About this file

This document is an amendment to the Request for Responses (RFR) issued by the Commonwealth of Massachusetts Executive Office of Health and Human Services (EOHHS) for a Behavioral Health Treatment and Referral Platform. The amendment revises the required forms that bidders must submit, including certifications, Commonwealth terms and conditions, and other standard contract documents. It also clarifies the requirement for bidders to participate in the Commonwealth's Electronic Funds Transfer (EFT) program, unless the bidder can provide compelling proof that it would be unduly burdensome. Additionally, the amendment updates the submission instructions for responses.

The overall RFR seeks to procure a software system that will enable acute care hospital personnel to identify patients with a psychiatric diagnosis waiting in Massachusetts emergency departments and seeking inpatient psychiatric treatment or community crisis stabilization. The platform will facilitate the secure sharing of information and referral forms among hospitals, health plans, community-based crisis intervention teams, and state agencies.

Commonwealth of Massachusetts Executive Office of Health and Human Services (EOHHS)

AMENDMENT 2 to the

Request for Responses for a Behavioral Health Treatment and Referral Platform

Amendment issued: June 16, 2022

Document Number: 22EHSBHTRPSRFR

COMMBUYS Bid Number: BD-22-1039-EHS01-EHS01-74235

The Request for Responses for the Behavioral Health Treatment and Referral Platform, initially issued by the Executive Office of Health and Human Services (EOHHS) on May 24, 2022, is hereby amended as follows:

1. Section 4.3.1.1.3, Required Forms, is hereby amended by deleting it in its entirety and replacing it as follows:

All Bidders must submit the following forms, executed as appropriate. Unless otherwise noted, these forms are posted on COMMBUYS along with this solicitation.

· Certification of Non-Collusion

· Certification Regarding Debarment and Suspension

· Disclosures

· Certification with Regard to Financial Condition

· Certificate of Good Standing (see Section 4.3.1.1.6 below). Additional Information about this Certificate may be found at:

http://www.mass.gov/dor/businesses/programs-and-services/certificate-of-good-standing.html

· Commonwealth Terms and Conditions for Information Technology Contracts

· Standard Contract Form: Fill out the Contractor-related boxes on the top left of the form and have a signatory sign it as an indication of acceptance of the form’s terms and conditions. By signing the Standard Contract Form, Bidder indicates acceptance of the Standard Contract Form Instructions, Contractor Certifications and the Commonwealth Terms and Conditions for Information Technology Contracts. The Selected Bidder will execute a fully completed Standard Contract Form at the conclusion of the negotiation process.

· Massachusetts Substitute W-9 Request for Verification of Taxation Reporting Information

· Contractor Authorized Signatory Listing

· Supplier Diversity Program SDP Plan Form (see Section 4.3.1.1.8)

· Prompt Payment Discount Form (see Section 5.12)

· If offering cloud software/services in its Response, a completed Cloud Terms Table (RFR Attachment 6) Note: Failure to submit all required forms may deem the bid submission as Non-Responsive.

2. Section 5.11, Electronic Funds Transfer (EFT), is hereby amended by deleting it in its entirety and replacing it as follows:

All Bidders responding to this RFR must agree to participate in the Commonwealth Electronic Funds Transfer (EFT) program for receiving payments, unless the Bidder can provide compelling proof that it would be unduly burdensome. EFT is a benefit to both Contractors and the Commonwealth because it ensures fast, safe and reliable payment directly to contractors and saves both parties the cost of processing checks. Contractors are able to track and verify payments made electronically through the Comptroller’s Selected Bidder Web system.

The Selected Bidder, upon notification of contract award, will be required to enroll in EFT as a contract requirement by completing and submitting the Electronic Funds Transfer (EFT) Authorization Agreement, provided by EOHHS at that time, for review, approval, and forwarding to the Office of the Comptroller. If the Bidder is already enrolled in the program, it may so indicate in its Response. Because the Electronic Funds Transfer (EFT) Authorization Agreement contains banking information, this form, and all information contained on this form, shall not be considered a public record and shall not be subject to public disclosure through a public records request. The requirement to use EFT may be waived by the SST on a case-by-case basis if participation in the program would be unduly burdensome on the Bidder. If a Bidder is claiming that this requirement is a hardship or unduly burdensome, the specific reason must be documented in its Response. The SST will consider such requests on a case-by-case basis and communicate the findings with the Bidder.

3. Section 4.2, Submission Instructions and Logistics, is hereby amended by deleting it in its entirety and replacing it as follows:

Instructions for Submitting Responses - Bidders shall submit a complete Response, which includes the three components of the Response as described in Section 4.3, no later than the Bid Opening Date and time in Section 4.1.2. Bidders shall submit Responses by the method described below in Section 4.2.1. All Responses shall be received by the Procurement Coordinator no later than the Bid Opening Date and time indicated in the Procurement Timetable in Section 4.1.2 or they shall not be evaluated.
