B.2 TASKS
The MNTP has a requirement for a performance based commercial service for Prairie Wide Demolition/Removal of up to ninety-two GROUP 811 BUNKERS in preparation for the restoration of the MNTP. The work includes removal and disposal of structures, structural components and structure contents of the bunkers and obliteration and re-grading of approximately 500 linear feet by 80 foot width of road/rail bed associated with each bunker. (250’ linear feet north and south of the bunker centerline). This work also includes minor restoration/stabilization of the site where structures are removed (i.e., seeding/mulching to mitigate short term soil erosion). Structures include ninety-two storage bunkers (igloo style), rail road grades, railroad ties, road surface, road base, culverts, and miscellaneous debris. Some work will require removal and disposal of hazardous materials that require special handling/disposal. Contractors will be required to dismantle the bunkers, remove and dispose off-site in accordance with requirements and standards established in existing laws, regulations, and industry standards. Contractors shall provide all expertise, labor, supervision, services, equipment, tools, supplies, materials, permits, licenses, transportation, and incidentals necessary to perform the required work
B.3 MINIMUM QUALIFICATIONS
Contractors shall have experience with demolition contracts including the local, state, and federal regulations affecting the work and the disposal of debris from the site.
Contractors shall have a safety plan in place that addresses, at a minimum, the following items.
1. Occupational Noise Exposure.
3. Personnel Protective Equipment.
4. Control of Hazardous Materials.
5. Electrical Safety Related Work Practices.
6. Lead.
7. Respirator Protection.
8. Confined spaces.
9. Equipment Operation
Contractors shall have a good record of safety with no serious violations found during previous OSHA inspections.
B.4 DELIVERABLES
1) Complete demolition of an individual bunker including removal of 500’ of road/railbed,
2) Seeding and mulching of disturbed area after demolition of an individual bunker.
B.5 ACCEPTANCE
Acceptance of the deliverables will be evaluated by the Contracting Officer (CO) or the appointed Contracting Officer Representative (COR) according to the Quality Assurance Surveillance Plan (QASP) contained in the attached Scope of Work.
B.6 EXTENT OF OBLIGATION.
(a) Awarded BPA’s may be terminated upon 30 days written notice by either party.
(b) The Government is obligated only to the extent of authorized calls awarded under the BPA.
(b) Calls against this BPA become binding once the contractor has received a Form OF-347 signed by a warranted CO. (See B.10).
B.7 PURCHASE LIMITATION.
(a) No single BPA call under this agreement shall exceed $300,000 in amount.
(b) Total BPA calls under this multiple award arrangement shall not exceed $5,000,000 over the possible 5 year life of the BPA (one base year and four one year renewal periods).
B.8 PROJECT LOCATION.
Midewin National Tallgrass Prairie, Group 811 Bunker Area, in Will County, IL. See attached map. Access is behind a locked gate. A key shall be provided upon issuance of a BPA call.
B.9 PERIOD OF PERFORMANCE.
(a) This agreement covers a period of one base year that starts at the time of award and four renewal years. BPA’s will be reviewed each year and if renewed, they will be updated to include any newly required clauses, regulations, and wage determinations. Contractors will be given an opportunity prior to renewal to update their ceiling prices.
(b) Each BPA call will include a period of performance based on the number of bunkers to be demolished. It is estimated to take 2-3 weeks to demolish one bunker.
B.10 INDIVIDUALS AUTHORIZED TO PURCHASE UNDER THE BPA.
(a) The following personnel are authorized to issue calls under this BPA:
Any warranted CO within the Forest Service.
(b) The CO is the only individual authorized to make changes to the calls once issued. Therefore, unless changes are approved in advance by the CO, the Contractor assumes all risks involved in any changes made.
B.11 ORDERING
(a) The Government expects to have between three and five BPA’s awarded as a result of this solicitation in order to provide adequate price competition for BPA calls. If at any time during the life of the BPA’s, the number of BPA holders falls below three, competition will be re-solicited.
(a) The Government does not guarantee any calls for service under BPA agreements and the BPA holder (contractor) is not obligated to accept any orders. However, once the contractor accepts a call on Form OF-347 signed by a warranted CO, the contractor is obligated to perform in accordance with the terms and conditions stated herein and the requirements contained in the individual call.
(b) The government will identify the number of bunkers it wishes to have demolished and the period of performance for the work. A request for pricing for the identified work will be sent by email to all BPA holders. This request will include a due date for price quotes which will generally be one week or less. Award will be made to the lowest priced offeror. Poor past performance on previous BPA calls will render a firm ineligible for future calls.
(c) BPA holders will be responsible for monitoring email for correspondence regarding requests for pricing.
(d) Each request for pricing issued by the government shall include the following information:
(1) Required Period of Performance
(2) Schedule of Items for pricing the work
(3) Terms/ Conditions specific to the Call
(4) Service Contract Act wage determination applicable to the Call
(5) Government point of contact
(6) Due date for the price quote
(e) It is expected that each call will be competed for price amongst all BPA holders. However, exceptions to the fair opportunity process as shown in FAR 16.505(b)(2) are incorporated into this BPA. If a Fair Opportunity Exception applies, the request for pricing will be issued to one contractor.
(f) If the first BPA call for each year is issued prior to September 30, it will be placed with the lowest priced technically acceptable offeror from the solicitation (or BPA renewal) at the price in their initial quote rather than being competed amongst the offerors. This is due to the short time period between the solicitation and call award.
B. 12 FIRM-FIXED PRICING
All calls issued will be on a firm fixed price basis. Payment shall not exceed that amount unless a change order is approved in advance and a formal written modification is signed by the CO.
B. 13 CONTRACTOR PERFORMANCE EVALUATIONS
(a) This BPA is subject to Federal Acquisition Regulations (FAR) that require past performance evaluations to be completed and entered into the Contractor Performance Assessment Reporting System (CPARS).
(b) Upon award of a BPA call greater than $150,000, the name and email address of the Contractor Representative responsible for reviewing the CPARS evaluations will be required.
(c) Upon completion of the work associated with the call, an evaluation will be initiated by the CO in the CPARS system and the Contractor Representative will receive an auto-email from CPARS with instructions to review and respond to the evaluation.
(d) Poor past performance on a BPA Call will result in termination of the BPA.
B.14 SUSTAINABLE ACQUISITION
The Contractor shall comply with FAR Part 23 Sustainable Acquisition Policy and all associated laws, rules, regulations, and executive orders referenced therein. Contracts that include the supply of products and those for the acquisition of services that include the supply of products, require that the products provided are—

(6) Made with recovered materials (EPA-Designated products) (applicable if FAR clause 52.223-9 or 17 is included).
B.15 PAYMENT

Payment shall not be made for less than one full deliverable. For example, if the call is for five bunkers, contractors may submit a partial invoice upon completion and acceptance of one bunker.
