· Construct a new 2,530 square foot Visitor Center.

The contractor should refer to the SCHEDULE OF ITEMS and project plans and specifications for estimates of quantities or work.

Project Location

This site is located in Schulman Grove which is an area of the Ancient Bristlecone Pine Forest. This forest is located in the White Mountains, east of Bishop, California. The closest town is Big Pine, California, which is 23 miles away. The road from Big Pine to Schulman Grove is a narrow, winding mountain road. In some areas it is only a single lane road, so caution must be taken.

State of California, County of Inyo, Section 31, Township 6 South, Range 35 East Coordinates are: 37°23.119'North, 118°10.695' West, 10,050 ft elevation From Bishop, California, travel south on highway US-395 for 15 miles, turn left (east) on highway CA-168 and travel east for 13 miles, turn left on White Mountain Road and travel north for 11 miles, turn right into the Schulman Grove Day Use Site.

NOTE: Any prospective bidder desiring an explanation or interpretation of the solicitation, drawings, specifications, etc., must request it in writing soon enough to allow a reply to reach all prospective bidders before submission of their bids. Oral explanations or instructions given before the award of a contract will not be binding. In no event shall failure to inspect the site constitute grounds for a claim after contract award. (See Section L, 52.236-27, SITE VISIT.)

Price Range

The Government's estimate is between $1,000,000 and $5,000,000.

Restrictions on Work

The Bristlecone Visitor Center is located at a very popular day use site called Schulman Grove. This site is visited by thousands of visitors each year. Contractor shall insure that public access to the construction area is prohibited. The Contractor may place one office trailer on the project site but it must not impede the operation of the temporary visitor center. The Contractor and the Contractor’s employees will not be permitted to have dogs or other pets on the project site at any time.

Site Conditions Affecting Work

WEATHER

Temperatures are mild in the summer and can reach 70 to 80ºF during the day, with dramatic changes possible. The area experiences a large nocturnal-diurnal fluctuation. Hailstorms and snow can occur any month of the year. The site is also subject to high winds, 70 knots, mostly in a westerly direction. Due to the elevation of the site and the varying winters (especially in terms of snow accumulation), the season of use can vary from year to year. The annual precipitation at the project site is about 11 inches per year, mostly in the form of snow fall.

Access to the project site is closed during the winter months because the road is not maintained. The average winter closure is around mid-November. The average spring opening is around mid-May. These dates are dependent on weather and should not be considered firm dates. There are occasional snow storms of short duration during the fall months. Icy conditions on local roads and highways can occur during the fall and spring.

UTILITIES - WATER

There are no utilities at the project site. There is no water at the site, potable or non-potable. The Contractor is responsible for supplying all water to the site. Arrangements to obtain water are the Contractor’s responsibility. The nearest water source is in the town of Big Pine, California.

UTILITIES – ELECTRICITY/POWER

There is no electricity at the site. The Contractor is responsible for providing generators or other power supplies required for the project. If generators are used, then the Contractor is required to position the generator such that noise levels are minimized. Any fuel required to run generators is the Contractor’s responsibility and shall be contained in approved fuel storage units. Additionally, fuel storage, transportation and transfer shall comply with OSHA requirements.

UTILITIES – TELECOMMUNICATIONS

There is no phone service at the site. Cellular service is not reliable and in most areas not available. The Contractor is responsible for having a Communication Plan which details how communication shall be carried out within the project site, with traffic to and from the project site, with the Contracting Officer’s Representative and during emergencies.

SANATATION

There is a vault toilet on the project site. This is available for the Contractor’s use. If the Contractor chooses to use this facility, then it will be the Contractor’s responsibility to maintain the facility during the performance period. This includes, but is not limited to, keeping it clean and useable, stocking it with toilet paper for use and keeping the hand sanitizer stations full. If the Contractor chooses not to use this facility, then the doors shall be locked and the Contractor will be responsible for providing toilet facilities for workers.

WASTE MANAGEMENT

The Contractor is prohibited from placing waste in any Forest Service or other Government owned trash receptacle. Construction and crew waste is to be collected on site and transferred to the dump on a regular basis. The construction site is to be kept clean of obvious waste and trash at all times. The nearest landfill to the project site is in Bishop. The address is as follows: Bishop-Sunland Landfill, 110 Sunland Road, Bishop, CA 93514. (760) 872-4126

SAFETY, EMERGENCY COMMUNICATIONS AND EVACUATION

Contractor is responsible for the safety of the Contractor’s employees including Subcontractors employees, Government employees associated with the project, and any visitors to the site both Government and private. The project safety plan shall comply with the appropriate California OSHA and Federal OSHA rules and regulations and must include a medical evacuation and emergency communications plan.

