About this file

This document is Amendment 1 to a Request for Proposals issued by the North Dakota Public Service Commission, Abandoned Mine Lands (AML) Division, addressing bidder questions for the Cartwright AML Project. The project involves engineering and construction services to permanently close an abandoned underground coal mine entrance (portal) located near Cartwright, North Dakota. The portal's outermost opening measures approximately 8 feet wide by 4 feet tall, with a recessed opening of approximately 4.5 feet wide by 2 feet tall and a measured depth of 12 feet, though the depth may extend further. The project scope includes addressing tension cracks adjacent to and above the portal, as well as slope stability issues surrounding the portal resulting from a west slope failure that occurred between 2025 and 2026, likely caused by a homeowner's septic system. Access to the portal from above along the residential property boundary has been obtained from the homeowner. The original solicitation was issued on October 8, 2026, with a deadline for receipt of proposals set for November 17, 2026, at 10:00 a.m. Central Time. This amendment was issued on October 19, 2026, to respond to numerous questions received during the question period.

No geotechnical data is available for the project. Bidders must either be licensed Professional Engineers in the State of North Dakota or demonstrate the ability to have all applicable designs and work reviewed and approved by a registered Professional Engineer in North Dakota. The portal closure design must be able to withstand grout injection pressure as a requirement, although grout injection is not included in the current project scope and may only occur in the future. No set-asides, pricing terms, or funding information is provided in this amendment document.

SOLICITATION AMENDMENT 1

October 19, 2026

RFP Number: SRC000464

Title: Cartwright AML Project; 408.26.10.006

Deadline for Receipt of Proposals: November 17, 2026, 10:00 a.m. CT

Solicitation Issued: October 8, 2026

The solicitation established a deadline for receipt of written questions. Due to the numerous amount of questions, Amendment 1 was created to answer the questions received to date. Any additional questions received will be answered after the question deadline. The answers do not change the solicitation except where noted.

QUESTION 1:

What is the volume of the void to be filled?

ANSWER 1:

The outermost opening of the portal is approximately 8’ wide by 4’ tall. The recessed opening seen in the pictures is approximately 4.5 feet wide by 2 feet tall. The depth was measured at 12 feet, but it may extend further.

QUESTION 2:

Is there any geotechnical data available?

ANSWER 2:

No geotechnical data is available.

QUESTION 3:

Safe portal access will require work from above and below; can access from above along the boundary of the residential property be obtained?

ANSWER 3:

Yes. We have obtained permission from the homeowner to be able to access the portal from above if needed.

QUESTION 4:

The west slope of the property failed between 2022 and 2026 and remains in an unstable condition and will continue to unravel. There are also tension cracks (see below) adjacent and above the Portal, indicating continued failure of the slope. Does the portal rehabilitation design need to account for continued slope failure, as this will significantly impact project scope?

ANSWER 4:

Correct, the west slope of the property did fail in 2025-2026. This was likely caused by the homeowner’s septic system. The original drain field was draining west and saturated the slope and eventually caused failure. The septic system and drain field have been moved in an attempt to resolve this issue.

The project is intended to address the tension cracks adjacent to and above the portal, as well as the slope stability issues surrounding the portal.

North Dakota as per their online guidance. Can the submission deadline be extended?

QUESTION 6:

The RFP stated that the portal closure must be able to withstand grout injection pressure, is there any grout injection included within this project?

ANSWER 6:
