This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in the Federal Acquisition Regulation (FAR) 12.6, as may be supplemented with additional information included in this notice. This combined synopsis/solicitation is for Fuel

Truck for Air Tactical Missions (Region 5) for a total period of five (5) years. This is a commercial product. The Government intends to award a minimum of two Contracts for an estimated time period of five (5) years from the date of award.

The intent of the Combined Synopsis / Solicitation is to obtain a two (2) fuel trucks to provide

2,500 gallon minimum capacity fuel truck services for a period of 122 days for 2 USDA Forest

Service (FS) Government-owned Bell 209 de-militarized Cobra helicopters at Government facilities (1 each) in Redding and Lancaster California. This contract is for truck and driver fuel transportation services. Jet A aircraft fuel is not part of this contract. Fuel will be supplied by the government. The proposed contract period is one base year with four option years. Pricing shall be based on a monthly rate per unit by location of the unit.

This solicitation is set-aside for Total Small Business (*No hard copies will be provided. All information for this combined synopsis is posted on www.fbo.gov.)

The solicitation documents and incorporated provisions and clauses are those in effect through

Federal Acquisition Regulations. The North American Industry Classification System (NAICS) code is 484220, defined as Specialized Freight (except Used Goods) Trucking, Local.

INSTRUCTIONS FOR SUBMISSION OF OFFERS:

Price Proposal Instructions

The offeror shall propose a yearly unit price for _Fuel Truck for Air Tactical Missions (Region

5) for each fuel truck/location that is listed. The offeror's price proposal shall be no longer than two (2) pages.

Technical Proposal Instructions

The offeror's proposal shall include the offeror's approach to meeting all requirements noted under the contract Requirements. No deviations are acceptable to the contract requirements. All required certifications to support the offer shall be included. The offeror's technical proposal shall be no longer than two (2) pages.

Proposals that do not adhere to all requirements / specifications in this solicitation may be rejected without further evaluation, deliberation, or discussion. The Government may reject any proposal that is not compliant with the solicitation requirements / specifications or reflects a failure to comprehend the scope of the resource categories to be provided.

Basis for Award

Contract award(s) will be based on the best value to the Government in terms of the price proposed and the technical requirements as stipulated in the Contract Requirements.

Pricing will be evaluated based on price reasonableness and price realism, as deemed necessary by the Government.

The Government may, at its discretion, obtain contractors past performance information from available sources, such as from the Past Performance Information Retrieval System or any other past performance information available to the Government. The Government reserves the right of not making a contract award to offerors with negative past performance information.

Contract Requirements:

Scope of Contract

A) This contract is to provide 2,500 gallon minimum capacity fuel truck services for a period of 122 days for 2 USDA Forest Service (FS) Government-owned Bell 209 de-militarized Cobra helicopters at Government facilities (1 each) in Redding and Lancaster California. This contract is for truck and driver fuel transportation services. Jet A aircraft fuel is not part of this contract. Fuel will be supplied by the government.

B) During contract field season, fuel truck support services will be required throughout the Continental US. The government will reimburse the contractor for travel and overnight expenses only when operating away from home base.

C) The proposed contract period is one base year with four option years.

Fuel Servicing Vehicle General:

A) This contract request is for 2 approved fuel servicing vehicles, 1 for each location (Redding, California and Lancaster, California) The fuel servicing vehicle shall be inspected annually by the Government and shall be stationed at the Base of Operation unless dispatched by the Contracting Officers’ Representative. Each vehicle shall display a current USDA-FS inspection sticker.

B) The fuel servicing vehicles shall be capable of transporting fuel over roads, through rough mountainous terrain to include grades of up to 9 percent or more.

C) Fuel servicing vehicles shall be properly maintained, clean, and reliable. Tanks, plumbing, filters, and other required equipment shall be free of rust, scale, dirt, and other contaminants.

D) Spare filters, seals, and other components of the fuel servicing vehicle filtering system shall be stored in a clean dry area. A minimum of one set is required to be with the vehicle.

E) The fuel tank capacity shall be 2500 gallons minimum. Barrels are not acceptable. The fuel servicing vehicle manufacturers' gross vehicle weight (GVW) with a full fuel tank shall not be exceeded.