HIGHWAY PERMITS

Contractor is responsible for securing any overload or over width limit permits required for the transport of building materials and sections or parts of buildings to the project site. The Contractor is responsible for conducting a thorough reconnaissance of all routes leading to the site. The Government will not be responsible for any building materials or parts or sections of buildings that cannot be transported to the site.

TRAFFIC SAFETY

The Contractor is responsible for traffic safety while hauling materials to and from the site. Due to the nature of the access road, which is a winding, narrow mountain road, large vehicles and trailers should exercise extreme caution when traveling to and from the site. Safety precautions include but are not limited to furnishing traffic control signs and flag persons where necessary.

SECURITY

The Contractor is responsible for the security of the Contractor’s tools and equipment at all times during the project. All trash and loose material shall be secured on each Friday or last working day of the week. All motorized equipment shall be provided with key locks or other device to render them inoperable when the Contractor is not on site. The Contractor shall provide trash receptacles for construction and employee waste. The Contractor shall not use Government trash facilities for waste without permission of the CO. All construction debris remains property of the Contractor and shall be properly disposed of off National Forest Land.

PROTECTION OF RESOURCES

Contractor shall thoroughly clean all equipment prior to delivery to the project site to remove weeds, mud, grease and oil buildup from the tires, wheels, tracks, engines and engine compartments, and other surfaces. Spills of petroleum products and other hazardous substances shall be reported, contained, and removed in accordance with all applicable rules, regulations and laws. Contractor shall submit a project spill response plan at the pre-work meeting for review by the Contracting Officer.

BORROW PIT

There is a borrow pit available for the Contractor’s use. The Grandview Pit is located ¼ mile north of the Grandview Campground on the east side of White Mountain Road. The pit is approximately 300 ft long by 150 ft deep. This pit can be used to store materials and equipment. If the Contractor chooses to utilize this pit, then upon completion of the project, the pit must be returned to its original form. Trash and debris may not be stored at this site, unless the Contractor receives permission from the CO. A pre-use and post-use inspection of the borrow pit will be completed by the CO if the Contractor chooses to use the site.

Project Site Clean Up Project site cleanup includes the removal and proper disposal of all construction trash, debris, residue, asphalt, and concrete slag off of National Forest Land. Items such as excess paint and miscellaneous building materials are considered the property of the Contractor and shall be removed from the project site.

All spills of petroleum products including leak spots from parked vehicles shall be removed and properly disposed according to all Local, State, and Federal rules, regulations, and laws governing such disposal.

During the Work the Contractor is required to furnish dumpsters or other trash receptacles and to empty such containers either as they become full or weekly, whichever is more frequent. The Contractor shall not place materials of any kind into private or Government trash bins or dumpsters.

Estimated Start Date

The estimated start work date is 09/20/2010. The contract time will be 180 days. Contract time includes delays for weather; locating and transporting supplies and materials; and final site clean-up. There is an anticipated winter-shut down during this contract. When the access to the site closes, the contract time will be stopped and restarted when access to the site is possible again.

Contractor must begin work within 10 days of the effective date of the Notice to Proceed. See Section F for additional information.

FAR 252.22-39 Notification of Employee Rights Concerning Payment of Union Dues or Fees (DEC 2004)

(a) Definition. As used in this clause-

"United States" means the 50 States, the District of Columbia, Puerto Rico, the Northern Mariana Islands, American Samoa, Guam, the U.S. Virgin Islands, and Wake Island.

(b) Except as provided in paragraph (e) of this clause, during the term of this contract, the Contractor shall post a notice, in the form of a poster, informing employees of their rights concerning union membership and payment of union dues and fees, in conspicuous places in and about all its plants and offices, including all places where notices to employees are customarily posted. The notice shall include the following information (except that the information pertaining to National Labor Relations Board shall not be included in notices posted in the plants or offices of carriers subject to the Railway Labor Act, as amended (45 U.S.C. 151-188)).

Notice to Employees

Under Federal law, employees cannot be required to join a union or maintain membership in a union in order to retain their jobs. Under certain conditions, the law permits a union and an employer to enter into a union-security agreement requiring employees to pay uniform periodic dues and initiation fees. However, employees who are not union members can object to the use of their payments for certain purposes and can only be required to pay their share of union costs relating to collective bargaining, contract administration, and grievance adjustment.

If you do not want to pay that portion of dues or fees used to support activities not related to collective bargaining, contract administration, or grievance adjustment, you are entitled to an appropriate reduction in your payment. If you believe that you have been required to pay dues or fees used in part to support activities not related to collective bargaining, contract administration, or grievance adjustment, you may be entitled to a refund and to an appropriate reduction in future payments.

For further information concerning your rights, you may wish to contact the National Labor Relations Board (NLRB) either at one of its Regional offices or at the following address or toll free number:

(c) The Contractor shall comply with all provisions of Executive Order 13201 of February 17, 2001, and related implementing regulations at 29 CFR part 470, and orders of the Secretary of Labor.

