Subject: Request for Proposal (RFP) ANCDF-RFP-AM-444 Liquid Incinerator (LIC) Refractory Repair, Post-Inspection
Attn: Prospective Offerors:
Westinghouse Anniston (WA) is soliciting proposals from qualified firms for repairs to the refractory within the LIC at Anniston Chemical Agent Disposal Facility (ANCDF), as described in the solicitation package which can be accessed at http://ancdfscpm.wgint.com/ located at Solicitations / Subcontracting Solicitations / ANCDF-RFP-AM-444 or at http://fbo.gov/ . If any documents are missing, contact the undersigned immediately. It is the Offeror’s responsibility to ensure that their proposal is based on the entire RFP package.
Westinghouse Anniston, URS Corporation, is the Systems Contractor operating the Anniston Chemical Agent Disposal Facility for the U.S. Army Chemical Materials Agency. Located 60 miles east of Birmingham, Ala., ANCDF is designed to destroy chemical nerve (GB, VX) and mustard (HD, HT) agent contained in thousands of munitions stored at Anniston Army Depot. URS is the systems contractor for similar chemical agent destruction facilities in Umatilla, OR and Pine Bluff, AR and the Tooele, UT facility.
WA anticipates that the work being solicited for will be performed during September 2010.
The exact start date is currently unavailable at the time of the issuance of this solicitation.
LIC drawings are included in the solicitation package.
In addition to your review of the technical detail related to the scope of the work, please review Sections E, QA requirements; Section H, Special Requirements for work on the ANCDF facility, and Section I for subject terms and conditions.

WA will not be conducting a pre-bid walk-down inspection of the work site, because the furnace is currently in use.
This solicitation does not commit WA or the Government to pay any costs incurred in the preparation and submission of a proposal in any form or to procure or subcontract for said services or supplies. It is also brought to each offeror’s attention that the WA Subcontract Administrator is the only individual who can commit WA to expenditure of the funds in connection with any subcontract resulting from this solicitation. The award of a subcontract pursuant to this RFP is Subject to the Availability of Government Funds.

Proposals will be evaluated based on the evaluation criteria identified in Section M of this document. Only qualified, licensed responders will be considered for award and the final award decision shall be based on a best value continuum as defined in FAR 15.101 and may include a trade-off process as defined in FAR 15.101-1. Offerors are advised that WA may award a subcontract after evaluation of proposals received without discussions with offerors.
Award of this subcontract will be made to the responsive offeror whose proposal conforms most favorably to the requirements of the solicitation and is most advantageous to WA and the government. When combined, all non-cost factors and sub-factors are more significant for evaluation of proposals than price alone.
Offerors shall provide one (1) hard copy.
The following RFP Sections and attachments must be completed and submitted with proposals. Incomplete proposals may be considered non-responsive:

WESTINGHOUSE ANNISTON (WA), Washington Government Environmental Services, LLC, URS, who is a prime contractor under Department of the Army Contract DAAA09-96-C-0018, intends to award, if needed, a Firm Fixed Price Subcontract for LIC System Refractory Repair at the Anniston Chemical Agent Disposal Facility (ANCDF) in Alabama.
SOLICITATION
You are requested to submit a Firm Fixed Price Offer to accomplish the work described herein understanding that WA may award a binding subcontract without amendment or further discussion of your Proposal. Your Offer, therefore, should be initially submitted providing your best terms of a price. However, WA reserves the right to reject any and all offers and shall not be liable for costs incurred in the preparation of proposals. Your attention is directed to Section L of this RFP that contains the instructions for preparation of offers. Failure to follow the instructions may render the proposal non-responsive and result in rejection thereof. The award of this RFP is Subject to the Availability of Government Funds.

