About this file

This is Amendment 1 to a Request for Proposal issued by the South Carolina State University through the South Carolina Division of Procurement Services for brokerage services related to Directors and Officers (D&O) Liability, Employment Practices Liability (EPL), Commercial Crime, and Kidnap, Ransom & Extortion (KRE) insurance. The solicitation requires submission of one original technical volume hardcopy marked "Original Technical Volume," one electronic media technical volume copy, one redacted technical volume copy via electronic media, one original price volume hardcopy marked "Original Price and Business Volume," and one electronic media price and business volume copy. Proposals must be submitted online at http://www.procurement.sc.gov by September 16, 2019 at 11:00 A.M. Questions from offerors must be received by September 3, 2019 at 12:00 P.M. The award will be posted on October 10, 2019. Offerors must hold their offers open for a minimum of ninety calendar days after the opening date.

The amendment clarifies that the University does not have five-year loss run information specific to D&O, EPL, and KRE policies, as these are inaugural policy lines; however, loss run information is available for the current General Tort Liability policy and Commercial Crime policies. The amendment specifies that brokerage service fees must be set at "$0" in the Bidding Schedule, meaning no fees or charges above the cost of coverage may be imposed unless South Carolina State University agrees in writing before an invoice is submitted. The University does not currently purchase cyber liability coverage. Procurement Officer Kristen Moss, CPPB can be contacted at (803) 737-2772 or kmoss@mmo.sc.gov for clarification.

(a) The Solicitation may be amended at any time prior to opening. All actual and prospective Offerors should monitor the following web site for the issuance of Amendments: www.procurement.sc.gov (b) Offerors shall acknowledge receipt of any amendment to this solicitation (1) by signing and returning the amendment, (2) by identifying the amendment number and date in the space provided for this purpose on Page Two, (3) by letter, or (4) by submitting a bid that indicates in some way that the bidder received the amendment. The following items are hereby incorporated:

Question 1: Can the "loss runs" information from the last 5 years be provided?

Answer: Currently, the university does not have ‘loss run’ information specific to D&O, Employment Practices, etc. policy; however, this information can be provided as it pertains to our General Tort Liability policy (see Attachment 2).

Question 2: Can you please provide 5-year loss runs for all lines referenced in the RFP along with the carriers for each line? This helps us develop our marketing strategy response requested in the RFP.

Answer: The current solicitation/RFP will result in inaugural policies for the following lines of coverage outside of our current General Tort Liability policy

· Directors & Officers Liability

· Employment Practices Liability

· Kidnap, Ransom & Extortion

For Commercial Crime – Please see Attachments 3-5.

Question 3: Does the University currently purchase cyber liability coverage?

Answer: No.

Question 4: Page 14 states “During the term of the resulting Contract, no fee or charge above the cost of the coverage may be imposed unless SCSU agrees in writing before an invoice is submitted.” Does this mean that “$0” is required in the Bidding Schedule on Page 30 for Line Number 0001 – Brokerage Services Fees?

Answer: Yes.

ALL OTHER TERMS, CONDITIONS, BIDDING INSTRUCTIONS, AND SPECIFICATIONS REMAIN UNCHANGED. IF THERE ARE ANY QUESTIONS OR IF ANY CONFUSION OR UNCERTAINTY ARISES AS A RESULT OF THIS AMENDMENT, IT IS THE SOLE RESPONSIBILITY OF THE OFFEROR TO CONTACT THE PROCUREMENT OFFICER FOR CLARIFICATION. CONTACT INFORMATION CAN BE FOUND IN THE TOP RIGHT HAND CORNER OF THE COVER PAGE OF THIS AMENDMENT. REFERENCE THE “DUTY TO INQUIRE” CLAUSE IN THE ORIGINAL REQUEST FOR PROPOSAL.