F) It will be the contractors’ responsibility to obtain any required trip permits. The costs of any permits will be reimbursed by the government through the normal payment process.

G) All tanks will be securely fastened to the truck bed and shall have a sump or sediment settling area of adequate capacity to provide uncontaminated fuel to the filter.

H) A 10-gallon-per-minute flow rate delivered by the filter and pump from the nozzle is the minimum size acceptable. Filter and pump sizes shall be compatible with the Helicopter being service.

I) A filter manufacturer's Operating, Installation and Service Manual shall be with the fuel servicing vehicle. Filters shall be changed in accordance with the manual's instructions.

J) Gasoline engine driven pumps shall have shielded ignition system and Forest

Service approved spark arrestor. Other exposed terminal connections shall be insulated to prevent sparking in the event of contact with conductive material.

K) All refueling pumps regardless of power source shall be listed for use with petroleum products (e.g. UL, FM etc.).

Fuel Servicing Vehicle Equipment:

A) All refueling pumps regardless of power source shall be listed for use with petroleum products (e.g. UL, FM etc.).

B) Each aircraft fuel servicing tank vehicle shall have two fire extinguishers, each having a rating of at least 20-B:C with one extinguisher mounted on each side of the vehicle. Extinguishers shall comply with NFPA 10 Standards for Portable Fire Extinguishers.

C) Fuel tanks shall be designed to allow contaminants to be removed from the sediment settling area. This settling area will be emptied daily. A record of the results will be kept for tracking and quality assurance purposes.

D) Only hoses designed for dispensing of the type of Aviation fuel being utilized will be used. Hoses that comply with API BULL 1529 hose Type C, Type F and Type CT are known to meet this requirement. Hoses shall be kept in good repair and stored on a mechanized reel on the fuel servicing vehicle.

E) Fuel nozzle shall include a 100 mesh or finer screen (except for closed circuit nozzles), a dust protective device and a bonding clip or plug. No hold-open devices will be permitted.

F) An accurate fuel metering device for registering quantities in U.S. gallons of fuel pumped shall be provided. The meter shall be positioned in full view of the fuel handler while fueling the Helicopter.

G) Fuel servicing vehicle shall have adequate bonding cables.

H) Fuel servicing vehicle shall comply with Department of Transportation and

Environmental Protection Agency requirements for transportation and storage of fuel, and shall carry sufficient petroleum product absorbent pads or materials to absorb or contain up to a 5-gallon petroleum product spill. The Contractor is responsible for cleanup of all product spills and disposal of all products used in the cleanup of a spill in accordance with the EPA, CFR 40 Part 261 and 262.

I) The contractor shall provide for closed circuit fueling. The fuel hose shall be at least 50 feet in length. The Wiggins fuel nozzle, compatible with the Hydraulic Research receiver. An adapter shall be provided to allow fueling of aircraft with standard fueling port. Tube-Alloy fuel nozzle and Carter 64018 Commercial Circuit nozzles also approved.

J) The fueling system must be equipped with a “dead man switch” that meets NFPA

407 and Forest Service CWN requirements.

K) The contractor must provide and maintain the required personal protective equipment for the fuel truck operators use while dispensing fuel and working in close proximity to aircraft.

L) The Fuel Service Vehicle shall be equipped with a cell phone that is assigned to the vehicle (i.e. not the personnel).

M) The fuel trucks shall be equipped with P25 compliant mobile and hand-held radios. A single radio is acceptable if the vehicle is equipped with a vehicle adapter or “docking station” (Jerk and Run).

Fuel Servicing Vehicle Markings:

A) Each fuel servicing vehicle shall have "NO SMOKING" signs with 3-inch minimum letters visible from both sides and rear of vehicle.

B) Each vehicle shall also be conspicuously and legibly marked to indicate the nature of the fuel. The marking shall be on each side and the rear in letters at least 3 inches high on a background of sharply contrasting color such as Avgas by grade or jet fuel by type.

C) EXAMPLE: Jet-A white on black background, Avgas 100 white on green background.

D) All fuel servicing vehicles must be placarded in accordance with 49 CFR 172.