PURPOSE OF PROCUREMENT:
Liquid Incinerator (LIC) Refractory Repairs, Post-Inspection
Scope of Work
Work Provided by Refractory Repair/Replacement Contractor ANCDF is soliciting the services of a Contractor to perform repair and/or replacement of the refractory systems in the ANCDF Liquid Agent Incineration (LIC) Furnace system.
Liquid Incinerator (LIC) System Refractory Repair
The Contractor will be provided with a detailed written inspection report (by a third party), covering all systems in the LIC, describing the as-found condition, and providing estimated remaining usable life. The report will recommend corrective actions as required (Use as-is, repairs, or replacement, future repairs and schedule.) The report will describe slag volume in the system, and where major deposits are found.
The contractor will review the report and at the direction, and Notice to Proceed (NTP), from ANCDF, perform the replacement of the refractory sub-systems in the LIC Furnace system.
Furnace System floors (Sections 1.02.2 and 1.04.1) will be repaired and reskinned as required to support the completion of the ongoing HD/HT Mustard Campaign. Contractor must be able to start three days after report delivery and NTP with replacement of identified sub-systems.
The Contractor will provide a restart plan for the LIC PCC and LIC SCC, with temperature reheat profile for each furnace system.
The system will be separated into the following sections.
Quotes for each section should be prepared to allow the minimum replacement scope necessary.
Annotated Drawings to define the subsystems of the LIC Furnace system will be provided.

Contractor shall, perform repairs and/or refractory replacement on each section of the LIC Furnace System, as authorized by ANCDF. Repairs and refractory replacement will include the removal of all slag and placement into ANCDF supplied roll-off containers for disposal by ANCDF. Refractory shall be replaced with refractory and mortar in kind as specified in the site drawings and specifications.
1.04.5 LIC SCC Slag Pit Refractory includes, in addition to the replacement of the slag pit refractory, the removal of all slag, including free and attached slag, in the slag pit and place in site provided containers for analysis and disposal by ANCDF. All free and attached slag is to be quantified by the Contractors and provided to ANCDF as a total slag formed (as found) estimate.
Contractor shall also stage refractory materials at entrances to the furnace and perform fit-up of the refractory components as required.
Contractor shall determine and provide to ANCDF, as-installed available SCC refractory expansion estimates for the LIC Restart Plan Documentation and for comparison with historic expansion allowances. Particular attention shall be applied to the vertical exhaust duct and the Refractory support shelves both existing and replacement, and the Upper Horizontal Duct refractory venturi. Contractor shall provide as installed refractory expansion estimates and allowances for the LIC Restart Plan.
In 1.06 LIC Vertical Exhaust Duct, the section 1.06.1 Vertical Exhaust Duct Support Shelves, the contractor shall measure the “as installed” shelf gap and the measurements shall be reported as “prior to” and “as left’ repacking of the joints.
Contractor shall segregate un-used ANCDF refractory materials by their respective compositions, grades, and sizes and palletized for subsequent re-stocking and future use. An inventory of the un-used materials is to be made and provided.
All Contractor equipment is to be brought to the agreed staging area, clearly marked with Contractor identification and address for subsequent shipment to the Contractor’s office. An

