About this file
Summary
This is an Agreement Template for Construction Contract between the City of Edinburg, Texas, and a contractor for the design, engineering, permitting, and installation of fire sprinkler systems at two municipal fire stations. The project encompasses Station 1 (212 W. McIntyre Street), an 18,000 square-foot facility requiring installation of one overhead sprinkler system with smoke and carbon monoxide alarm connections to existing fire sprinkler and alarm infrastructure, and Station 3 (1221 E. University Drive), a 6,000 square-foot facility requiring complete new installation of sprinkler and fire alarm systems including all underground work from the riser to the city water line. The contractor must provide design, engineering plans, and hydraulic calculations and is responsible for obtaining all permits from the City of Edinburg Permits Department at no charge to the City. Substantial Completion is required on or before July 12, 2027 (210 calendar days from Notice to Proceed), with Milestone 1 (Station 1) due within 90 calendar days and Milestone 2 (Station 3) due within 120 calendar days from their respective section start dates. Final Completion must occur within 30 calendar days of Substantial Completion (on or before August 11, 2027). The contractor bears full financial responsibility for any reinspection fees caused by failed inspections or missed appointments.
The contract price consists of Unit Price Work for both stations, including Site Surveys, Hydrant Flow Testing, Engineering Drawings, and Turn-key Fire Sprinkler System installation, with specific pricing to be determined through the bidding process. Progress payments will be made monthly on or about the 25th day of each month, based on the Schedule of Values and measured against percentage of work completed, with retainage held until final completion. Liquidated damages for failure to achieve Substantial Completion range from $100 to $800 per day depending on contract value, and an additional $250 per day applies for failure to complete remaining work after Substantial Completion. The contractor must provide Performance and Payment bonds with powers of attorney. The contract incorporates EJCDC C-700 Standard General Conditions for Construction Contracts (2018) and requires the contractor to comply with all applicable state and federal laws and regulations, with failure to comply potentially resulting in contract termination and contractor disbarment. All amounts not paid when due accrue interest at 0% per annum, and the contractor must hold a valid fire sprinkler contractor license.
