About this file

This is an Amendment 1 Questions and Answers document clarifying contract provisions for a vegetation management or weed treatment project. The amendment addresses a key ambiguity regarding post-treatment monitoring and contractor responsibilities over a three-year period. The original contract required bidding on a per-acre basis for treatment services, with a performance standard stipulating that treated areas must achieve a 90% success rate, defined as weed regrowth not exceeding 10% of treated areas within three years following initial treatment. The contract specifies that contractors are responsible for re-treatment at their own cost if weed regrowth exceeds the 10% threshold within the three-year monitoring period, provided such regrowth results from incomplete initial treatment rather than new weed populations.

The amendment clarifies that the contracting agency or a designated party will conduct site monitoring on behalf of the contractor to verify compliance with the 90% success rate requirement. Contractors are not responsible for treating new weed populations that emerge from seeds after the initial three treatments are completed, as the agency assumes responsibility for managing naturally occurring new growth. Re-treatment obligations apply only when project failure is determined to result from incorrect initial execution rather than environmental factors beyond the contractor's control. This structure protects the agency's investment by ensuring treatment quality while clearly delineating the contractor's financial liability to corrective actions within a defined timeframe.

Amendment #1 Questions and Answers We went through the site visit and could get a clear black and white answer on a provision in the bid. Specifically the clause “The contractor will monitor sites for additional 3 years for a 90% success rate of treated areas." On Page 6. We were told to bid the job per acre and not to worry about that clause since Derek was going to do the monitoring.

Do we bid a price for monitoring the sites?

The site will be monitored for a 90% success rate by us but if the weeds regrowth is more than 10% of treated areas the contractor will need to come back with in 3 years and at their cost.

Are we responsible to treat the sites after the initial 3 treatments?

Only if it is determined that the project was not done correctly. We will be treating new population of weeds after the contractor is done ourselves I totally understand that there are going to be new weeds coming back from seeds that the contractor cannot treat at the timing of their contract. This covers us to make sure project is done correctly.