inventory of Contractor Equipment and Storage boxes and facilities shall be provided to ANCDF. This shall include the following:
Refractory Saw power requirement (amps, volts), power connectors and physical size, Lifting equipment (cranes, cherry pickers, man lifts) physical sizes and lay-down areas, Site Trailers foot prints, hook up locations and fixtures personnel lockers, showers, toilets, sinks) for crew(s) and/or for storage of supplies such as PPE, and other consumables.
Fork lifts, capacity, sizes and fuel used, Gang box number and sizes.
Site inspection by the Crew Chief and the Technical Point of Contact/Process Coordinator will be performed to document the clean up of the work areas and the proper staging of equipment for subsequent shipment off-site. Contractor is responsible the site cleanliness daily and at the completion of the work requirements.
Assets Provided by Refractory Repair/Replacement Contractor Contractor shall provide personnel experts in refractory materials and experienced in construction of furnaces similar to the LIC Primary Furnace, LIC Secondary Furnace and LIC Exhaust Duct at ANCDF. Personnel will have been approved by ANCDF for Chemical Limited Area (CLA) entry.
Submittals
The following submittals of documentation of personnel and equipment shall be provided:
1. Provide documentation regarding personnel HAZWOPER Training Certification.
2. Provide documentation regarding personnel Confined Space Training Certification for all entrants and hole watch.
3. Provide documentation regarding personnel Respiratory Training Certification for all entrants and hole watch.
4. Provide documentation regarding personnel Lock-Out/Tag-Out Training Certification for all entrants and hole watch.
5. Provide documentation regarding personnel Scaffold User Training Certification for all users.
6. Provide documentation regarding personnel Scaffold Builder/Inspector Training
Certification for one or more individuals responsible for Scaffold.
7. Provide documentation regarding personnel OSHA logs for 3 years.
8. Provide documentation regarding personnel Heat Stress Prevention Training Certification if not using ANCDF program.
9. Provide identification of Project Lead on Site, Designated Safety Representative and
Crew Chief on Site. Lead or crew chief will be on site and available to ANCDF whenever work is being performed.
10. Welding Procedure Specifications (WPS), Welder Certifications, and materials certifications (for Vertical Duct refractory support shelf replacement).
11. Site Access forms for the Chemical Limited area for any anticipated personnel.
12. Current Inspection reports of all Scaffolding materials
SECTION C DESCRIPTION/SPECS/WORK STATEMENT
Materials Provided by Refractory Repair/Replacement Contractor
Contractor shall provide all metals for replacement of refractory supports and shelves with like-kind per ANCDF Specification. This shall include all welding rod IAW ANCDF specification.
Work, Assets, and Materials provided by ANCDF
Welding Inspection will be provided by ANCDF/URS QA. Where applicable the inspections will be performed prior to the removal of the means of access (scaffold for vertical segment) or the closure of manhole penetrations for the balance of the LIC Furnace System.
ANCDF shall also provide the following services and materials in support of the Refractory Contractor:
Provide 25 or 40 ton cooler/chiller for cooling LIC system including re-positioning the system as work proceeds.
Open LIC SCC Exhaust Duct Manholes and Quench Tower Lower Manhole, as needed. Close LIC SCC Exhaust Duct Manhole and Quench Tower Lower Manhole at the conclusion of the repair and inspection activities.
Disconnect and reconnect all instrumentation in LIC Furnace system.
Flush, drain and disconnect and reconnect all Spent Decon and Process Water piping going to the LIC Furn-202.
Remove LIC PCC Wind box and Replace at conclusion of all of the Inspection and Repair Activities.
Secure and downgrade LIC Furnace Chamber Rooms from CEA to CLA during the performance of work, and restore the LIC Chambers at the completion of work.
ANCDF shall provide all refractory brick, board, felt wool and mortar as stipulated in the specifications and as shown in the drawings for the recommended repairs to the LIC Furnaces and Duct work. These materials will be staged adjacent to the Munitions Demilitarization Building, the Pollution Abatement Building or across the road on gravel between the Brine Reduction Area Building and the Laboratory.
ANCDF shall build and place “Saw Enclosures” adjacent to the furnace and duct openings.
Each station will have its own electrical power supply. The enclosure adjacent to the LIC Secondary Exhaust manway will be large enough for 2 saw stations. The enclosure adjacent to the last exhaust duct manway before the Quench Tower will accommodate a single saw station.
SECTION C DESCRIPTION/SPECS/WORK STATEMENT
Final electrical, potable water and sanitary tie-ins will be made by ANCDF at the identified tie-in points.
Document the pre-repair alignment of the external ductwork expansion joints and make the necessary adjustments to accommodate the anticipated expansion as indicated on the manufacturer’s drawings and specifications.
Complete thermal imaging survey of the LIC Furnaces and exhaust ducts.
ANCDF shall provide process water for saw station use.
ANCDF shall dispose of the accumulated water contaminated during the operation of the saws (that has been placed in containers provided by ANCDF) in accordance with the site waste plan.
ANCDF shall remove, and re-position LIC-FURN-202 Top Plate on supports from furnace to wall separating LIC Primary and Secondary furnaces should the inspection warrant exercise of the repair option for the Secondary Combustion chamber refractory lining. ANCDF shall restore this system at the completion of work.
ANCDF shall remove, and re-position LIC-FURN-201 Top Plate using Eye-bolts embedded in the ceiling should the inspection warrant exercise of the repair option for the Primary Combustion chamber refractory lining. ANCDF shall restore this system at the completion of work.
Accumulated refractory debris and slag from removal, repairs and saw station operations will be taken from the ANCDF-provided roll-off containers and bins and disposed of in accordance with the waste plans for the various types of refractory.
ANCDF Safety shall provide Confined Space evaluations for “Permitted” and “Non-Permitted” Confined Space entries by any and all personnel.
Work/Assets and Materials Provided by Third Parties Refractory inspections will be conducted for compliance with the specifications and drawings, “as installed” available expansion verification, supplemental photographic documentation and to assess workmanship. Site and/or Third Party Inspection Personnel may be used. The findings will be added to the LIC Restart Plan Documentation. The inspections will be performed prior to the removal of the means of access (scaffold for vertical segment) or the closure of manhole penetrations for the balance of the LIC Furnace System.