E) Each vehicle shall display Firewatch emblems. These emblems will be provided by the government.

Fuel Servicing Vehicle Filtering System:

(Three-Stage or Single-Stage is acceptable)

A) The first and third stage elements of a three-stage system and the elements of a single-stage system shall be new and installed by the Contractor during the annual inspection and witnessed by the Government Inspector. The separator element (Teflon screen) of the three-stage system shall be inspected and tested as prescribed by the manufacturer.

B) If equipped with a drain, the bottom of the filter assembly shall be mounted to allow for draining and pressure flushing into a container. If the unit is drained overboard, the fuel shall not come in contact with the exhaust system or the vehicle's wheels. If the unit is equipped with a water sight gauge, the balls shall be visible.

Three-Stage (filter, water separator, monitor API/IP 1583 or current Military specification qualified) System: Fueling systems shall utilize a three-stage system such as a Facet Part Number 900442-FG-220 using facet cartidges, for 20 gallon per minute pump, or equal. A Facet Part Number 900443-FG-210 for a 10 gallon-per-minute (g.p.m.) pump, or equal. An acceptable third stage (monitor) unit is Velcon C.F. 220K for 20 g.p.m. flow or Velcon C.F. 210K for 10 g.p.m. systems. All three stages must come from the same manufacture.

Examples: Facet 21 (or 22) Series canister (VFG-21-609, VF-21-609, VFCS- 21, VFG-22-612) with a Facet FG-O-609-2 (21 series) cartridge for 40 gpm, or the FG-O-612 for 50 gpm. Or the Velcon VF-61 canister with an ACO- 51201K or a Facet FG-O-512-2 cartridge for 50 gpm.

Single-Stage System or Three-in-One Filter Canister: Fueling systems shall utilize a single (API/IP 1583 qualified) element system such as a Velcon or the Facet filter canister with Aquacon cartridge or the Facet Fuel Gard (FG-O-XXX) of a size compatible with pumps flow rate.

Differential ressure gauge(s) shall be installed and readable.

EXAMPLE: Velcon VF-61 canister with an ACO-51201K or a Facet FG-O-512-2 cartridge, or ACO-40501SPK or the Facet Spin-On cartridges FGS-O-405 & FGS-O-409.for 10 to 15 GPM flow rate - or the Facet 21 or 22 Series canister (VFG-21-609, VF-21-609, VFCS- 21, VFG-22-612) with a Facet FG-O-609-2 (21 series) cartridge for 40 gpm, or FG-O-612 (22 series) for 50 gpm.

Fueling:

A) Fueling operations, including storage and handling, shall comply with the airframe and engine manufacturer's recommendations and all applicable FAA standards. [NFPA Standard No. 407, Aircraft Fuel Servicing, shall be followed except that no passengers may be on board during fueling operations.] Additionally, if storage facilities contain more than 1,320 gallons in total or any one single container contains more than 660 gallons, then the regulations of the Environmental Protection Agency (EPA) shall apply; see Title 40, Code of Federal Regulations, Part 112 (40 CFR 112).

B) Fuel shall pass through a filtering system, as outlined in Section C, FUEL

SERVICING VEHICLE FILTERING SYSTEM, in accordance with the filter manufacturer's recommendations.

C) If requested by the government and the contractor has been approved, Rapid

Refueling of Helicopters is permitted in accordance with NFPA 407 5-21. There are two approved methods of Rapid Refueling:

Closed Circuit Refueling (CCR). This method of refueling uses a CCR system designed to prevent spills, minimized fuel contamination, and prevent escape of flammable fuel vapors.

Open Port. This method of refueling allows flammable fuel vapors to escape.

D) Rapid refueling of helicopters is permitted if requested by the Government, and the Contractor meets the following requirements:

Rapid refueling proceedures in accordance with NFPA 407 -21 and Forest Service policy.

Notwithstanding NFPA 407 5-21.2(b), a pilot is seated at the controls of the aircraft during refueling operations.

Personnel providing onsite fire protection are briefed on the Forest Service rapid refueling proceedures.

Fuel quality control procedures are outlined in the Quality Control

Procedures for Fueling Attachment.

E) All smoking is prohibited within 50 feet of fuel servicing vehicles and aircraft.

