About this file
This is a Required Affidavit for Bidders, Offerors, and Contractors established by the Commonwealth of Kentucky pursuant to KRS 45A.110 and 45A.115. The affidavit must be submitted by any bidder, offeror, or contractor seeking to be awarded a contract or renewing an existing contract with the Commonwealth. An authorized representative of the contracting party must complete the attestation, obtain notarization, and submit the completed affidavit to the Commonwealth. The affidavit is effective for one year from the date of execution. No specific products, services, project timelines, bidder meetings, or contract terms are detailed in this document, as it serves as a standardized compliance instrument applicable across multiple procurement opportunities.
The affidavit requires the authorized representative to attest under penalty of perjury that the contractor has not knowingly violated Kentucky campaign finance laws and that contract award will not violate any provision of those laws. "Knowingly" is defined as awareness or should-have-been awareness of a violation's existence. The document requires the bidder or offeror to provide their name, address, and Commonwealth Vendor Code, along with notarization by a notary public with commission expiration date. The Commonwealth retains the right to request an updated affidavit at any time during the contract period. This affidavit serves as a prerequisite compliance document rather than addressing pricing, set-asides, or funding mechanisms.