I. SUMMARY OF WORK
WESTINGHOUSE ANNISTON (WA), Washington Government Environmental Services, LLC, URS, who is a prime contractor under Department of the Army Contract DAAA09-96-C-0018, intends to award, if needed, a Firm Fixed Price Subcontract for LIC System Refractory Repair at the Anniston Chemical Agent Disposal Facility (ANCDF) in Alabama.
II. LOCATION OF WORK
The work is located at the Anniston Chemical Agent Disposal Facility (ANCDF) located off of the Morrisville Road, adjacent to the Calhoun County Transfer Station and Landfill.
III. COMMENCEMENT OF WORK
Prior to contract award and notice to proceed, the Contractor shall submit an acceptable Accident Prevention/Safety Program, including Job Hazard Analysis, before work may commence but no later than the award Kick-Off Meeting, as required by Article H-66-II, paragraphs 1-2, Section H, Safety.
The Contractor’s Safety Program must be approved by WA and implemented prior to contract award and commencement of any on-site work. The time specified for completion of the work shall include final cleanup of the premises.
The work shall be completed within the WA approved Contractor’s progress schedule (no more than 160 hours)
The Contractor shall furnish sufficient forces and equipment, as may be necessary to insure the prosecution of the work in accordance with the approved schedule. In the event the Contractor falls behind in the scheduled work, the Contractor shall take steps as may be necessary to improve progress, including increasing the number of crews and/or the amount of equipment, subject to WA approval, all without additional cost to WA.
IV. PROJECT SCHEDULE
The Contractor shall provide a detailed project schedule before work may commence but no later than the award Kick-Off Meeting. The schedule shall:
• consist of a Gantt type bar chart including Activity descriptions, duration, and constraints.
• identify all submittal requirements and the time frame for submission
• be subdivided to the lowest reasonable detail as dictated by the scope of work.
• be in sufficient detail to allow a thorough review by WA.
V. QUALITY ASSURANCE/QUALITY CONTROL REQUIREMENTS
The Contractor shall perform all work in accordance with the Contract, including the referenced Specifications, Drawings, Codes and Standards included in the Scope of Work (SOW). The Contractor shall designate an on-site Point of Contact (POC) for the Project with the authority to assure the quality of the workmanship. This POC will have authority to stop work, and make decisions affecting the scope of work in the event quality related deficiencies are discovered.

VIII. REQUIREMENTS FOR QUALIFICATION TO PERFORM WORK AT ANCDF
(Contractors)
1. Contractor Licenses
Contractor and its Subcontractor(s), if any, must be licensed in to perform the work as detailed in Section C. Copies of currently valid licenses must be submitted to WA Subcontract Administration prior to bid award.
2. Additional Contractor Requirements
The following documentation must be provided and approved by WA prior to award of subcontracts:
a. Proof of Insurance, compliant with WA prescribed coverages, amounts and endorsements (See Section H, Article 6, for specific insurance requirements).
b. Copy of current Accident Prevention/Safety Plan, approved by WA. The Safety Plan must include Contractor’s Experience Modification Rate (EMR) for the prior three (3) years, and an industrial hygiene exposure monitoring procedure. An acceptable Job Hazard Analysis (JHA) must be submitted by contractor prior to the beginning of any work on –site.
c. Copy of current QA/QC program, approved by WA, as applicable to a resulting subcontract.
3. Requirements for all Contractor Personnel Working on the ANCDF Site
a. Certificates of completion of specialized training which may be required, depending upon the scope of the project, including but not limited to: welding certification, scaffold erection, scaffold use, work in confined space, Lockout/Tagout procedures, ladder safety and fall protection, must be submitted prior to beginning work.
b. Submission and WA approval of Physicians statement concerning the wearing of respiratory protection equipment.
c. Submission of Personal Data Forms and approval of personal background check conducted by ANAD, required for badging and access to the site, including the Chemical Limited Area (CLA).
d. U.S. citizenship requirement (Foreign Nationals working on the WANCDF site require prior written approval from the ANAD Commanding Officer).