Fuel Servicing Vehicle Driver Qualifications and Responsibilities:

A) The Contractor shall furnish appropriately licensed and qualified fuel service vehicle drivers for each day the fuel trucks are on duty.

B) Each driver will be expected to demonstrate an acceptable knowledge of correct fueling procedures and fueling and safety equipment installed on the fueling vehicle.

Fuel Servicing Vehicle Driver Duty Limitations:

A) Fuel Servicing Vehicle Driver shall comply with Department of Transportation (DOT) Safety regulations part 390-399, including duty limitations. It is the Contractor’s responsibility to insure that employees comply with DOT regulations.

B) Duty includes standby, work or alert status at any location.

C) Fuel Servicing Vehicle Drivers may be removed from duty for fatigue or other causes created by unusually strenuous or severe duty before reaching duty limitations.

D) Notwithstanding DOT Safety Regulations Part 390-399, the fuel service vehicle driver shall have a minimum of 2 full calendar days off duty during any 14-day period. Off duty days need not be consecutive.

Conduct and Replacement of Personnel:

A) Performance of Contract services may involve work and/or residence on Federal property (i.e., National Forests and National Parks, etc.). Contractor employees are expected to follow the rules of conduct established by the manager of such facilities that apply to all Government or non-Government personnel working or residing on such facilities. The Contractor may be required to replace employees who are found to be in noncompliance with Government facility rules of conduct.

B) Personnel, who perform ineffectively, refuse to cooperate in the fulfillment of the

Contract objectives, are unable or unwilling to adapt to field living conditions, or whose general performance is unsatisfactory or otherwise disruptive may be required to be replaced.

C) The CO shall notify the Contractor of specifics of the unsatisfactory conduct and/or performance by the Contractor's personnel. The determination of unacceptability is at the sole discretion of the CO. When directed by the CO, the Contractor shall replace unacceptable personnel.

D) Fuel servicing personnel shall speak, read, and write English fluently and communicate clearly.

E) Contract personnel may be required and shall be equipped to stay multiple nights in remote locations without accommodations, for example, a fire camp setting.

Suspension and Revocation of Personnel:

A) The CO may suspend a contractor fuel servicing vehicle driver who fails to follow safe operating practices, does ineffective work, or exhibits conduct detrimental to the purpose for which contracted, or is under suspension or revocation by another government agency.

Substitution or Replacement of Personnel and Equipment:

A) The Contractor may substitute or replace equipment equal to or greater than contract awarded performance after receipt of written approval by the Contracting Officer.

B) Request for substitution shall be made at least 10 (ten) days prior to the proposed exchange, except for unforeseen conditions.

Relief Crews:

When the Contractor is dispatched away from the designated base of operations, the Government may authorize payment for the reasonable cost of transporting a relief crew to and from the temporary base of operations. This does not include transportation costs to the permanent bases of operation. This cost reimbursement is not applicable to primary crews. Salary costs for Contractor relief employee(s) while in travel status is not a cost for which the Government will reimburse the Contractor.

Travel expenses shall include transportation and per diem expenses equal to the current standard maximum rate that is allowed as established by the Federal Travel Regulations (FTR).

Personal Protective Clothing and Equipment:

A) Contractor is responsible for providing all contract personnel with required personal protective equipment.

B) All crewmembers will wear appropriate PPE as outlined in the Interagency Helicopter Operations Guide (IHOG) and Forest Service Health and Safety Code.

Special Safety Requirements:

A) In order to protect life and health and to prevent damage, the Contractor will use due diligence in preventing accidents and will comply with applicable Federal and State laws.

B) No equipment such as radios, survival gear, tools, etc., shall be located in or on the vehicle in such a manner as to potentially cause damage or obstruct the operation of equipment or personnel.

C) All smoking is prohibited within 50 feet of fuel servicing vehicle or fueling equipment. Smoking in or around aircraft is also prohibited.

Pre-Use Inspection of Equipment and Personnel:

A) After award of the contract and any renewal thereof, an inspection of the

Contractor's equipment and personnel will be made. The inspection will take place at a location agreed to by the Contractor and Contracting Officer.

