A. SCOPE OF CONTRACT. This contract requires spot application of listed herbicides for control of specified noxious weeds and related work, in compliance with its terms, specifications and provisions. The contractor shall furnish all supervision, personnel, personal protection equipment, transportation, equipment, chemicals, seed, operating supplies, and all elements required to perform the work except those listed as Government-furnished property. Application methods shall be spot application using ground based equipment and may include backpacks/ATV’s and/or full sized vehicles.
B. LOCATION AND DESCRIPTION. The work is located on the North Fork and Pierce Ranger Districts of the
Clearwater National Forest. Locations of specific treatment areas, size of treatment areas, maps, and other pertinent information will be provided with the task orders. The roads scheduled for spray treatment are on maintained and unmaintained system roads. Road conditions may vary from paved surface, two-lanes wide to single lane native surface with brush growing over road. Some roads may not be drivable with full sized vehicles or ATV’s. At times vehicle access may be limited or restricted to protect resources. The areas for spraying may include landings, dispersed sites, campgrounds, administrative sites, rock pits, stock piles, and vegetative units.
C. DEFINITIONS OF TECHNICAL SPECIFICATIONS AND TERMS
Aquatic Buffer Area. An area within 15 feet of standing or running water within which no application of herbicides, other than aquatically approved types, is permitted.
Ground Based. Spray equipment mounted on terrestrial vehicles or carried by animals or people, and equipped with one or more nozzles mounted on booms, spray heads or wands to apply herbicides uniformly and consistently as per label and contractual requirements to targeted weeds within acceptable application areas.
Clearwater National Forest AG-82B1-S-10-0214

Examples of ground based equipment would include pick-ups or trucks with spray booms with multiple nozzles or solid stream oscillating spray head type equipment with multiple nozzles, ATV’s with spray booms with multiple nozzles, backpack sprayers with spray booms with multiple nozzles or wands with a single nozzle, and/or horse mounted sprayers with spray booms with multiple nozzles or wands with a single nozzle.
Spot Application. The focused application of herbicide sprays to localized or restricted areas that contain populations of targeted weeds as differentiated from overall broadcast or complete coverage application regardless of weed occurrence. If an area exhibits a continuous occurrence of targeted weeds, that area would be considered a spot or multiple adjacent spots requiring treatment to the extent of the infestations or populations.
Spray Mile: Mile of one side, one pass of a specified road to drive and spray as needed.
GOVERNMENT-FURNISHED PROPERTY
Personal Data Recorders (PDRs) and herbicide application documentation forms will be provided to the Contractor.
A sample form is provided in the Attachments. The Government will also provide the watershed boundary information for reporting purposes and the State of Idaho noxious weed booklet.
D. TECHNICAL SPECIFICATIONS
(a) GENERAL REQUIREMENTS
1. Where possible, the Contractor shall apply one of the approved herbicides listed in Table 1, prescribed in the task order or agreed to by the Contracting Officer’s Representative (COR) and at the rates specified on the herbicide label, using spot application technique to all target weeds. For road spraying, the spray treatment shall cover noxious weeds that occur from the toe of the fill to the top of the cut, the running surface, turnouts, and existing landings including up to a maximum of 50 feet slope distance from the road centerline on both sides.
Areas requiring spot herbicide treatment will vary from small patches to long strips to large areas. Areas may include spraying decompacted landings and stock piles where few or no weeds are present but possible seed sources exist.
2. Required spot herbicide applications shall only be permitted where target weeds or shrubs are present, using only spot applications with ground based application equipment and not within aquatic buffer areas as described in Table 2.
3. Required spot herbicide applications shall comply with respective herbicide labels and applicable
Federal and State regulations.
4. The Contractor shall comply with all applicable OSHA, EPA, manufacturer’s directions, Idaho State and Federal requirements for handling herbicides including storage, transportation, application, container disposal and cleanup of spills.

Seed analysis labels attached to the bags shall be provided to the Forest Service. No other seed shall be used without prior consent from the Contracting Officer Representative.
E. CONTRACTOR QUALITY CONTROL
The Contractor is responsible for the quality of work and is expected to conduct their own prompt inspections to ensure the technical specifications are being met. Government inspections are for payment determination only, and are not intended to be used as a quality control by the
Contractor. Any delay in Government inspections will not cause the Government to be responsible for the Contractors’ quality.
F. GOVERNMENT QUALITY ASSURANCE SURVEILLANCE PLAN
(a) Inspection. The Government’s quality assurance inspections will determine compliance with specifications and provide the basis for computing the rate of payment. The Government will make periodic visual inspections of each subitem to determine adherence to specifications. Visual inspections can occur anytime during the performance of the work.
Spraying of areas where few or no weeds are present but possible seed sources exist and the seeding will be evaluated on visual inspection of the work for compliance with specifications.