F-1 DELIVERIES
The work is located on the Anniston Army Depot located in Anniston, Alabama in Calhoun County located off of Morrisville Road, adjacent to the Calhoun County Transfer Station and Landfill.
F-2 KICK-OFF MEETING
An award Kick-Off Meeting shall be scheduled by WA to execute Subcontract documentation of award, receive submittals as designated throughout this RFP, introduce all concerned parties, and discuss any issues. The meeting is typically held within three weeks or less of notice of award.
F-3 PERFORMANCE
Until acceptance of the inspection report, this is unknown. Once the report is accepted a schedule shall be agreed to. Subcontract is expected to stay on schedule even if it requires longer working hours or additional manpower, all at no additional cost. All repairs shall be completed within the allotted 160 hours.
F-4 WEEKLY STATUS MEETING
Weekly status meetings may be held to discuss the project safety, quality assurance, performance schedule, material order summary security, and workmanship. WA Oversight will schedule the meetings as required.
F-5 DAILY PROGRESS REPORT
No later than 4:30 pm each day, the Contractor shall furnish to WA one copy of a detailed Daily Progress Report, covering all labor and supervision of the Contractor and each of its lower-tier contractors for the previous day. The Contractor’s daily Progress Report shall include as appropriate the following information:
a. A complete description of effort underway during the timeframe of the report, including identification of each item of work by the schedule.
b. Off-site Contractor activities.
c. Instructions received from WA.
d. All required tests taken, previous day’s quality inspections performed and results, and a list of the next days planned QC inspections.
e. Weather conditions.
f. All injuries, regardless of severity.
g. Unplanned work stoppages/delays.
h. Results of the daily site safety inspection including any safety hazards observed and corrective action taken.
i. Resource information to include size of work force, by Contractor, and by lower-tier contractors, by the trades involved and equipment used. The daily resource information must indicate both the daily and a running total of man-hours expended on the project, and a list of major items of equipment on-site.
j. In all cases, the Daily Progress Report shall be verified and signed by the person designated this responsibility by the Contractor.
k. The Reports should be consecutively numbered and dated.
Retainage may be enforced by WA until daily reports are submitted up to the current date.

Receipts and documentation for costs incurred for firm-fixed price subcontracts is not required.
The information shown below in paragraph VIII. is provided as a guideline for formulation of prices; and shall be applicable in the event modifications are issued to firm-fixed price subcontracts which include travel.
Invoices shall not be submitted to WA for Requests for Equitable Adjustments (REA) for delays until a negotiated amount has been agreed upon by Subcontractor and WA. REA’s for delays submitted to WA must be accompanied by WA Process Coordinator countersigned Daily Work Reports including a description of the circumstances of the delay and the number of delay hours identified by employee.
IV. Payment Terms
Unless otherwise requested prior to contract award and approved by the WA Subcontract Manager, payments shall be made Net 30 days after receipt of an acceptable invoice. Invoices shall be submitted only after the completion of sublet work and final acceptance by WA. All requests for changes to the payment terms shall be submitted in writing for approval to the WA Contract Administrator prior to award of subcontract.
V. Title
Except as may be specified elsewhere in this Subcontract, title to Material and Supplies shall pass to the Government at time of acceptance of the Work by WA.

