Combined Synopsis/Solicitation
Solicitation Number AG-64R4-S-16-0003
Description: Road Blading, Culvert Replacement, Aggregate Placement – Mark Twain National Forest
Specifications are Attachment 2 to this solicitation.
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice.
This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued.
This solicitation is issued as a Request for Proposal. The documents and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-84.
This procurement is set aside for Small Business. The NAICS code is 237310 and the Small Business Size Standard is $36.5M.
Note – The Base Year will begin at award (anticipated 01 March 2016) and run 12 months. Each successive Option Year (if exercised) will be 12 months in duration and begin immediately upon expiration of the previous. (AGAR 452.211-74 Period of Performance)
SCHEDULE: The Bid Schedule is Attachment 1 to this solicitation.
This solicitation shall result in between 1 and 8 Requirements Contracts. Offerors may propose on one, multiple or all 8 locations. The locations are listed on the Schedule. Offerors must propose on EVERY task for each of locations they propose on. Offerors who do not propose on every task for a location will be considered unresponsive and removed from further consideration for that location. Unreasonably high, unrealistically low, unbalanced or incomplete pricing shall eliminate a proposal from competition.
Requirements Contract: The quantities contained on the bid schedule represent the Government’s best estimate of its requirements for the period of contract performance. The Government reserves the right to order quantities in excess of the stated estimated quantities on the Bid Schedule. However, such quantities shall not exceed 150 percent of the total estimated contract dollar amount. It is estimated that the Government’s requirements for any additional quantities for each line item will be in approximately the same proportions that each item currently bears relative to the entire estimate; however, mathematical precision is not required.
The Contractor shall perform work on these quantities at the same bid price. The Contractor’s lack of receipt of quantities shall not create an entitlement to an equitable adjustment from the Government. This is a Requirements Contract (reference FAR 52.2167-21). There is NO GUARANTEED MINIMUM under this contract.
Note Regarding Attachment 3 – Road List – Attachment 3 is a list of roads currently within the boundaries of the Mark Twain Forest. Any of these roads may appear on a task order issued under this contract. Within each of the eight areas, any of these roads may also be substituted in/out for any of the other roads within that area – provided the mileage is not altered. This may be done occasionally as a result of flooding or roads otherwise rendered inaccessible. This substitution does NOT render the contract holder eligible for an increase. This list is subject to periodic revision as necessary to add or remove roads.
Site Visits – Offerors are STRONGLY ENCOURAGED to request and attend site visits and/or visit the roads in a location before proposing on that location due to the variability of the roads involved. Site visits will not be conducted for a location unless at least one interested offeror contacts the Forest Service personnel indicated below to arrange for the site visit to take place. In order to schedule a site visit offeror’s must contact the Forest Service contact listed below NO LATER THAN 4PM CST, 29 December 2015. Site visits will be conducted in early January 2016 – the dates/times will be posted to FedBizOpps.

(b) All delivery orders or task orders are subject to the terms and conditions of this contract. In the event of conflict between a delivery order or task order and this contract, the contract shall control.

(b) Maximum order. The Contractor is not obligated to honor --
(1) Any order for a single item in excess of $150,000;
(2) Any order for a combination of items in excess of $150,000; or

(d) Notwithstanding paragraphs (b) and (c) of this section, the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within 5 calendar days after issuance, with written notice stating the Contractor’s intent not to ship the item (or items) called for and the reasons. Upon receiving this notice, the Government may acquire the supplies or services from another source.
(End of Clause)
52.216-21 – Requirements (Oct 1995)
(a) This is a requirements contract for the supplies or services specified, and effective for the period stated, in the Schedule. The quantities of supplies or services specified in the Schedule are estimates only and are not purchased by this contract. Except as this contract may otherwise provide, if the Government’s requirements do not result in orders in the quantities described as “estimated’’ or “maximum” in the Schedule, that fact shall not constitute the basis for an equitable price adjustment.
(b) Delivery or performance shall be made only as authorized by orders issued in accordance with the Ordering clause. Subject to any limitations in the Order Limitations clause or elsewhere in this contract, the Contractor shall furnish to the Government all supplies or services specified in the Schedule and called for by orders issued in accordance with the Ordering clause. The Government may issue orders requiring delivery to multiple destinations or performance at multiple locations.
(c) Except as this contract otherwise provides, the Government shall order from the Contractor all the supplies or services specified in the Schedule that are required to be purchased by the Government activity or activities specified in the Schedule.
(d) The Government is not required to purchase from the Contractor requirements in excess of any limit on total orders under this contract.
(e) If the Government urgently requires delivery of any quantity of an item before the earliest date that delivery may be specified under this contract, and if the Contractor will not accept an order providing for the accelerated delivery, the Government may acquire the urgently required goods or services from another source.
(f) Any order issued during the effective period of this contract and not completed within that period shall be completed by the Contractor within the time specified in the order. The contract shall govern the Contractor’s and Government’s rights and obligations with respect to that order to the same extent as if the order were completed during the contract’s effective period;
provided, that the Contractor shall not be required to make any deliveries under this contract after expiration of the contract and completion of any open task orders.
(End of Clause)
52.217-8 – Option to Extend Services (Nov 1999)
The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. (b) If the Government exercises this option, the extended contract shall be considered to include this option clause.
(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 66 months.
(End of Clause)

(a) Workers Compensation and Employer's Liability. The Contractor is required to comply with applicable Federal and State workers' compensation and occupational disease statutes. If occupational diseases are not compensable under those statutes, they shall be covered under the employer's liability section of the insurance policy, except when contract operations are so commingled with a Contractor's commercial operations that it would not be practical to require this coverage. Employer's liability coverage of at least $100,000 shall be required, except in States with exclusive or monopolistic funds that do not permit worker's compensation to be written by private carriers.

In any area where the worker is exposed to the potential for flying or falling objects, the contractor shall provide a hard hat, at no cost to the employee, and the contractor shall assure that the employee wears the hard hat. The hard hat must meet the minimum requirements of American National Standards Institute (ANSI) standard Z89.1-1997.
