ADDITIONAL QUESTIONS
Dog Tooth Bend EWP Channel Clearing and Excavation Solicitation AG-SPEC-S-16-0035
Q) During the question and answer section, clearing of channels was discussed. The question was the size or diameter of trees that would be encountered during channel excavation? The answer given was that clearing would be required to the top of the cut slopes and would consist of small trees only, perhaps four inch +/- being the top size. Clearing mature trees of greater diameter would not be required. However, this subject was not addressed within the questions/answers provided within amendment number 1.
A) Occasionally to access the ditch it may require removal of some trees and brush. Any size tree or brush may be present along the channels, with most being smaller in size.
Q) The work area limits as shown for Lateral D2 is confined to the county road right-of-way. Our question concerns the disposal of spoil material generated during excavation. Has it been determined that there is sufficient space for stockpiling of spoil material within the work area limits or will it be necessary to transport said spoil to other disposal areas? We would like clarification on the work required with respect to Lateral D2.
A) The work area is the county road right-of-way. The county is responsible for spreading of the spoiled material removed from the ditch. Work with the county highway if you have special needs. The amount of spoil would not exceed the work area.
Q) The Dog Tooth Bend EWP project consist of approximately 22 profile drawings. We would like clarification as to whether the upper profile as shown represents elevations on centerline of proposed channel or the bank line?
A) Centerline
Q) The Does the SF-24 Bid Bond have to be the original stamped. Or can my bond company email me a copy and I send that?
A) The Bid Bond has to be original as do the bid documents. No copies, email version or facsimiles will be accepted. They must be mail or delivered to be received in Syracuse at the address in Block 7 by the date and time shown – Monday, September 12, 2016 by 12 pm local time (which is Eastern time).
Q) Can sealed bid be delivered prior to the September 12 bid opening or does it have to be that day?
A) Bids will be accepted at any time prior and up to the date and time for bid opening, and kept in a locked file until bid opening. Anything received after that date and time will be rejected.
Q) Does the government require a special bond form for the bid bond.
A) Bid bonds must be in accordance with FAR clause 52.228-1 – they do not necessarily need to the on the SF-24 form, but must meet the requirements of the clause, so we recommend that this form be used to insure that your bid guarantee meets all the requirements – the language required by the Government is specific.
If you submit a bid bond on something other than am SF-24 it will have legal review to determine whether or not the form used is acceptable. This will be based on whether or not it represents a significant departure from the rights and obligations of the parties as set forth in SF 24. Forms other than the SF 24 may include limitations (e.g. limitations on the ability of the Government to recover costs under the bond), which are unacceptable and contrary to what is on the SF 24. It that were the case, the would have to be rejected.
Q) The period of performance on page 3 of 37 of the solicitation is listed as 8/26/16-11/10/16. Given that the bids are not due until 9/12/16 will contractors be held to the 11/10/16 date or should we just assume 45 calendar days from NTP? If the latter is the case, generally what is timeframe between award and NTP?
A) The performance time is 45 days from the Notice to Proceed. NTP is generally issued within 10 days or less of contract award.