B) The fuel vehicle driver, and fuel servicing vehicle shall be made available for inspection as scheduled by the Contracting Officer.

C) Each Fuel truck operator/driver will be expected to demonstrate an acceptable knowledge of correct fueling procedures, and fueling and safety equipment installed on the fuel servicing vehicle, and must meet all Department of Transportation requirements. Contractor should have equipment and personnel to change the filter on the fuel service vehicle.

D) The following documents shall be made available at the initial yearly pre-use inspection:

Truck/tank inspection documents

Training documents for the fueler, drug testing program

Any other certifications required by the State or Federal Governments

Pre-Use Inspection Expenses:

A) All operating expenses incidental to the inspection shall be borne by the

Contractor.

B) The Contractor will not be charged for the costs incurred by the Government on the initial pre-use inspection.

Re-inspection Expenses:

A) When re-inspection is necessary because Contractor's equipment and/or personnel did not satisfy the initial inspection, re-inspection costs incurred by the Government may be charged to the Contractor.

B) Such costs may include actual costs of transportation, per diem, and overtime of the Government Inspectors. The Contractor shall give advance notice to the Contracting Officer as to the time re-inspection is desired.

Inspections During Use:

A) At any time during the contract period, the Contracting Officer may make tests or inspections as deemed necessary to determine that the Contractor's equipment and/or personnel currently meet specifications. Government costs incurred during these inspections will not be charged to the Contractor.

B) If the inspections or tests reveal deficiencies that require correction and subsequent re-inspection, the costs incurred by the Government may be charged to the Contractor in accordance with the Provision above.

C) When the fuel service vehicle becomes unavailable due to mechanical breakdown, the Government reserves the right to inspect the vehicle after the Contractor’s mechanic has approved it for return to service.

Inspection of Substitute Equipment and Personnel:

Inspection costs incurred by the Government when inspecting substitute personnel and/or equipment subsequent to the initial pre-use inspection may be charged to the Contractor in accordance with the Re-inspection Expenses part of the statement of work.

Mandatory Availability Period:

A) As Specified in the Schedule of Items: The fuel truck driver shall be ready to commence operations at 9:00 am, or such time stipulated by the Government on the first day of the Mandatory Availability Period.

B) The Mandatory Availability Period may become effective up to 45 days before the date specified in the schedule of items; or the mandatory availability period may be started up to 45 days later that the date specified in the schedule of items.

C) Pre and Post–Season Use. The Government may, at its option, extend the

Mandatory Availability Period (as specified in the schedule of items) for up to 45 days on a day by day basis. The Contractor is obligated to perform in accordance with the terms and conditions of this contract during this period.

Optional Use Period:

The Government may order service of any or all contract line items, on a day-to-day basis, any time outside the Mandatory Availability and outside of the pre and post-season periods at the contract rate. The contractor has the option to respond during this period.

Daily Availability Requirements:

A) Equipment: Continental United States - The equipment shall be available 9 hours each day as specified by the Contracting Officer. The equipment will not be removed from the Base of Operation without the approval of the Contracting Officer.

B) Personnel. The daily rate identified in the schedule of items shall be based upon a 9-hour day. Personnel will be available on site and ready to respond during the daily availability period. During the mandatory availability period, the daily rate identified in the schedule of items shall be based upon a 9-hour day. In addition to the 9 hour day, personnel may be ordered to perform in one of the following conditions of availability:

Extended Standby. Extended standby for the crew (that period over 9 hours per day, per crew member) will be measured in hours (rounded to the next full hour) and paid at rate specified in the Schedule of Items for all extended standby ORDERED by the Government and performed by the Contractor beyond the hours stipulated in the Schedule of Items when the crew meets the standby requirement in accordance with the Provisions titled Daily Availability Requirements. Extended Standby is not intended to compensate the crew while they are traveling to and from place of lodging.

Return-to-Duty. The Contractor will inform the Contracting Officer as to how appropriate personnel may be contacted. Subject to Flight and Duty Limitations, these persons will be allowed one (1) hour to return to availability status after the contact attempt is made. Failure to return-to-standby status within one hour may result in loss of availability as determined by the Contracting Officer.

