About this file
This is Amendment #1 to a Fixed Price Bid Solicitation issued by the South Carolina Department of Juvenile Justice (DJJ) Administration for Psychological Evaluation Services. The solicitation requests providers to deliver pre-dispositional evaluations (PDEs) and General Sessions Waiver Evaluations for juvenile offenders. The evaluation services must be completed at County DJJ offices or Regional Psychology Offices within 30 days of referral, with draft reports reviewed and returned by supervising psychologists within five business days, followed by corrected final versions within an additional five business days. The original solicitation deadline for offer submission is February 6, 2020 at 2:00 PM, with questions due by January 24, 2020 at 5:00 PM. Award notification is scheduled for February 12, 2020. Bidders must submit one online copy of their offer and acknowledge receipt of any amendments. DJJ does not anticipate subpoenas requiring providers to testify in court regarding pre-dispositional evaluations, with testimony typically provided by DJJ's Supervising Psychologist instead.
Providers selected through this solicitation will be added to a Qualified Provider List (QPL) and may accept or decline individual referrals, though award and inclusion on the QPL does not guarantee service use or funding levels. Qualified professionals must hold a Master's degree in clinical or applied psychology with assessment experience and operate under the supervision of doctoral-level, licensed psychologists. DJJ will provide testing supplies and access to scoring programs; however, all file materials, including interviews, testing data, and raw data, remain the property of DJJ and cannot be retained by providers or used in clinical presentations. Failure to meet established deadlines may result in non-payment and removal from the contract. Evaluators must recommend types of services rather than specific providers to avoid conflicts of interest. This is a new contract resulting from increased referral volume following the implementation of Raise the Age legislation on July 1, 2019, which expanded DJJ jurisdiction.

AMENDMENT #1
QUESTIONS FROM OFFERORS - AMENDMENT (JUN 2017)
The solicitation is amended as provided herein. Information or changes resulting from questions will be shown in a question-and-answer format. All questions received have been reprinted below. The “state’s response” should be read without reference to the questions. The questions are included solely to provide a cross-reference to the potential offeror that submitted the question. Questions do not form a part of the contract; the “state’s response” does. Any restatement of part or all of an existing provision of the solicitation in an answer does not modify the original provision except as follows:
underlined text is added to the original provision. Stricken text is deleted. [02-2a097-1]
RESPONSES TO VENDOR QUESTIONS ARE LISTED BELOW:
1. How have Psychological Evaluation Services been previously accomplished by DJJ Administration (“DJJ”)?
RESPONSE: Evaluations have been assigned to internal evaluators (DJJ employees) until these employees hit their maximum caseloads at which time overflow cases were assigned to part-time/temporary employees.
2. Is this solicitation a new contract or a continuation (“rollover) of a previous contract similar in scope of service?
RESPONSE: This is a new contract.
3. Will bids received after the initial bid opening be opened on March 1st and September 1st of year one (2020)?
RESPONSE: Yes.
4. What does DJJ estimate the volume of referrals to providers for Pre-Dispositional Evaluations (“PDE”) and General Sessions Waiver Evaluations to be in each region on an annual basis?
RESPONSE: Referrals vary based on court dockets statewide.
5. What are the trends in DJJ’s recent experience that may affect the volume of referrals to providers?
RESPONSE: Raise the Age has increased the number of referrals received since implementation on 7/1/2019.
6. How does DJJ plan to distribute referrals to providers for PDE and General Sessions Waiver Evaluations in each region?
RESPONSE: All awarded offerors will be added to a Qualified Provider List (QPL).
Receiving an award and being added to the QPL does not guarantee a use of services or funding level.
7. Will providers be assigned referrals or will providers be able to accept/deny particular referrals?
RESPONSE: Providers can accept or decline referrals.
8. Will the approved provider list be ranked by “best-to-worst” providers? In other words, will providers be evaluated yearly according to performance and prioritized accordingly for referrals?
RESPONSE: Providers who fail to perform per contract requirements may be removed from the contract.
9. What are the licensure and/or education requirements for a Master’s level, non-licensed psychologist?
RESPONSE: Master’s in clinical or applied psychology and experience with assessment.
10. Who are these professionals (i.e. Licensed Professional Counselors, Licensed Social Workers, Licensed Psycho-Educational Specialists, unlicensed Master’s in Psychology graduates, etc.)?
RESPONSE: Master’s in clinical or applied psychology and experience with assessment.
11. Are these professionals qualified to administer all required testing measures in the contract (i.e.
intelligence testing)?
RESPONSE: Yes, and they operate under the supervision of doctoral level, licensed psychologists.
12. Will DJJ provide any training on testing measures, testing supplies, or access to scoring programs for testing measures to the provider for completion of the necessary components of the PDEs and General Sessions Waiver Evaluations?
RESPONSE: Testing supplies and access to scoring will be provided.
13. Upon completion and submission of the PDE or General Sessions Waiver Evaluation, will the provider be required to provide a post-evaluation feedback session to the child/family?
RESPONSE: Occasionally, but only upon written request from the parent or court order.
14. What is the difference between the role of the DJJ “Supervising Psychologist” and the “Assigned Psychologist,” and what will be the process for communication between the two?
RESPONSE: The Assigned Psychologist is the person who is assigned to complete the evaluation. The Supervising Psychologist is the psychologist who reviews and co-signs the evaluation.
15. What is the anticipated timeline between submission of the draft report and completion of the final report?
RESPONSE: The supervising psychologist will review and return the report for follow-up and finalization within five (5) business days of receipt. A corrected/final version of the report shall be returned to the supervising psychologist within five (5) business days.
16. Are both the draft report and the final report included in the contracted rate of reimbursement?
RESPONSE: Yes.
17. Is the provider allowed to keep copies of the final report and the data gathered for the report?
RESPONSE: All file material including interviews, testing, and raw data must be submitted with the evaluation report and are the property of DJJ.
18. Is the provider allowed to use the raw data in clinical presentations to peers?
RESPONSE: No. All file material including interviews, testing, and raw data must be submitted with the evaluation report and are the property of DJJ.
19. What locations are allowable for PDEs to be conducted by providers? County DJJ offices and Regional Psychology Offices appear to be listed as primary locations.
RESPONSE: County DJJ offices and Regional Psychology Office
20. Can providers complete PDEs at the provider’s office or other location?
RESPONSE: These evaluations need to be completed at the County DJJ office or Regional Psychology Office.
21. Does DJJ anticipate potential subpoenas requiring providers who complete PDEs to report/testify at court?
RESPONSE: DJJ does not anticipate subpoenas requiring providers who complete Pre- Dispositional Evaluations to testify in court. In the event that testimony is required regarding a Pre-Dispositional Evaluation, it is typically required of the DJJ Supervising Psychologist.
22. What are the penalties for a late/tardy PDE submitted after the 30 day deadline?
RESPONSE: Deadlines are established based on court scheduling. Failure to meet established schedules may result in non-payment and removal from the contract.
23. Does the 30 day timeline begin counting from the date of referral or from the date of evaluation?
RESPONSE: The thirty (30) day timeline begins at the date of referral.
24. If the provider assigns a diagnosis and recommends mental health treatment, are there any restrictions regarding referral to the provider (or provider organization) for service delivery of the recommended mental health services?
RESPONSE: Evaluators shall recommend the types of services that the juvenile could benefit from rather than recommending specific providers.
