Contractors must comply with SCDOT's 2025 Standard Specifications, provide proof of Commercial General Liability insurance at $1 million per occurrence, Auto Liability at $1 million per accident, and Worker's Compensation at statutory limits, and comply with debarment, drug-free workplace, ethics, and illegal immigration requirements. THE SOLICITATION IS AMENDED AS PROVIDED HEREIN. INFORMATION OR CHANGES RESULTING

FROM QUESTIONS WILL BE SHOWN IN A QUESTION-AND-ANSWER FORMAT. ALL QUESTIONS

RECEIVED HAVE BEEN REPRINTED BELOW. THE “STATE’S RESPONSE” SHOULD BE READ WITHOUT REFERENCE TO THE QUESTIONS. THE QUESTIONS ARE INCLUDED SOLELY TO PROVIDE A CROSS-

REFERENCE TO THE POTENTIAL OFFEROR THAT SUBMITTED THE QUESTION. QUESTIONS DO NOT

FORM A PART OF THE CONTRACT; THE “STATE’S RESPONSE” DOES. ANY RESTATEMENT OF PART OR ALL OF AN EXISTING PROVISION OF THE SOLICITATION IN AN ANSWER DOES NOT MODIFY THE

ORIGINAL PROVISION EXCEPT AS FOLLOWS: UNDERLINED TEXT IS ADDED TO THE ORIGINAL

PROVISON. STRICKEN TEXT IS DELETED. [02-2A097-1]

The following question was received regarding this solicitation. The response from SCDOT is below in red text.

Revised SECTION VII — TERMS AND CONDITIONS, B. SPECIAL.

Award will be posted on 11/05/2026 to 11/10/2026

QUESTION 1:

The solicitation requires the offeror to provide financial statements and information regarding prior comparable contracts, while also stating that SCDOT may consider proposed subcontractors in determining the offeror's responsibility.

If an offeror proposes a qualified and properly identified subcontractor to perform the construction work, including the concrete, excavation, base preparation, hauling, and related work, may the subcontractor's documented financial information, comparable project experience, references, and qualifications be considered by SCDOT in determining the offeror's responsibility?

Additionally, if the offeror is a recently established business and therefore does not have two prior fiscal years of financial statements or three prior comparable contracts of its own, how should the offeror satisfy the requirements of the "QUALIFICATIONS -- REQUIRED INFORMATION (MAR 2015)" clause?

SCDOT RESPONSE:

No Change: Yes. SCDOT may consider the financial information, experience, references, and qualifications of a properly identified subcontractor when determining the offeror’s responsibility. The prime contractor remains responsible for completing all contract requirements.

If the offeror does not have two years of financial statements or three comparable contracts, it should explain why and submit all available records, along with supporting information about its key personnel, proposed subcontractors, and committed resources. SCDOT will determine whether this information demonstrates the offeror’s ability to perform. This does not waive the solicitation’s requirements.

The offeror must identify the work and percentage to be performed by the prime contractor and each subcontractor. Refer to Section V for qualification and subcontractor identification requirements and Section II.B for any preferences claimed. Please refer to SECTION II. INSTRUCTIONS TO OFFERORS -- B. SPECIAL

QUESTION 2:

What kind of concrete fiber is specified for the D3 CONCRETE REPAIR- SALT DOME project? Micro, macro or steel fiber?

SCDOT RESPONSE:

No Change: It was not specified within the solicitation. SCDOT will accept Macro fiber at a minimum.

Please refer to III. SCOPE OF WORK/SPECIFICATIONS , under Standard Specifications for Highway Construction https://www.scdot.org/business/standard-specifications.html

QUESTION 3:

Will there be a performance and payment bond required if the bid amount is under $100,000.00?

SCDOT RESPONSE

Change: Yes. Performance and labor and material payment bonds are required when the contract amount exceeds $50,000, including amounts under $100,000. Within ten (10) days after award and before beginning work, the Contractor shall furnish both bonds, each for 100% of the contract amount, issued by a surety licensed in South Carolina and meeting applicable State requirements. Each bond shall include a valid power of attorney.

All bond costs shall be included in the bid price. For contracts of $50,000 or less, both bonds are required unless expressly waived in writing by SCDOT pursuant to S.C. Code § 11-35-3030(2). Please see the

SECTION VII — TERMS AND CONDITIONS, B. SPECIAL

PERFORMANCE BOND REQUIRED (JAN 2006):

Within ten (10) days after award, contractor shall provide a performance bond in the full amount of the contract sum, issued by a surety company licensed in South Carolina, with an “A” minimum rating of performance as stated in the most current publication of “Best’s key rating guide, property liability” which shall show a financial strength rating of at least five (5) times the contract amount. Each bond must be accompanied by a “power of attorney” authorizing the attorney-in-fact to bind the surety and certified to include the date of the performance bond. [07-7B155-1]

LABOR AND MATERIAL PAYMENT BOND REQUIRED

In all instances where a task order or purchase order is estimated to exceed $50,000, the Contractor shall, within ten (10) days after issuance of the task order or purchase order and prior to performing work or engaging a subcontractor to provide the work, provide a Labor and Material payment bond in the full amount of the task order or purchase order, issued by a surety company licensed in South Carolina, with an “A” minimum rating of performance as stated in the most current publication of “Best’s key rating guide, property liability”. Each bond must be accompanied by a “power of attorney” authorizing the attorney-in-fact to bind the surety and certified to include the date of the performance bond. Failure to provide such bond shall result in forfeiture of the task order or purchase order and no work shall commence. Should the task order or purchase order be forfeited, SCDOT shall move to the next contractor available for the work who can provide the required bond.