VI. Certificates of Insurance and Daily Work Reports.
Subcontractor shall provide WA Subcontracts Dept. with acceptable certificate of insurance in accordance with requirements identified in Section H-6 of this document. Subcontractor shall not begin on-site work before WA receives and approves insurance certificate.
Subcontractor shall provide at each weekly project status meeting, revised project schedule.
Daily reports shall be submitted to WA by Subcontractor no later than close of business the following day of the report date. A lock-box for deposit of Daily Reports is available at the left side of the north entrance stairs at the PMOC building CD012 for use in the event the PMOC building is locked.
VII. Authorization to Proceed; Not-to-Exceed Amounts (NTE)
In the event that WA issues Authorizations to Proceed for Subcontracts, Task Orders, Modifications or Purchase Orders with a “not to exceed” (NTE) dollar amount, WA will not be obligated to pay, or be liable for charges exceeding the stated NTE dollar amount without prior notification by Subcontractor to the WA Subcontract Administrator, that the not to exceed amount is expected to be exceeded, and receipt of subsequent written approval by WA Contracts to incur costs above the initial NTE amount stated in the subcontract and in accordance with FAR 52.232-7 for Time and Materials and Labor Hour subcontracts.
Subcontractors are advised that they are to notify WA in writing upon incurring costs reaching 75% of the authorized Not-to-Exceed amount.
VIII. Allowable Travel Charges
All travel costs shall be charged in accordance with current allowable rates prescribed in the Federal Travel Regulation (FTR); specific details may be found at the website http://gsa.gov.
under the Section entitled Travel Resources.
Receipts and Documentation:
For time and materials and labor hour subcontracts, the information provided below identifies those allowable travel expenses and rates at which WA will reimburse subcontractors. Receipts for all travel related costs incurred (except for daily per-diem allowance) must be provided with invoices. WA will not be responsible for payment of any travel costs not supported by proper documentation. Profit/fee and other indirect rates shall not be applied to travel charges.
Per-Diem (Meals and Incidental Expenses [M&IE]):
The current FY2008 allowable M&IE rate for Anniston/Oxford, AL is $39.00 per day for each full day. Allowable M&IE per-diem for travel days is 75% of full day rate (.75 X 39.00 = $29.25)
Lodging:
Current allowable FY2010 lodging rates for Anniston/Oxford, AL are $70.00 per day, plus applicable taxes. Other allowable charges associated with lodging charges: Business Phone Calls.
Airfare:
Airfare may be charged at actual cost, (economy / coach class only), no upgrades, including all applicable fees and taxes. Fees related to cancellation or changes in ticketing shall be allowable at cost only in cases where the schedule change or cancellation was required to be made at the direction of WA.

Airport Parking:
May be charged at actual cost, with accompanying receipt.
Rental Vehicle:
May be charged at actual cost; limited to mid-size (intermediate size) vehicle only; no upgrade charges are allowable (in certain circumstances subcontractors may be required to rent other type vehicles such as trucks or vans, which will be allowable, providing sufficient justification is provided). One rental vehicle shall be allowed per minimum of three subcontractor personnel per vehicle. Gasoline and fuel shall be charged at actual cost with accompanying receipt.
(WA will not pay for fuel purchase options paid to the rental vehicle company).
Personal (Personally Owned Vehicle [POV]) Mileage:
Current allowable FY2010 reimbursable rate for POV mileage is $0.50 per mile. (Please note: 1.
POV mileage cannot exceed the cost of comparable round-trip airfare for the subject trip, and 2.
Multiple round trip POV mileage to and from airport may not exceed the cost of one round trip mileage plus airport parking fees). Toll fees are allowable with accompanying receipt.
Laundry Services:
Laundry services while on travel are not covered in daily per-diem allowances. Reimbursement for costs for laundry services must be negotiated prior to award of time and materials or labor hour subcontracts and shall be billed separately, with supporting documentation.
Changes in Government M&IE per-diem, lodging and POV mileage rates:
Any changes issued by the Government to allowable per-diem, lodging and POV mileage rates shall be effective and applicable to WA issued subcontracts in accordance with the Government effective date.

SUBCONTRACTING PROGRAM REPORTING REQUIREMENTS
Note: This clause is not applicable to Small Business Concerns as defined in Section K-8 (b), Ref: 52.2190-1.
This Subcontract contains a requirement for the Subcontractor to develop a subcontracting plan for Small Business and Small Disadvantaged Business Concerns per FAR 52.219-9, Small and Small Disadvantaged Business Subcontracting Plan. This subcontract clause also requires the Subcontractor to submit a semiannual report on Standard Form 294, Subcontracting Report for Individual Contract, and a quarterly report on standard Form 295, Summary Subcontract Report, covering all lower-tier subcontracts let under prime contracts issued by the Department of Defense. With regard to lower-tier subcontracts let under this Subcontract, the following distribution shall be made:

