitions outlined in KRS 11A.236 over the previous ten years. The affidavit is effective for a maximum of one year and requires signature by a duly authorized representative before a notary public.
For non-bid contracts including sole-source, non-practical-to-bid, or emergency contracts, additional certifications are required regarding campaign contributions. Contractors must affirm that neither they nor immediate family members with 10% or greater business interest have contributed more than the amount specified in KRS 121.150 to the gubernatorial slate elected in the preceding election. Officers, employees, and affiliated entities must not have knowingly contributed more than $5,000 in aggregate to campaigns of elected officials with jurisdiction over the contract award. Additionally, contractors must certify that neither they nor affiliated parties have directly solicited contributions exceeding $30,000 in aggregate for such campaigns. Non-compliance with affidavit statements during the effective period requires immediate notification to the Finance and Administration Cabinet, Office of Procurement Services, and the Commonwealth reserves the right to request updated affidavits at any time.
