A. The following timelines are proposed in this RFP:

1. The contractor shall provide written notice with the intent of submitting a responsive proposal within five (5) business days. Responses shall be provided to the contracting team identified above and to the DLA Raytheon Team email: DLAHSVRTXTEAM@DLA.MIL.

2. The complete proposal shall be submitted no later than 3:00 PM Central Standard Time (CST January 14th, 2027.

B. Instructions for the proposal:

1. Please ensure that you read the entire RFP, including all of the enclosures, prior to submitting a proposal. The proposal shall be in full compliance with the instructions of this RFP.

2. This RFP is not an authorization to start work.

3. The basic terms and conditions of the Umbrella Contract SPRBL1-25-D-0006 and Subsumable Contract

SPRRA2-25-D-0016 shall govern the Contractors’ and Governments’ rights and obligations.

4. To assure maximum timeliness of proposal submissions, the list of NSN/PNs numbers may be separated into more than one proposal with the understanding that the data requirements are not lessened by doing so. Prior written approval from the Contracting Officer is required before submitting multiple proposals. The Contracting Officer will make the determination if splitting a requirement into more than one proposal is in the best interest of the Government. The contractor is required to submit an explanation, anticipated submission dates, and proposal ID number assigned with the request to separation.

5. If a part number contains multiple revisions that do not affect form, fit, or function, the contractor shall submit a

Memorandum of Record (MFR) identifying all revisions and certifying equal pricing.

6. Contract Clauses are governed by the Umbrella Contract and Subsumable Contract unless otherwise indicated, (excluding classified clauses; notices, clauses, and provisions) shall apply to all add-ons, Delivery Orders and shall govern the contractor’s and Governments’ rights and obligations. No alternative or additional clauses shall be submitted with this proposal.

7. Your proposal(s) shall remain valid for a minimum of one hundred and eighty (180) days from receipt by the

Government. Your proposal is not considered fully received until ALL required documents have been received and acknowledged by a DLA RTX Team Member.

8. IAW contract SPRRA225D0016 Section C-2: The offeror may propose alternative sole source parts for the requested items and updated quantities for MOQ and BEQ. The contractor is required to provide written notification within 30 days to the buying command. The contractor should ensure the alternative parts(s) have the same form, fit and function and is accompanied by a complete obsolescence notification letter detailing the reasons the contractor is unable to propose the requested part. Specifically for this RFP, the Contracting Officer requires the written notification to include a detailed explanation for the alternate part number being proposed.

9. IAW contract SPRRA225D0016 Section C-4(3): If RTX identifies any part(s) as a “Single Purchase” RTX may propose the part as assuming limited availability of Patriot spares parts which will be priced only for available quantity for one ordering period as a standalone Delivery Order. If a part is identified as “Single Purchase” the buying command understands that the part has available quantity on hand and anticipates a 30–60-day lead time for delivery of part(s) unless otherwise negotiated. Specifically for this RFP, the Contracting Officer requires written notification that details the reason why a single purchase is being made over multi-year pricing.

10. In the interest of supporting obsolete items and pursuant to communication with the Contracting Officer, in conjunction with the original part requested, an additional proposal for a “Single Purchase” of the Next Higher Assembly (NHA) may be accepted to support the function of a requested part.

11. Nothing in this RFP shall be construed to preclude the contracting officer from requiring the offeror to supply sufficient information to determine the reasonableness of price, regardless of whether the offeror was required to provide such information in connection with any earlier procurement. If the contracting officer determines that the pricing information submitted is not sufficient (see Section C of this RFP) to determine the reasonableness of price, the contracting officer may request other relevant information prior to accepting the proposal as adequate and consistent with the solicitation.

12. The proposal should include at least the proposed order sizes, evidence-based delivery schedules, price ranges-

Minium Order Quantities (MOQ), & Best Estimated Quantities (BEQ). The Government expects the Offeror to propose only the quantities and price ranges that can be supported and is open to negotiating any items related to quantity or price ranges. The quantities requested are based on a government estimate and the offeror proposal shall support the MOQ & BEQ unit prices for each part number provided.

13. Raytheon shall only propose sole source items under this contract. Raytheon shall notify the Government immediately if the items or services being solicited are not sole source to Raytheon.

