1.9 MINIMUM QUALIFICATION FACTORS
1.9.1 Evaluation Overview (see 52.212‐2 Evaluation of Commercial Items) In this acquisition, the Government will obtain best value by using the best value source selection approach defined at FAR 15.101‐1; i.e., an approach which permits tradeoffs among cost or price and non‐cost factors and allows the Government to accept other than the lowest priced proposal.
The Government will award from this solicitation to the most qualified, responsible offeror whose offer best conforms to the solicitation specifications, and is most advantageous to the government. To arrive at an award decision, the contracting officer will evaluate offerors submission of prior relevant experience, past performance and price.
Submittal evaluation will occur in accordance with FAR 13.106‐2.
1.9.2 Evaluation Factors
Offerors will be evaluated on the following criteria:
A. Prior Experience The government will evaluate the quality and extent of the offeror’s experience on projects of a similar size and scope to this solicitation. The purpose of the prior experience evaluation is to allow the government to assess the offeror’s ability to perform the effort described in this solicitation, based on the offeror’s demonstrated experience. After evaluating an offeror’s prior experience, the offeror will be assigned one of the following ratings:
PERFORMANCE CONFIDENCE ASSESSMENTS
Rating Description
SUBSTANTIAL
CONFIDENCE
Based on the offeror’s prior experience, the government has a high expectation that the offeror will successfully perform the required effort.
SATISFACTORY
CONFIDENCE
Based on the offeror’s prior experience, the government has an expectation that the offeror will successfully perform the required effort.
LIMITED CONFIDENCE Based on the offeror’s prior experience, the government has a low expectation that the offeror will successfully perform the required effort.
NO
CONFIDENCE
Based on the offeror’s prior experience, the government has no expectation that the offeror will be able to successfully perform the required effort.
UNKNOWN
CONFIDENCE
No prior experience is identifiable or the offeror’s prior experience is so sparse that no confidence assessment rating can be reasonably assigned.
Offerors with no relevant prior experience or the offeror’s prior experience is so limited that no confidence rating can be reasonably assigned shall receive the rating “Unknown Confidence”, meaning the rating is treated neither favorably nor unfavorably.
B. Past Performance Past performance is a measure of the degree to which an offeror has satisfied customers in the past, and complied with federal, state, and local laws and regulations. The offeror's submission of relevant past performance information must convey to the government that the offeror is capable, possesses technical expertise and experience, possesses sufficient resources, and is able to plan, organize, and use those resources to deliver timely and quality demolition services. Offeror’s with no past performance information will be given a neutral rating.
C. Price After an initial compliance review, offerors will be ranked according to the most favorable proposed price for the project, with the low offeror ranked first.
Unrealistically low or high prices may be grounds for eliminating a proposal from consideration.
Prior Experience and Past Performance when combined are approximately equal to Price.
1.9.3 Additional Evaluation Details
If the lowest priced evaluated offer is judged to have a Substantial Confidence performance assessment, that offer represents the best value for the government and the evaluation process stops at this point. Award of the contract shall be made to that offeror.
The Government reserves the right to award a contract to other than the lowest priced offeror, if that offeror does not have a performance confidence assessment of “Substantial Confidence”. In that event, the Contracting Officer will make a best value award decision.
Offerors are encouraged to submit sufficient information to allow the Contracting Officer to develop a performance confidence assessment. Offeror’s may be asked to clarify certain aspects of their proposal (e.g., the relevancy of performance information) or respond to adverse performance information to which the offeror has not previously had an opportunity to respond. Communications conducted to resolve minor or clerical errors will not constitute discussions and the Contracting Officer reserves the right to award a contract without the opportunity for proposal revision.
The Government intends to award a contract without discussions. The Government, however, reserves the right to conduct discussions if deemed in its best interest.

52.212‐2 ‐‐ Evaluation ‐‐ Commercial Items. (Jan 1999)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.
The following factors shall be used to evaluate offers:
Prior Experience The government will evaluate the quality and extent of the offeror’s experience on projects of a similar size and scope to this solicitation. The purpose of the prior experience evaluation is to allow the government to assess the offeror’s ability to perform the effort described in this solicitation, based on the offeror’s demonstrated experience. After evaluating an offeror’s prior experience, the offeror will be assigned one of the following ratings:
PERFORMANCE CONFIDENCE ASSESSMENTS
Rating Description
SUBSTANTIAL CONFIDENCE Based on the offeror’s prior experience, the government has a high expectation that the offeror will successfully perform the required effort.
UNKNOWN CONFIDENCE No prior experience is identifiable or the offeror’s prior experience is so sparse that no confidence assessment rating can be reasonably assigned.
Offerors with no relevant prior experience or the offeror’s prior experience is so limited that no confidence rating can be reasonably assigned shall receive the rating “Unknown Confidence”, meaning the rating is treated neither favorably nor unfavorably.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