ARTICLE H-4 - KEY PERSONNEL
The Subcontractor shall designate by name and position title those key personnel, which are considered to be essential to the work to be performed under this Subcontract. Prior to diverting any of the specified individuals to other programs, the Subcontractor shall submit justification (including proposed substitutions) in sufficient detail to permit evaluation of the impact on the program. The Subcontractor without the written consent of the Subcontract Administrator shall make no diversion. The personnel listing may be amended from time to time during the course of the Subcontract to either add or delete personnel, as appropriate upon written consent of the Contract Administrator.
ARTICLE H-5 – RESERVED
SECTION H SPECIAL CONTRACT REQUIREMENTS
ARTICLE H-6, INSURANCE REQUIREMENTS
In accordance with the Subcontract clause entitled "Work on WA, Government or Other Premises," the Subcontractor shall provide evidence of insurance coverage prior to award. The Subcontractor shall maintain insurance in the following types and minimum amounts:
I. WORKERS’ COMPENSATION
a. Coverage: Workers' compensation, and, where an exposure to the statutes exists,
1. Federal Employee Liability Act,
2. U.S. Longshoremen and Harbor Workers' Act,
3. Continental Shelf Act,
4. Jones Act, and

IV. PROFESSIONAL LIABILITY

a. Coverage
1. Applicable only where exposure exists for Professional services involving design, site surveys, soil testing, and/or Construction Management, etc.
2. Coverage shall provide a minimum 24 month discovery period after completion of the work.
b. Policy Minimum Limits: $1,000,000 per occurrence.
V. ENDORSEMENTS
a. All insurance certificates for Subcontractors physically present at a WA location shall include the following endorsements. Further, all insurance policies shall be issued by an acceptable insurance company and will include the following:
1. A thirty (30) day advance written notice in the event of cancellation, non-renewal, or material change of any policy. The following cancellation language in quotation marks must be deleted on the Certificate of Insurance that is provided to WA: “endeavor to” and “but failure to mail such notice shall impose no obligation or liability of any kind upon the company, its agents or representatives.”
2. That WA and principal are named as additional insureds (except on workers' compensation and professional liability).
3. A waiver of subrogation in favor of WA and principal (except on professional liability).
4. Cross liability or severability of interest coverage (liability policies only).
5. The Subcontractor's insurance is primary and any insurance maintained by WA or principal is considered excess and non-contributory.
b. Any request to waive or modify the above provisions must be sent directly to the WA
Subcontract Administrator and must be approved prior to commencement of work.
VI. SUBCONTRACTOR RESPONSIBILITY FOR RISK OF LOSS TO THE WORK
a. Each Subcontractor to be responsible for risk of loss to its work and all supplies, materials and equipment used in the performance of that work.
1. WA does not require each Subcontractor to insure this exposure.
2. If a Subcontractor cannot financially withstand any such loss, builders' risk insurance should be required.
VII. CERTIFICATES OF INSURANCE
Certificates of insurance will be required prior to commencement of subcontract work.
SECTION H SPECIAL CONTRACT REQUIREMENTS
1. Certificates will not be acceptable unless all the listed coverages are provided in at least the amounts listed above.
2. Certificates must be signed by an authorized representative of the insurance company, who must indicate the capacity in which signing.

The wording “…endeavor to mail (No.) days written notice…” as typically found on certificates shall not be acceptable in this clause.
5. No work should be performed by the Subcontractor until satisfactory evidence of insurance with the required coverages has been received.
ARTICLE H-7 - RESERVED
ARTICLE H-8 - LOCATION OF WORK
This Subcontract will require the Subcontractor to perform at the Anniston Army Depot, Anniston, Alabama.
ARTICLE H-9 — CONFERENCES
Periodic on-site meetings shall be scheduled whenever requested by the Subcontractor or WA for the resolution of questions or problems encountered in the performance of the work. The Subcontractor and/or appropriate representative(s) shall be required to attend and participate in all conferences pertinent to the work required under this Subcontract as directed by the Subcontract Administrator. Furthermore, all Subcontractors charged with executing construction or maintenance work on Depot property are required to attend the pre-job brief chaired by WA personnel prior to commencing work.
ARTICLE H-10 — WRITTEN RECORDS
The Subcontractor shall support WA in providing written records of all significant conferences, meetings, discussions, telephone conversations, etc., with WA or Government representative(s), in which the Subcontractor and/or designated representative(s) thereof participated. These records shall be dated and shall identify participating personnel, subject discussed, and conclusions reached. The Subcontractor shall forward to the Subcontract

