About this file
This is Amendment 1 to solicitation #5400027952 issued by the Medical University of South Carolina (MUSC) for NEBEC Program Consultants. The amendment modifies submission deadlines, with offers now due March 6, 2025 at 11:00 AM ET (extended from March 5) and questions due by February 21, 2025 at 11:00 AM ET (extended from February 14). The solicitation requires submission of one electronic technical proposal, one electronic business proposal, and redacted copies of each. A non-mandatory pre-proposal conference was held via Microsoft Teams on February 13, 2024. Award is expected to be posted on March 17, 2025.
The amendment provides clarification that budget neutral status must be achieved within the contract life with cost breakout by year 3, accepts additional professional certifications as qualifying credentials, and confirms that energy savings must be based on metered data rather than calculations. There is no minority participation requirement. The business proposal must include detailed annual pricing, with the total multi-year sum entered in SCEIS and the bidding schedule. Pricing is structured as a fixed fee rather than performance-based compensation.

Questions and Answers
Q1. Section III - "The program should balance operational goals of optimized energy use with user comfort and be budget neutral." What timeframe would be acceptable for the overall program to be budget neutral in years? Given that envelope recommendations are part of this exercise.
A1. Budget neutral status shall be obtained within the life of the contract. The expectation is to have a cost breakout to reach this goal by Y3.
Q2. Section IV - Several key offeror qualifications are identified as requirements - CMVP, CEM, CIAQP and BESA. Would alternate/analogous certifications be acceptable:
o ASHRAE Building Energy Modeling Professional (BEMP), o Building Enclosure Commissioning Process Provider (BECxP), o WELL Performance Testing Agent, o Commissioning Authority + Building Enclosure (CxA + BE) o Certified Commissioning Authority (CxA) o Level 1 Certified Infrared Thermographer
A2. Yes. These certifications are acceptable qualifications.
Q3. Section IV 3.5 Services Defined - “Detail your proposed Savings Validation Method, including whether any fees are based on calc savings versus actual metered savings. Fees are based on a fixed fee for services. Energy savings calcs are limited to direct energy savings from NEBECP and shall not include maintenance and ops / other savings.” What is the goal of this question? Is it to confirm that fees are fixed rather than based on performance?
A3. The intent of this question is to determine the methodology of calculating energy savings.
Savings shall be based on metered data, not calculated savings.
Q4. On the pre-bid call, it was stated that signing the bidding proposal is itself a contract with the Medical University of South Carolina. Please explain what is fully meant by this outside of award.
A4. See Section II-A: BID/PROPOSAL AS OFFER TO CONTRACT (JAN 2024)
By submitting Your Bid or Proposal, You are offering to enter into a contract with the Using Governmental Unit(s) (MUSC). Without further action by either party, a binding contract shall result upon final award. Any award issued will be issued to, and the contract will be formed with, the entity identified as the Offeror on the Cover Page. An Offer may be submitted by only one legal entity; "joint bids" are not allowed. [02-2A015-1]
If your firm is the highest ranked proposer, your proposals may be accepted without discussions or negotiations.
Q5. What is the Minority Participation team percentage requirement for this project?
A5. There is no Minority Participation team percentage requirement.
Q6. Please provide additional detail of the Price Business Proposal requirements. Page 19 of the RFP states "Offeror shall provide the annual fixed price fee contract price for all services provided."
Page 34 of the RFP was discussed on the pre-bid call to be a total lump sum of all services. Is the Business Proposal to be kept to a one line, one-page summary of lump sum services as shown on page 34?
A6. Detailed annual pricing must be included in the Business Proposal. When entering the price in SCEIS or in the Bidding Schedule, Offerors will enter the sum total of their multi-year pricing.
