52.212-1 Instructions to Offerors—Commercial Items. (Apr 2014) 52.212-2 Evaluation—Commercial Items.
As prescribed in 12.301(c), the Contracting Officer may insert a provision substantially as follows:
Evaluation—Commercial Items (Oct 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
____Price Reasonableness________________________ ____Technical Capability_________________________
Price reasonableness rates higher than technical capability. Experience and past performance are subsections of technical capability.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
ADDENDA to 52.212-2 EVALUATION – COMMERCIAL ITEMS (OCT 2014)
(a) BASIS FOR CONTRACT AWARD: The basis for award will be an integrated assessment based on tradeoff between price reasonableness and technical capability. The Government will award the contract to the offeror who represents the best value to the Government.
1. PRICE:
(1) Completeness: The proposal covers all requirements of the specifications (Attachment 1), includes all pricing information required by the solicitation and the Schedule of items is completed as required. Offeror must provide pricing for all items listed on the schedule of items.
(2) Reasonableness: Prices are reasonable in comparison to estimates, prior prices paid, competition, historical and projected inflation and can be supported by suitable estimating techniques.
(3) Realism: The government may determine that a proposal is unacceptable if the prices proposed are materially unbalanced between the line items or subline items. Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more contract line items is significantly overstated or understated, as indicated by the application of cost or price analysis techniques. (For instance, the price variance between gas tiers is not realistic considering the price increase in gas for the task/item indicated or there is an inconsistent application of inflation rates and price increases between fuel tiers/line items for any base and option year and/or between a base and option year.) The burden of proof of realism rests solely with the offeror. A proposal may be rejected if the Contracting Officer determines that the lack of balance poses an unacceptable risk to the government.
(4) Contract Award Amount: The estimated quantities are shown for evaluation purposes only. The estimated quantities are a good faith estimate on the part of the Government.
2. TECHNICAL CAPABILITY AND PAST PERFORMANCE: Technical capability and past performance assessments shall be accomplished for all proposals. Each offeror shall be assigned one of the following ratings:
RATING
DEFINITION
Exceptional/High Confidence
Based on the offeror’s performance record, essentially no doubt exists that the offeror will successfully perform the required effort.
Very Good/Significant Confidence
Based on the offeror’s performance record, little doubt exists that the offeror will successfully perform the required effort.
Satisfactory/Confidence
Based on the offeror’s performance record, some doubt exists that the offeror will successfully perform the required effort.
Neutral/Unknown Confidence
No performance record identifiable (see FAR 15.305(a)(2) (iii) and (iv)).
Marginal/Little Confidence
Based on the offeror’s performance record, substantial doubt exists that the offeror will successfully perform the required effort. Changes to the offeror’s existing processes may be necessary in order to achieve contract requirements.
Unsatisfactory/No Confidence
Based on the offeror’s performance record, extreme doubt exists that the offeror will successfully perform the required effort.
(1) A number of past performance references provided by offerors will be selected and investigated. Any derogatory past performance information obtained will be presented to the affected offeror and that offeror will have an opportunity to respond with any mitigating facts. The final determination of past performance ratings shall rest with the contracting officer.
(2) An offeror with limited or no recent or relevant past performance will receive a rating of Neutral/Unknown Confidence, and will not be rated favorably or unfavorably on past performance.
(3) Technical capability and past performance must be relative to the work to be performed in this contract. Sustainable acquisition will be evaluated according to the certifications submitted. No certification will equate to a neutral evaluation.
3. Price reasonableness rates higher than technical capability.
4. The Government reserves the right to award the contract to other than the lowest priced offeror.
5. AWARD WITHOUT DISCUSSIONS. The Contracting Officer will only clarify the offerors’ information; no discussions are contemplated in accordance with FAR 15.306. Offerors may be given the opportunity to clarify relevance or adverse past performance to which the offeror has not previously had an opportunity to respond. Clarifications are limited exchanges between the Government and offerors that may occur when award without discussions is contemplated. If discussions are determined to be necessary the procedures described in FAR 15.306 will be used.
(End of provision) 52.212-3 Offeror Representations and Certifications—Commercial Items.
As prescribed in 12.301(b)(2), insert the following provision:
