About this file
This is Amendment #1 to a bid solicitation issued by the Colorado Division of Reclamation, Mining & Safety for the Morning Star Mine Closure Project (PKA-16-761). The project involves the closure of 15 mine features located in San Miguel County, Colorado, within the Lizard Head Wilderness area. The work encompasses installing various mine closure methods including rock bulkheads with bat access, hand backfill closures, grated shaft closures, and corrugated HDPE pipe installations. The amendment, dated May 3, 2016, revises key project parameters including access restrictions, closure methods for specific features, and safety requirements. The original pre-bid meeting was held on May 3, 2016, with the bid submission deadline revised to Tuesday, May 17, 2016, at 4:00 p.m., and the bid opening scheduled for 10:00 a.m. on Wednesday, May 18, 2016. The bid schedule requires contractors to provide lump sum pricing for mobilization/demobilization, a Safety, Health, and Environmental Action Plan (SHEAP), installation of mine closures across all 15 features, and up to five additional equipment hours at an hourly rate.
The amendment establishes significant operational constraints, including a prohibition on helicopter access to features 2 through 8 within the Lizard Head Wilderness, with access limited to pack animals or hiking; however, helicopter access is permitted for feature 1 and for life-threatening emergencies. The U.S. Forest Service will issue an expedited Temporary Special Use Permit authorizing motorized vehicle use on three designated trails, with a potential fee of $140.27 payable by the contractor. The amendment clarifies that contractors must contact San Miguel County Road and Bridge Department regarding any required right-of-way or access permits and provides the superintendent's contact information. Closure methods for features 4 through 6 and 8 were changed from bulkhead to hand backfill due to access limitations, and feature 7 was reclassified from an adit to a shaft. The SHEAP was revised to eliminate the previous requirement for MSHA 40-hour underground mine safety training certificates, though contractors must post emergency medical facility information at the job site. Funding sources include both USFS and OSM (Office of Surface Mining) allocations across the 15 features, with all work located in San Miguel County.

RE: Amendment # 1 to PKA-16-761, Morning Star Mine Closure Project
Thank you for your attendance at the Morning Star Pre-Bid Meeting, held on May 3, 2106. Please note: the Bid Submittal date has been changed to Tuesday, May 17, 2016 no later than 4:00 p.m. The Bid Opening date has been changed to 10:00 am, Wednesday, May 18, 2016, in an effort to provide contractors with additional time to adjust costs and account for the changes above. A REVISED Bid Schedule is attached to this amendment and, for your convenience, a copy of the attendance sheet is also attached to this amendment.
The following clarifications and amendments should be noted and incorporated into the bid document:
1. The U.S. Forest Service (USFS) has determined that helicopter access IS NOT PERMITTED in the Lizard Head Wilderness area. Consequently, access to features numbered 2 through 8 must be by pack animals or hiking. However, Helicopter can access feature number 1. Helicopter access is allowed in the Wilderness Area to assist with life-threatening emergencies.
2. The USFS will issue one expedited Temporary Special Use Permit to the successful bidder, authorizing motorized vehicles on the following trails:
a. USFS Trail 420 to Bilk Creek; the creek crossing has been washed away, however. Rock slides along the trail may be cleared to improve access.
b. USFS trail to Bridal Veil Basin for access to features 14 and 15.
c. USFS trail from Ophir to feature number 11.
The Special Use Permit fee will either be waived or CONTRACTOR will be charged a fee of $140.27. CONTRACTOR will be responsible for payment of the fee, if there is a charge.
3. CONTRACTOR will check with San Miguel County Road and Bridge Department to inquire about the need for a Right of Way or Access Permit on San Miguel County roads. Mike Horner, San Miguel County Road and Bridge Superintendent’s telephone number in Norwood is (970) 327-4835.
4. Because access is limited to pack animals or hiking, the closure method for features numbered 4-6 and 8 have been changed from bulkhead to hand backfill.
5. Number 7 has been changed from an adit to a shaft. Closure options remain the same.
6. The closure method for feature number 12 has been changed to either a Rock Bulkhead closure with Human and Bat Access or a Grated Adit closure with Human and Bat Access.
7. In response to a Contractor’s question, "Portland cement and sand" can be substituted for "commercially available sand and cement mix", as long as it meets PSI strength requirement that is specified in the 2009 General Bid Specifications for Rock Bulkhead Closures.
8. The SHEAP has been revised to NO LONGER REQUIRE the MSHA 40 hour underground mine safety training certificate or a current Underground Miner training certificate for each employee working underground. Please include a sheet to be posted on the Job Site that includes name, contact information and map to the closest Emergency Medical Center and Hospital.
9. A Contractor asked if Davis Bacon Wages apply to sub-contractors and family members.
Contractors need to contact the U.S. Department of Labor to determine what is required under the Davis Bacon Act.

www.mining.state.co.us.
The link to download the General Bid Specifications, 2009, is http://mining.state.co.us/Programs/Abandoned/Documents/General%20Bid%20Spe cifications.pdf
11. In response to a Contractor’s question, there are NO Emission Tier requirements relative to List of Equipment Offered.
12. On May 3, 2016, electronic copies of the Morning Star Pre-Bid slide presentation and a photo of the Bilk Creek crossing was sent by Camille Price by email to Contractors via the email addresses that they wrote on the Pre-Bid Attendance Sign-In Sheet from May 3, 2016.
All terms and conditions of the Invitation for Bid other than as changed by this amendment remain the same.
Receipt and acceptance of this amendment shall be acknowledged on the bid form and by submitting the Revised Bid Schedule.