C) If not requested to be on return-to-standby status, Contractor's personnel will be considered to be off duty and cannot be required to return to duty status that day.

D) Authorized Breaks. During the standby period, requirements may be modified by the Contracting Officer to allow Contractor’s personnel time off away from the Base of Operation and no deduction will be made for such authorized breaks.

Unavailability:

A) The Contractor will be considered to be unavailable whenever the equipment or personnel are not in condition to perform or fail to perform within the requirements of this contract. It is the contractor’s responsibility to immediately inform the contracting officer of a change in availability status. Unavailability status will continue until the cause of the failure is corrected. It is the Contractor's responsibility to inform the Contracting Officer whenever the equipment or personnel are again available.

B) Unavailability status will be applied to each line item. If the causal effect of one or more items being unavailable results in a condition of non-operational ability as determined by the contracting officer, unavailability may be applied to all contract line items.

C) Inspection by the Government after a performance failure has occurred will be made as promptly as possible after the Contractor has given notice that the failure has been corrected. When inspection reveals that the failure has been corrected, the Contractor will be deemed in "available" status from the time the Contractor gave notice to the Government of the correction of the failure. If consistent failure to respond to dispatch occurs, the Contracting Officer retains the right to require inspections at the Contractor's expense.

D) During periods of unavailability, the Government may obtain replacement services elsewhere and charge the Contractor for any resulting excess costs.

Further, the Contractor may be liable for any additional actual damages to the Government resulting from such failure to perform.

Contract Vehicle Mileage:

Mileage for the contractor service vehicle(s), when dispatched by the Government, will be paid in accordance with the schedule of items, to and from the designated base of operations while supporting the Helicopter.

Travel Expenses:

Travel expenses shall be paid for assignments away from the designated base.

Travel expenses shall include transportation to and from the (temporary) base of operation and per diem expenses equal to the current standard maximum rate that is allowed as established by the Federal Travel Regulations (FTR). The Government retains the option to provide meals and/or lodging when travel is required. A list of localities

Contract Clauses

This is a Combined Synopsis/Solicitation, issued as a commercial item procurement under FAR part 12.6. FAR 52.212-1, 52.212-2, 52.212-3, 52.212-4 and 52.212-5 apply.

Prior to award, the successful contractor must be registered in both: Central Contractor Registration: http://www.ccr.gov and ORCA: http://www.orca.bpn.gov.

Loss, Damage, or Destruction

(a) For equipment furnished under this agreement without operator, the

Government will assume liability for any loss, damage or destruction of such equipment, except that no reimbursement will made for loss, damage or destruction due to (1) ordinary wear or tear, (2) mechanical failure, or (3) the fault or negligence of the Contractor or the Contractor’s agents or employees or Government employee owned and operated equipment.

(b) For equipment furnished under this agreement with operator, the Government shall not be liable for any loss, damage or destruction of such equipment, except for loss, damage or destruction resulting from negligence, or wrongful act(s) of Government employee(s) while acting within the scope of their employment. The operator is responsible for operating the equipment within its operating limits and responsible for safety of the equipment.

(a) The Contractor assumes responsibility for all damage or injury to persons or property occasioned through the use, maintenance, and operation of the Contractor’s vehicles or other equipment by, or the action of, the Contractor or the Contractor’s employees and agents.

(b) The Contractor, at the Contractor’s expense, shall maintain adequate public liability and property damage insurance during the continuance of this contract, insuring the Contractor against all claims for injury or damage.

(c) The Contractor shall maintain Worker’s Compensation and other legally required insurance with respect to the Contractor’s own employees and agents.

(d) The Government shall in no event be liable or responsible for damage or injury to any person or property occasioned through the use, maintenance, or operation of any vehicle or other equipment by, or the action of, the Contractor or the Contractor’s employees and agents in performing under this contract, and the Government shall be indemnified and saved harmless against claims for damage or injury in such cases.

Firearm-Weapon Prohibition

The possession of firearms or other dangerous weapons (18 USC 930 (f)(2)) are prohibited at all times while on Government Property and during performance of services, under this contract. The term dangerous weapon does not include a pocket knife with a blade less than 2 ½ inches in length or a multi-purpose tool such as a Leatherman.