14. First Article (FAT) / Production Lot (PLT) MAY BE required. FAT unit MAY BE retained as a material standard.

Test Item MAY BE destroyed as part of testing. First Article Test (FAT) and Production Lot Test (PLT) requirements for items listed in Enclosure 1 - Identification of Requirements, as applicable, MAY BE waived.

a. Enclosure 1- identifies parts that have been waived or are not waived, if a part is not waived then it is requested that the contractor provides a proposal with FAT/PLT proposed. If the contractor feels that the part should be waived, then the contractor will need to request a waiver worksheet from DLA and submit it to DLA with supporting documents to the USG for approval/disapproval of the waiver.

b. If the FAT/ PLT waiver is disapproved, the contractor will need to submit pricing to include the FAT/ PLT and clearly break the cost out separately for each part as it will be included in the contract as a separate CLIN for each part.

C. Proposal Content/Cost/Price Supporting documentation. At a minimum your proposal shall be addressed with the following:

10. Time of Delivery – Accelerated Delivery

Unless otherwise authorized in the award, accelerated delivery is acceptable only if there is no additional cost or obligation to the Government for accelerated delivery.

11. DEFENSE PRIORITY AND ALLOCATIONS SYSTEM (DPAS) RATED AWARDS

Defense Priorities and Allocations System (DPAS) Rated Awards (JUNE 2025)

A DPAS rated order indicates the priority the contractor must give to the performance of the award. There are two priority ratings: “DX” and “DO”. All “DX” rated orders have equal priority with each other and take preference over “DO” rated orders and unrated orders. All“DO” rated orders have equal priority with each other and take preference over unrated orders. (see 15 CFR 700.11 and DoDM 4400.1-M).

Mandatory Contractor Performance Scheduling

A contractor must schedule operations, including the acquisition of all needed production items, in a timely manner to satisfy the delivery requirements of each DPAS rated order. Additionally, contractors are required to use DPAS rated orders with their U.S. suppliers to obtain items needed to fill rated orders (15 CFR 700.15).

Contractors may also use DPAS rated orders to obtain replacements of inventoried items used to fill rated orders (see 15 CFR 700.17(b)). Modifying production or delivery schedules is necessary only when required delivery dates for a rated order cannot otherwise be met. Since “DX” indicates the highest rated order, the manufacturer will schedule its production before processing other lower or unrated orders. “DX” rated orders must be given production preference over “DO” rated orders and unrated orders if necessary to meet required delivery dates, even if this requires the diversion of items being processed or ready for delivery against unrated orders. Similarly, “DO” rated orders must be given preference over unrated orders. If an accepted rated order of equal priority status conflicts with other accepted rated orders of equal priority status, the contractor must prioritize the rated orders in the sequence in which the rated orders are to be delivered or performed (see 15 CFR 700.14).

Contractor Acceptance of a DPAS rated order:

[Contractors receiving an award that includes a DPAS rating shall advise DLA via the post award mailbox (DLAHSVPostAwardTeam@dla.mil & DLAHSVRTXTEAM@dla.mill) , if they cannot perform in accordance with the requirements of the applied DPAS rating. When rejecting an order in full, communication to the contracting officer must include a detailed reason for rejection. If the order can be fulfilled at a later date, the contractor must provide, a) the earliest possible delivery date, b) a detailed reason why the awarded delivery date cannot be met (e.g. reason should not simply state a production delay) and, c) an offer to accept the order based on that date. Contractors must advise DLA within fifteen (15) working days after receipt of a “DO” rated order, and within ten (10) working days after receipt of a “DX” rated order if they cannot perform in accordance with the DPAS rating. Contractors that do not contact DLA are self-attesting that they acknowledge receipt of the award and will conform to the DPAS rating requirement. If the prescribed response time has passed and the contractor learns that shipment or performance will be delayed, the contractor is still required to notify DLA immediately.

Special Priority Assistance:

Preferential scheduling is a must for DPAS rated orders (see 15 CFR 700.14). If a contractor learns that a shipment or performance will be delayed after the allotted response time has passed or any other issue arises that will affect deliveries during the duration of the contract, the contractor is required to notify DLA immediately through the use of Form BIS-999, Special Priorities Assistance (SPA). Deviations from schedules cannot be approved without the completion and submission of this form. Once submitted, DLA and its customers will discuss the SPA for approval. The Department of Commerce requires an approved BIS-999 prior to reprioritizing DPAS rated orders and its schedules (See 15 CFR 700.50). Please contact DLA post award for any SPA questions or concerns.

13. FAR 52.204-7(c)(2) says by submitting its offer, the Offeror verifies that, as of the date of its offer, its representations and certifications posted electronically in SAM for the provisions listed in paragraph (c)(1) of this provision are current, accurate, and complete. The Offeror’s representations and certifications in SAM are hereby incorporated by reference into its offer.
