Justification and Approval for Other Than Full and Open Competition

This is a Justification and Approval (J&A) document for a non-competitive federal contract award by the United States Air Force. The Air Force Material Command (AFMC) at Hill Air Force Base, Utah, seeks approval to issue a sole-source bridge contract under the authority of FAR 6.302-2 (Unusual and Compelling Urgency) to provide critical product support integration services for the Avionics Intermediate Shop. The contract will be awarded as a Firm Fixed Price (FFP) non-commercial bridge C-type contract to the incumbent contractor for a 120-day performance period from January 26, 2026, through May 26, 2026. The estimated contract value is redacted, with pricing based on past actuals from the predecessor contract FA8251-22-F-0069, including labor, subcontractor labor, travel, and data deliverables. This bridge action is necessary because the current contract FA8251-18-D-0017 (a 7.5-year ID/IQ integration contract) expires on January 23, 2026, and the follow-on contract must be operational by January 26, 2026 to maintain critical operational capability without service interruption.

The J&A justifies the sole-source award based on the impractical timeline for competitive solicitation, as the 45-day Federal Acquisition Regulation furlough and procurement timeline would exceed available time and create an untenable service gap. The Government confirmed a competitive market exists through market research conducted for the long-term, follow-on requirement, which is currently underway as a full and open competition. The justification emphasizes that awarding to any other source would result in prohibitive duplication of costs and schedule delays due to contractor start-up, security processing, and training requirements. No sources expressed written interest in this urgent requirement, as it was not synopsized per FAR 5.202(a)(2) exception. The Government commits to preventing future sole-source actions by completing the ongoing competitive procurement to establish a long-term contract for these services.

V. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable, including whether a notice was or will be publicized as required by subpart 5.2 and, if not, which exception under

FAR 5.202 applies.

Due to the unusual and compelling urgency of this requirement, solicitation was limited to

In accordance with FAR 5.203, a notice of the proposed contract action was not publicized. This action is exempt from the synopsis requirement under the authority of FAR 5.202(a)(2).

This exception is applicable because this justification is made under the authority of FAR 6.302-2, "Unusual and Compelling Urgency," and

A competitive solicitation for the long-term, follow-on requirement is currently underway, demonstrating the Government's commitment to maximizing competition when time permits.

VI. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

The technical analysis of the offerors Basis of Estimates (BOE) and inputs from the contracting officer, the contracting officer expects they will be able to determine that the anticipated costs to the Government will be fair and reasonable.

VII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.

Market research for the long-term, competitive follow-on requirement was conducted, which resulted in the ongoing source selection currently in progress. That effort confirms that a competitive market exists for the enduring requirement, and the Government is committed to maximizing competition for the long-term solution.

The market research for this specific short-term bridge action is focused on identifying sources capable of continuing the critical services without a service interruption, beginning 26 January 2026.

Therefore, a review of the market, including the known sources from the ongoing competitive procurement, confirms that

VIII. Any other facts supporting the use of Other Than Full and Open Competition.

The most significant fact supporting this justification is the

1.

August 2023 Page 5 of 5August 2023 Page 5 of 5

The follow-on bridge contract must be operational by 26 January 2026

2. Bridge Action to Support Full Competition: This sole-source bridge action is a temporary measure necessitated by the for the long-term requirement. This action is not intended to circumvent competition but rather to provide the necessary time to complete a fair and thorough competitive process without causing mission failure.

3. Prohibitive Duplication of Cost and Schedule Impact: Awarding a short-term bridge contract to any source other would require a new contractor to expend significant time and resources for recruiting, training, and security processing. These start-up costs would be duplicated when the long-term competitive contract is awarded, representing a substantial and unrecoverable duplication of cost to the Government. More critically, the schedule impact of such a transition makes any other source non-viable for this urgent requirement.

IX. List of any sources that expressed, in writing, an interest in the acquisition.

As this urgent requirement was not synopsized, in accordance with the exception at FAR 5.202(a)(2), no notice was publicized.

X. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisitions for the supplies or services required.

The primary action to overcome barriers to competition for this requirement is already in its final phase. The Government is concluding a full and open competition for the long-term, follow-on contract.

Upon successful completion of the ongoing review, a long-term, competitive contract will be awarded. This action will establish a competitive environment for this requirement and is intended to prevent the need for any future sole-source actions for these services.