Administrator, as soon as possible (not to exceed 5 calendar days), a reproducible copy of the records.
The scope of construction or maintenance work performed by Subcontractor personnel on depot property is directed via a Maintenance Work Order as defined in Implementing Procedure MNT- 2.01, Work Control Program. Therefore, the Subcontractor is expected to utilize the provided work order and document all activities such as; as found condition, work performed, problems encountered, and as left condition.

ARTICLE H-14 - SUPERVISION BY THE SUBCONTRACTOR
The extent and character of the work to be done by the Subcontractor shall be subject to the general oversight, supervision, control, and approval of the WA Contract Manager or his designee and the WA Oversight technical point of contact. At all times during performance of this Subcontract and until the work is completed and accepted, the Subcontractor shall directly supervise the work or assign and have on the site a designated manager after full NTP who is acceptable to WA. The designated manager must have authority to act for the Subcontractor on the Subcontract.
ARTICLE H-15 – TITLE
The title of all installed material shall reside with WA.
ARTICLES H-16 Through H-19 DELETED
ARTICLE H-20 - ACCESS TO SUBCONTRACTOR DATA
(a) WA shall, in the performance of its prime contract with the Department of the Army, have the right to unlimited access to all data otherwise provided or made available to the Government or WA in the performance of the Subcontract, except that excluded by advance agreement approved by the Government, and is limited to such data.
Subcontractor and affected lower-tier subcontractors shall enter into and abide by the terms of a non-disclosure agreement and non-competition agreement when orders affecting this Subcontract are placed on ordering agreement DAAM01-96-D-0012 or follow-on contract.
(b) This clause shall flow down and be incorporated in all lower-tier subcontracts at all tiers for which lower-tier subcontractor data may otherwise be made available to the Government.
(c) The Contracting Officer shall have the right to review, analyze, and copy by any means the cost, technical, and performance documentation, and to provide it to WA, in order to perform a task assigned to WA.
(d) WA and its personnel are obligated to treat all cost, technical, and performance documentation as confidential and proprietary information and handle it in accordance with this clause. This clause shall not limit other intellectual property rights held by the parties.
SECTION H SPECIAL CONTRACT REQUIREMENTS
(e) Review, analysis, and copying shall take place at the WA offices for documentation unless the parties involved in a particular action agree to other arrangements. WA shall provide adequate space for review, analysis, and copying of cost documentation. If cost documentation is on microfilm type media or magnetic media, the Subcontractor or lower-tier Subcontractor shall provide access to equipment for reading the media that is at least equivalent to that utilized by itself. The Subcontractor shall also provide hard copies or magnetic media copies of all cost, technical, and performance documentation as the Contract Manager may request.
(f) Unless otherwise specified, the Subcontractor is not required to create or maintain cost documentation in any particular form for this Subcontract provided that the cost documentation is created and maintained in a manner consistent with its customary business practices or as otherwise required of a cost accounting system required for award of this Subcontract.
(g) The WA contract requires treatment of all cost documentation as confidential and prohibits disclosure of the documentation in any manner or to any extent to third parties except pursuant to additional agreements with the Subcontractor or its lower-tier Subcontractors.
(h) The WA contract limits disclosure of cost documentation only to those of its officers and employees who require it in conjunction with the performance of its obligations under WA.
(i) The WA contract prohibits commercial use of the documentation.
(j) Within a reasonable time after completion or termination of WA, WA is required by contract to deliver to the Government or destroy, at the option of the Government, all documents in its possession containing Subcontractor documentation, except that WA may retain one reproduction of such documents for record keeping purposes to document what information it had access to, provided WA remains in compliance with the other requirements of this special contract requirement and such documents are secured in a segregated file.
(k) WA is prohibited by contract from transmitting…
