About this file
This is a Required Affidavit form issued by the Commonwealth of Kentucky for bidders, offerors, and contractors seeking to be awarded state contracts or contract renewals. The affidavit is effective for one year from the date of execution and is mandated under Kentucky Revised Statutes 45A.110 and 45A.115. An authorized representative of the contracting party must complete the attestation, obtain notarization, and submit the completed affidavit to the Commonwealth. The form requires the contractor to swear under penalty of perjury that it has not knowingly violated Kentucky's campaign finance laws and that contract award will not violate any provision of such laws. The term "knowingly" is defined as awareness or reasonable awareness of a violation's existence. The Commonwealth retains the right to request an updated affidavit at any time during the contract period.
The affidavit requires submission of contractor identification information including legal name, address, and Commonwealth vendor code if known. A duly authorized representative must sign and date the attestation, which must then be notarized by a notary public who must provide their signature, commission expiration date, and identify the state and county where the oath was administered. This document serves as a compliance certification requirement for all bidders and offerors on Kentucky state and local contract opportunities and does not contain pricing information, set-asides, or funding details specific to any individual procurement.
