About this file
This is Amendment 2 to a Request for Proposal issued by the State of South Carolina's Procurement Services Division on behalf of Coastal Carolina University for Insurance Brokerage Services. The solicitation seeks a single insurance broker to manage the university's insurance portfolio across multiple lines of coverage. The pre-proposal conference is scheduled for January 12, 2022 at 10:00 AM via Microsoft Teams, with interested parties required to contact Procurement Officer Nakendra Perry by January 11, 2022 to obtain conference call details. Questions from offerors must be submitted by January 13, 2022 at 11:00 AM. The initial offer deadline was January 20, 2022 at 11:00 AM, with an amended deadline of January 27, 2022 at 11:00 AM. Offerors must submit offers online only, consisting of one original technical proposal marked "Original," one redacted technical copy marked "Redacted," one price proposal marked "Original," and one price copy marked "Copy." Award is expected to be posted on March 10, 2022, and offerors must hold their offers open for a minimum of 120 calendar days after the opening date.
The current insurance program includes cyber coverage through Resilience at an annual premium of $159,000 with 17.5% commission; executive risk coverage through Berkshire Hathaway at $126,087 with 15% commission; and crime coverage through Beazley Insurance Company at $15,475 with 15% commission. Currently, there is no broker service fee. The university's self-insured retentions are $250,000 for cyber, $500,000 for directors and officers liability, $1,000,000 for employment practices liability, and $25,000 for crime. Cyber coverage is currently limited to $5,000,000 due to market constraints, though the university previously carried $10,000,000. The broker assists with fewer than 20 certificates of insurance annually and is expected to participate in one in-person meeting per year with the university. Evaluation criteria total 75 maximum points, with no specific rating scale provided for evaluation factors. Potential offerors may submit additional comments or clarifications as a separate appendix, though offers containing modifications to contractual requirements or nonconforming terms and conditions may be deemed non-responsive.

AMENDMENTS TO SOLICIATION (JUN 2017)
The solicitation is amended as provided herein. Information or changes resulting from questions will be shown in a question-and-answer format. All questions received have been reprinted below. The “State’s response” should be read without reference to the questions. The questions are included solely to provide a cross-reference to the potential offeror that submitted the question. Questions do not form a part of the contract; the “state’s response” does. Any restatement of part or all of an existing provision of the solicitation in an answer does not modify the original provision except as follows: Underlined text is added to the original provision. Stricken text is deleted. [02-2A097-1]
1. Please provide the current carriers, premiums and commissions paid by line of coverage.
State’s Response:
Cyber
Carrier: Resilience Premium: $159,000 Commission: 17.5% Executive Risk Carrier: Berkshire Hathaway Premium: $126,087 Commission: 15% Crime Carrier: Beazley Insurance Company Premium: $15,475 Commission: 15%
2. What is the current broker service fee?
State’s Response: There is currently no broker fee.
3. In Section III under Contractor Requirements, Question 6, how many certificates of insurance does your broker assist with annually?
State’s Response: Our current broker assists with fewer than 20 certificates of insurance on an annual basis.
4. How many in person meetings per year would the University like to have with the selected broker?
State’s Response: One meeting per year.
5. What kind of challenges have you faced in the cyber market for the 21-22 renewal? Have you always purchased $5M?
State’s Response: The cyber market was difficult in 21-22. Out of 16 carriers, only two submitted a quote. In the past, CCU carried $10M, but this market made it difficult to purchase the extra $5M.
6. What is your SIR for the Cyber, D&O, EPLI and Crime?
State’s Response:
Cyber-$250,000 D&O- $500,000
EPL- $1,000,000
Crime-$25,000
7. We noticed that the evaluation criteria only adds up to 75 points, can you please let us know what other criteria will add the additional 25 points?
State’s Response: 75 is the maximum points that can be obtained.
8. Insurance brokerage is a very specialized form of professional service which usually calls for contractual terms not covered by the terms and conditions set forth in Section VII of the RFP. Also, clarification of a few of the Section VII terms and conditions would be helpful. Clauses we may want to discuss or clarify are insurance, indemnity, Off-shore contracting, audit and termination for convenience.
State’s Response: Potential offerors would need to submit such questions on what needs clarification per the Questions from Offerors clause.
9. How should bidders apprise the University of additional terms and clarifications needed for insurance brokerage if bidders cannot submit their own sample contract clauses with their proposals?
State’s Response: If your offer includes any comment over and above the specific information requested in the solicitation, you are to include this information as a separate appendix to your offer. Offers which include either modifications to any of the solicitation's contractual requirements or an offeror's standard terms and conditions may be deemed non-responsive and not considered for award.
10. For the current policy term and/or contract periods of the policies of interest, will you provide?
| a. | Retentions/deductibles |
| b. | Current policy period and, if different, current contract period premiums |
| c. | Claims paid annualized for each of the previous 5 years |
State’s Response:
c. No cyber, D&O, or Crime claims have been paid in the previous five years.
11. Evaluation factors disclosed do not total 100 points, should they?
State’s Response: See response to question 7.
12. For each of the evaluation factors are there specific criteria or rating scales used to calculate the total points? May we obtain a copy of same?
State’s Response: There is no scale.
ALL OTHER TERMS, CONDITIONS, BIDDING INSTRUCTIONS, AND SPECIFICATIONS REMAIN UNCHANGED. IF THERE ARE ANY QUESTIONS OR IF ANY CONFUSION OR UNCERTAINTY ARISES AS A RESULT OF THIS AMENDMENT, IT IS THE SOLE RESPONSIBILITY OF THE OFFEROR TO CONTACT THE PROCUREMENT OFFICER FOR CLARIFICATION. CONTACT INFORMATION CAN BE FOUND IN THE TOP RIGHT HAND CORNER OF THE COVER PAGE OF THIS AMENDMENT. REFERENCE THE “DUTY TO INQUIRE” CLAUSE IN THE ORIGINAL REQUEST FOR PROPOSAL.
