AMENDMENT 2 – Solicitation AG-SPEC-S-17-0007

RESPONSE TO QUESTIONS

A-E DESIGN SERVICES TO INCLUDE

GEOTECHNICAL ENGINEERING, MODELING, DESIGN, SURVEYING, AND INSPECTION SERVICES

TO DEVELOP COMPLETE DESIGN PACKAGES FOR PROJECTS LOCATED WITHIN THE COASTAL AREAS

OF THE GULF COAST REGION OF THE UNITED STATES

(TEXAS, LOUISIANA, MISSISSIPPI, ALABAMA AND FLORIDA)

Q1.To further clarify the response to Q.1 and Q.16 from Amendment One, please confirm that it is your intent that minimum qualifications for items 2 (Civil/Ag), 3 (Electrical/Mechanical), 5 (Hydrological/Modeling), 6 (Civil), 7 (PLS), and 9 (Ecologist) is that we may provide multiple people in these categories to meet the state registration/licensing coverage, as opposed to individuals for each discipline who are registered/licensed in each of the coastal states.
A1.Confirmed.
Q2.For the SF 330 Section F example project descriptions, are we permitted to list IDIQ’s and similar types of master contracts as a single project? Or would you prefer we list specific task orders as projects?
A2.Please list specific task orders as projects.
Q3.Can Minimum Qualification #6 be met by multiple personnel who, individually, possess ten years’ experience, and collectively, hold licenses in the states represented above? Example: Engineer 1 has ten years experienced and is licensed in TX, MS and FL. Engineer 2 has ten years’ experience and is licensed in LA and AL.
A3.Yes
Q4.Regarding Solicitation AG-SPEC-S-17-0007, the text states: “Under FAR 52-219-14 Limitations of Subcontracting, the prime contractor must perform at least 50% of the cost of contract performance with his/her own employees. This applies to small business set aside contracts.” Does the SBA’s new ruling, which went into effect in June of this year, apply to this solicitation? Specifically, can a small business pursue this contract and demonstrate ability to perform at least 50% of the cost of contract performance with his/her own employees or employees of other small businesses on the team?
A4.This Final Rule was effective for SBA's Regulations (the CFR) on June 30, 2016 but does not change any requirements, or regulations, contained in the FAR; such as the Limitations on Subcontracting clause 52.219-14. It is only when the FAR is changed that it affects contracting. The FAR still states that the Contracting Officer shall not "Deviate" from the FAR. The SBA's regulations (CFR) have changed (e.g. SBA is now issuing Mentor Protégé agreements for all Small Businesses and JV's under the new SBA regulations) but the FAR has not yet been changed to catch up with the new SBA regulations. Until the FAR regulations have changed, all CO’s must continue to utilize the requirements and make determinations in accordance with FAR 52.219-14.
Q5.Given the fact that this RFQ covers a 5 state geographic area and includes so many disciplines, would you consider excluding the SF 330 Part II’s from the 100 page limitation?
A5.No