(d) In the event that the Contractor does not comply with any of the requirements set forth in paragraphs (b), (c), or (g), the Secretary may direct that this contract be cancelled, terminated, or suspended in whole or in part, and declare the Contractor ineligible for further Government contracts in accordance with procedures at 29 CFR part 470, Subpart B-Compliance Evaluations, Complaint Investigations and Enforcement Procedures. Such other sanctions or remedies may be imposed as are provided by 29 CFR part 470, which implements Executive Order 13201, or as are otherwise provided by law.

(e) The requirement to post the employee notice in paragraph (b) does not apply to-

(1) Contractors and subcontractors that employ fewer than 15 persons;

(2) Contractor establishments or construction work sites where no union has been formally recognized by the Contractor or certified as the exclusive bargaining representative of the Contractor's employees;

(3) Contractor establishments or construction work sites located in a jurisdiction named in the definition of the United States in which the law of that jurisdiction forbids enforcement of union-security agreements;

(4) Contractor facilities where upon the written request of the Contractor, the Department of Labor Deputy Assistant Secretary for Labor-Management Programs has waived the posting requirements with respect to any of the Contractor's facilities if the Deputy Assistant Secretary finds that the Contractor has demonstrated that-

(i) The facility is in all respects separate and distinct from activities of the Contractor related to the performance of a contract; and

(ii) Such a waiver will not interfere with or impede the effectuation of the Executive order; or

(5) Work outside the United States that does not involve the recruitment or employment of workers within the United States.

(f) The Department of Labor publishes the official employee notice in two variations; one for contractors covered by the Railway Labor Act and a second for all other contractors. The Contractor shall-

(1) Obtain the required employee notice poster from the Division of Interpretations and Standards, Office of Labor-Management Standards, U.S. Department of Labor, 200 Constitution Avenue, NW, Room N-5605, Washington, DC 20210, or from any field office of the Department's Office of Labor-Management Standards or Office of Federal Contract Compliance Programs;

(2) Download a copy of the poster from the Office of Labor-Management Standards website at http://www.olms.dol.gov; or

(3) Reproduce and use exact duplicate copies of the Department of Labor's official poster.

(g) The Contractor shall include the substance of this clause in every subcontract or purchase order that exceeds the simplified acquisition threshold, entered into in connection with this contract, unless exempted by the Department of Labor Deputy Assistant Secretary for Labor-Management Programs on account of special circumstances in the national interest under authority of 29 CFR 470.3(c). For indefinite quantity subcontracts, the Contractor shall include the substance of this clause if the value of orders in any calendar year of the subcontract is expected to exceed the simplified acquisition threshold. Pursuant to 29 CFR part 470, Subpart B-Compliance Evaluations, Complaint Investigations and Enforcement Procedures, the Secretary of Labor may direct the Contractor to take such action in the enforcement of these regulations, including the imposition of sanctions for noncompliance with respect to any such subcontract or purchase order. If the Contractor becomes involved in litigation with a subcontractor or vendor, or is threatened with such involvement, as a result of such direction, the Contractor may request the United States, through the Secretary of Labor, to enter into such litigation to protect the interests of the United States.

FAR 52.225-9 Buy American Act—Construction Materials (JAN 2005)

(a) Definitions. As used in this clause- "Component" means an article, material, or supply incorporated directly into a construction material.

"Construction material" means an article, material, or supply brought to the construction site by the Contractor or a subcontractor for incorporation into the building or work. The term also includes an item brought to the site preassembled from articles, materials, or supplies. However, emergency life safety systems, such as emergency lighting, fire alarm, and audio evacuation systems, that are discrete systems incorporated into a public building or work and that are produced as complete systems, are evaluated as a single and distinct construction material regardless of when or how the individual parts or components of those systems are delivered to the construction site. Materials purchased directly by the Government are supplies, not construction material.

"Cost of components" means-

(1) For components purchased by the Contractor, the acquisition cost, including transportation costs to the place of incorporation into the construction material (whether or not such costs are paid to a domestic firm), and any applicable duty (whether or not a duty-free entry certificate is issued); or

(2) For components manufactured by the Contractor, all costs associated with the manufacture of the component, including transportation costs as described in paragraph (1) of this definition, plus allocable overhead costs, but excluding profit. Cost of components does not include any costs associated with the manufacture of the construction material.

"Domestic construction material" means-

(1) An unmanufactured construction material mined or produced in the United States; or

(2) A construction material manufactured in the United States, if the cost of its components mined, produced, or manufactured in the United States exceeds 50 percent of the cost of all its components. Components of foreign origin of the same class or kind for which nonavailability determinations have been made are treated as domestic.

"Foreign construction material" means a construction material other than a domestic construction material.

"United States" means the 50 States, the District of Columbia, and outlying areas.

(b) Domestic preference.