If the visual inspection of sprayed areas where weeds are present indicates unsatisfactory work, then a representative sample of plots will be taken to determine the quality of the work performed. Each contract subitem will be inspected separately and inspection results will not be averaged with those of other contract subitems.
Clearwater National Forest AG-82B1-S-10-0214
Noxious Weed Spraying Page 14 of 50
(b) Procedures. Inspections will consist of visual observations and/or sample plots to determine compliance with the specifications. The inspections will be located throughout the sprayed areas to obtain a representative sample of the work. Individual target plants will be examined to determine whether the plant was sprayed according to specifications. The wilting, curling, discoloration or killing of target plants shall be used as a measure of application effectiveness. At approved application rates, the effect of herbicides on the target plants should be visible within three to five days following application (when applied during the plant’s vigorous growing period). The Forest
Service will allow sufficient time for herbicide effects to show on target plants before conducting inspections for contract performance and compliance.
An inspection summary for each subitem will be recorded as follows:
1. Number of target plants that should have been sprayed.
2. Number of target plants satisfactorily sprayed.
Spraying quality for each subitem will be calculated as follows:
number of satisfactorily sprayed target plants X 100 = spraying quality percent number of target plants that should have been sprayed
(c) Rework and Reinspection After Rework. When inspection results are below 90 percent, payment will not be made until the spraying deficiencies have been corrected. Reinspections after rework will be made in the same manner as the first inspections but on different plots. The contractor shall pay for inspections necessitated by the rework.
Noncompliance with treatment specifications or any other contract requirements will classify the treatment as unacceptable and rework will be required to bring the treatment into compliance.
If an area has been documented as weed free at the time of inspection by the Contractor, but subsequent inspection by the Forest Service discovers that weeds were present on the site, the
Contractor will be required to return to the site to treat these infestations.
Application of unauthorized herbicides to riparian buffer areas will constitute noncompliance and will subject the contractor to possible termination for default.
Application of herbicides to non-target species when no target weeds or specified shrubs are present will constitute noncompliance and will subject the Contractor to possible termination for default.
G. DELIVERIES OR PERFORMANCE REQUIREMENTS
Performance Period.
It is estimated that weed spraying and seeding will be required only between May 1 and October 31, with the majority of the spray work occurring in June and July each year. The majority of the seeding work shall occur during the periods May 1 to June 1 or September 1 to October 15 th, unless otherwise approved by the Contracting
Officer’s Representative.
Successful herbicide treatment of targeted noxious weed or shrub populations requires application of appropriate herbicides at the proper growth stage of the targeted weeds or shrubs and within a period of dry weather that shall facilitate maximum effectiveness of the applied chemical. It is therefore imperative that work be performed when the targeted plants are at the proper growth stage and weather conditions are suitable for application and absorption
Clearwater National Forest AG-82B1-S-10-0214
Noxious Weed Spraying Page 15 of 50 of the herbicide(s). The Contractor shall maintain progress at a rate that shall assure completion within the specified period that shall occur during the optimum period of performance outlined above. The minimum acceptable rate of progress shall be calculated by dividing the total units of work awarded by the specified contract time.
The estimated start date and required completion date will be specified in each Task Order. The amount of contract time allowed for each Task Order will equal a minimum of one calendar day for every 20 acres ordered and one calendar day for every 40 spray miles ordered.
Whenever it is determined that the environmental or weather conditions become unsuitable for noxious weed or shrub treatment as per the herbicide label or contract restrictions, the Contractor shall suspend operations.
NOTE: The Government reserves the right to direct the sequence in which work is performed.
H. ORDERING PROCEDURE
Task Orders will be placed with the Contractor by the Government. Order(s) may be placed by mail, facsimile, electronic commerce, or orally with written confirmation.
At a minimum each task order will contain a description of work ordered including a listing of treatment areas, roads, and maps, an estimated quantity of work ordered, the estimated start work date, and the estimated contract time for the task order.
I. MEASUREMENT
The approximate locations to be sprayed will be generally described in the task order listing of road segments and areas and included maps. The actual specific areas to be sprayed will be determined by the presence of specified target noxious weed or shrub species within the specified road segments as well as adjacent limiting riparian buffer areas. The Contractor shall measure the road segments driven and sprayed where needed at the time of treatment.
In addition, the Contractor shall map the spray locations on the PDR. The spray segments as well as the application data shall be kept separate by the specified watershed boundaries.
J. PAYMENT
Payment will be based on:
Per mile treatment: satisfactorily treated spray miles which is defined as miles of one side, one pass of a specified road driven and treated where required. Payment will be based on total road miles.
Per acre treatment: satisfactorily treated acres recorded in the PDR. Payment will be based on total area.
The Contractor shall tally and report for payment the length of road segments and acres specified for treatment as treatment is occurring.
The Contractor shall submit completed data to the Government on the hard copy herbicide application documentation forms and in the PDR for all treated areas.
