JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND
OPEN COMPETITION (JOFOC)
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION IN ACCORDANCE WITH
TITLE 41 U.S.C. 3304 (A) (1)
UNDER SIMPLIFIED ACQUISITION THRESHOLD
Requisition Number: SHOP-PR-25-000773
Date: 26 January 2025
Estimated Contract Dollar Value:
1. Identification of the agency and contracting activity.
The U.S. Department of Justice (DOJ), Federal Bureau of Investigation (FBI), Procurement Section (PS), National Acquisition Programs Unit (NAPU), has prepared this justification for other than full and open competition for the acquisition of Air Clean System filters on behalf of the Laboratory Division (LD), Evidence Response Team Unit (ERTU).
2. The nature and/or description of the action being approved, i.e., sole source, limited competition, establishment of a new source, etc.
In accordance with a statutory exception to the fair opportunity process, the FBI contemplates the award of a one-time, sole-source, firm-fixed-price, commercial product, purchase order to Applied Medical Technologies, Inc., (doing business as Air Clean Systems), [CAGE Code 02HC2], 2179 E. Lyon Station Road, Creedmoor, North Carolina, 27522-9108 for Bonded Carbon Filters, HEPA Filters, and Particulate Pre-filters.
3. A description of the supplies or services required to meet the agency’s needs.
Each FBI Field Office (FO) has an Evidence Response Team (ERT). ERTs collect and preserve evidence from crime scenes. The FOs have a DrySafe Evidence Drying Cabinet, which was manufactured by Air Clean Systems. Evidence collected at crime scenes may be wet with blood or other bodily fluids. Evidence items, such as clothes and shoes, may be dried in the drying cabinet, which provides a quick drying process, both secure and within a controlled environment for drying evidence, preventing contamination, and for preserving the integrity of evidence. The filters contained within the drying cabinets act to capture or collect all airborne particles or vapors released during the drying process and must be changed periodically. Each cabinet has pre-filters which should be changed at least once every three (3) months. Each cabinet also has a HEPA filter and a carbon filter which must be replaced every two (2) years. The used filters are considered hazardous waste once they have served their predetermined life cycle.
The Bonded Carbon Filters must meet the following requirements: The filters must fit the DrySafe Evidence Drying Cabinet, (Model Number ACEVD60A/ACEVD60AS), with no need for modification of the filter or the Drying Cabinet; must be a Bonded Carbon Filter; must filter ammonia and amines; must have a minimum life expectancy of two (2) years; must meet the measurements, geometry, and design of Air Clean Systems Filter Type ACF300.
The HEPA Filters must meet the following requirements: The filters must fit the DrySafe Evidence Drying Cabinet, (Model ACEVD60A/ACEVD60AS), with no need for modification of filter or the Drying Cabinet; must have an efficiency rating of 99.997 percent for collection at 0.3 microns;
must have a minimum life expectancy of two (2) years in duration; must meet the measurements, geometry, and design of the Air Clean Systems Filter Type ACFHEPA.
The Particulate Pre-filters must meet the following requirements: The filters must fit the DrySafe Evidence Drying Cabinet (Model ACEVD60A/ACEVD60AS), with no need for modification of filter or the Drying Cabinet; must have an efficiency rating of 95 percent; must have a minimum life expectancy of one (1) month; must meet the measurements, geometry, and design of the Air Clean Systems Filter Type ACFPRE, (pack of 12). The pre-filters effectively capture larger (submicron) particles, extending the lifespan of the main filters and ensuring optimal performance of the air purification system.
4. The statutory authority permitting other than full and open competition.
The statutory authority permitting other than full and open competition is 41 U.S.C. 3304(a)(1) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1 entitled, “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.”
5. Demonstrate the unique qualifications of the proposed contractor or the nature of the action requiring the use of the authority.
Air Clean Systems products are designed and manufactured around specific filtration to assure that the DrySafe Evidence Drying Cabinet functions properly when protecting either the operator or the process. The ACF300, ACFHEPA, and ACFPRE filters are manufactured by Air Clean Systems and are an integral part of the design and need to be changed regularly to maintain proper performance of this equipment. These filters are made in the USA.
Air Clean Systems is the sole source manufacturer of replacement filters for all Air Clean Systems DrySafe Evidence Drying Cabinets. The main replacement filters, both Bonded Carbon and HEPA, are sold individually and not as a package or a kit.
Air Clean Systems is a small business. The FBI awarded Purchase Order (PO) Number 15F06721P0002808 to Applied Medical Technologies, Inc. on March 2nd, 2021, for Air Clean System filters for the DrySafe Evidence Drying Cabinets.
6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies.
A Notice of Intent (NOI) to award a sole-source Purchase Order (PO) to Applied Medical Technologies, Inc. will be posted on the SAM.gov website. This announcement will also give an opportunity for other vendors to demonstrate their ability to meet the FBI’s specific needs through a submission of their technical capabilities and cost information for consideration prior to an award being issued.
7. The anticipated dollar value of the proposed acquisition, including options if applicable, and a determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
Prior to issuing an award, the Contracting Officer will determine that the proposed price is fair and reasonable in accordance with FAR 13.106-3.
8. A description of the market research conducted and the results.
During a criminal investigation, it is common to seize items that are contaminated with liquid blood or other bodily fluids. To properly package these items of evidence, the item must first be dried. This process is done by utilizing a drying cabinet. Preventative maintenance and service of the DrySafe Evidence Drying Cabinets is essential for performance. The filters contained within these cabinets capture and/or collect all airborne particles or vapors released during the drying process. Field ERT personnel will perform the installation of these filters and the routine cleaning and maintenance of the Drying Cabinets.
Market research was conducted and searches for filters were conducted on the Internet and by speaking with various vendor representatives. The FBI cannot procure any filter. Only Air Clean System original equipment manufacturer (OEM) filters are specifically designed to fit and function within the DrySafe Evidence Drying Cabinet. The use of OEM filters is vitally important to avoid compromising the reliability and performance of the cabinet. It is essential that the recommendations of the manufacturer be followed when servicing these cabinets.
9. Any other facts supporting the use of other than full and open competition.

See section 5 above.
10. A listing of any sources that expressed a written interest in the acquisition.
A synopsis will be posted on the SAM.gov website. This synopsis will give an opportunity for other vendors to demonstrate their ability to meet the FBI’s specific needs through a submission of technical capabilities and cost information.
11. A statement of any actions the agency may take to remove or overcome any barriers to competition if subsequent acquisitions are anticipated.
The FBI will continue to conduct market surveys and research available through industry shows and technology releases in the form of papers and journals. This will be used to identify potential sources for subsequent acquisitions. If potential sources are identified, it will be necessary to submit to both extended compatibility and validation studies if the products are to be added to the FDDU laboratory process. The FBI Laboratory holds itself to the highest standards within the forensic community and ensures that any technology used is proven, assessed technology.