(1) This clause implements the Buy American Act (41 U.S.C. 10a - 10d) by providing a preference for domestic construction material. The Contractor shall use only domestic construction material in performing this contract, except as provided in paragraphs (b)(2) and (b)(3) of this clause.

(2) This requirement does not apply to the construction material or components listed by the Government as follows:

__NONE______________________________________

[Contracting Officer to list applicable excepted materials or indicate "none"]

(3) The Contracting Officer may add other foreign construction material to the list in paragraph (b)(2) of this clause if the Government determines that-

(i) The cost of domestic construction material would be unreasonable. The cost of a particular domestic construction material subject to the requirements of the Buy American Act is unreasonable when the cost of such material exceeds the cost of foreign material by more than 6 percent;

(ii) The application of the restriction of the Buy American Act to a particular construction material would be impracticable or inconsistent with the public interest; or

(iii) The construction material is not mined, produced, or manufactured in the United States in sufficient and reasonably available commercial quantities of a satisfactory quality.

(c) Request for determination of inapplicability of the Buy American Act.

(1)(i) Any Contractor request to use foreign construction material in accordance with paragraph (b)(3) of this clause shall include adequate information for Government evaluation of the request, including-

(A) A description of the foreign and domestic construction materials;

(B) Unit of measure;

(C) Quantity;

(D) Price;

(E) Time of delivery or availability;

(F) Location of the construction project;

(G) Name and address of the proposed supplier; and

(H) A detailed justification of the reason for use of foreign construction materials cited in accordance with paragraph (b)(3) of this clause.

(ii) A request based on unreasonable cost shall include a reasonable survey of the market and a completed price comparison table in the format in paragraph (d) of this clause.

(iii) The price of construction material shall include all delivery costs to the construction site and any applicable duty (whether or not a duty-free certificate may be issued).

(iv) Any Contractor request for a determination submitted after contract award shall explain why the Contractor could not reasonably foresee the need for such determination and could not have requested the determination before contract award. If the Contractor does not submit a satisfactory explanation, the Contracting Officer need not make a determination.

(2) If the Government determines after contract award that an exception to the Buy American Act applies and the Contracting Officer and the Contractor negotiate adequate consideration, the Contracting Officer will modify the contract to allow use of the foreign construction material. However, when the basis for the exception is the unreasonable price of a domestic construction material, adequate consideration is not less than the differential established in paragraph (b)(3)(i) of this clause.

(3) Unless the Government determines that an exception to the Buy American Act applies, use of foreign construction material is noncompliant with the Buy American Act.

(d) Data. To permit evaluation of requests under paragraph (c) of this clause based on unreasonable cost, the Contractor shall include the following information and any applicable supporting data based on the survey of suppliers:

FAR 52.228-1 Bid Guarantee (SEP 1996) (Applicable over $100,000)

(a) Failure to furnish a bid guarantee in the proper form and amount, by the time set for opening of bids, may be cause for rejection of the bid.

(b) The bidder shall furnish a bid guarantee in the form of a firm commitment, e.g., bid bond supported by good and sufficient surety or sureties acceptable to the Government, postal money order, certified check, cashier's check, irrevocable letter of credit, or, under Treasury Department regulations, certain bonds or notes of the United States. The Contracting Officer will return bid guarantees, other than bid bonds –

(1) To unsuccessful bidders as soon as practicable after the opening of bids, and (2) To the successful bidder upon execution of contractual documents and bonds (including any necessary coinsurance or reinsurance agreements), as required by the bid as accepted.

(c) The amount of the bid guarantee shall be 20 percent of the bid price or $3 Million, whichever is less.

(d) If the successful bidder, upon acceptance of its bid by the Government within the period specified for acceptance, fails to execute all contractual documents or furnish executed bond(s) within 20 days after receipt of the forms by the bidder, the Contracting Officer may terminate the contract for default.

(e) In the event the contract is terminated for default, the bidder is liable for any cost of acquiring the work that exceeds the amount of its bid, and the bid guarantee is available to offset the difference.

FAR 52.228-13 Alternative Payment Protections (JUL 2000) (Applicable to Contracts>$30,000 but < $100,000)

(a) The Contractor shall submit one of the following payment protections

(1) Irrevocable letter of credit

(2) Payment bond

(3) Certificates of deposit

(4) Certified or cashier’s checks, bank drafts, money orders, or currency

(b) The amount of the payment protection shall be 100 percent of the contract price.

(c) The submission of the payment protection is required within 10 days of contract award.

(d) The payment protection shall provide protection for the full contract performance period plus a one-year period.

(e) Except for escrow agreements and payment bonds, which provide their own protection procedures, the Contracting Officer is authorized to access funds under the payment protection when it has been alleged in writing by a supplier of labor or material that a nonpayment has occurred, and to withhold such funds pending resolution by administrative or judicial…
