PART I – SECTION A – SOLICITATION/CONTRACT FORM
This Request for Proposals is a solicitation for an Indefinite Delivery, Indefinite Quantity (IDIQ) Performance Based Service Contract for all aspects of professional cultural resources services for a wide variety of activities on the Francis Marion and Sumter National Forest lands in South Carolina. The primary tasks will be archeological survey and site evaluation of firelines constructed for prescribed burning and wildfire supression. However, tasks will not be limited to archeological survey and evaluation. Additional tasks may include historic buildings inventory and evaluation, artifact analysis, collections management, cultural resource recording, site monitoring, archeological site relocation and marking, preparation of National Register of Historic Places nominations, prehistoric and historic synthesis, historical research, cultural resources overviews, cultural resource management plans, historic preservation plans, archaeological and historical interpretation, or other cultural resource planning documents, report preparation, and documents written for the lay audience.
The Government anticipates multiple awards for the Sumter National Forest (Piedmont) and For the Francis-Marion National Forest (coastal) in South Carolina. The Sumter National Forest covers the Long Cane Ranger District (Edgefield,SC), Enoree Ranger District (Whitmire,SC) and The Andrew Pickens Ranger District (Mountain Rest, SC). The Francis-Marion National Forest is located in Huger,SC. See Attachment 1 for a map of South Carolina Contractors will identify is Section B if they wish to be considered for an IDIQ for the Sumter National Forest, the Francis-Marion National Forest, or Both.
There are two line items in this solicitation; Line Item 001 is for the Francis Marion National Forest, Line item 002 is for the Sumter National Forest. Contractors may submit a price and technical proposal on one or both line items
Of the successful Offerors selected for award one will also be awarded Line Item 001 and one will be awarded line item 002 as the first Task Orders All successful offerors will receive a guaranteed minimum of $ 2,000.00 over the life of the contract. The maximum to be awarded under the resulting contracts is $500,000.00.

52.204-7 Central Contractor Registration (OCT 2003)
(a) Definitions. As used in this clause-
"Central Contractor Registration (CCR) database" means the primary Government repository for Contractor information required for the conduct of business with the Government.
"Data Universal Numbering System (DUNS) number" means the 9-digit number assigned by Dun and Bradstreet, Inc. (D&B) to identify unique business entities.
"Data Universal Numbering System +4 (DUNS+4) number" means the DUNS number assigned by D&B plus a 4-character suffix that may be assigned by a business concern. (D&B has no affiliation with this 4-character suffix.) This 4-character suffix may be assigned at the discretion of the business concern to establish additional CCR records for identifying alternative Electronic Funds Transfer (EFT) accounts (see the FAR at Subpart 32.11) for the same parent concern.
"Registered in the CCR database" means that-
(1) The Contractor has entered all mandatory information, including the DUNS number or the DUNS+4 number, into the CCR database; and
(2) The Government has validated all mandatory data fields and has marked the record "Active".
(b)(1) By submission of an offer, the offeror acknowledges the requirement that a prospective awardee shall be registered in the CCR database prior to award, during performance, and through final payment of any contract, basic agreement, basic ordering agreement, or blanket purchasing agreement resulting from this solicitation.
(2) The offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation "DUNS" or "DUNS +4" followed by the DUNS or DUNS +4 number that identifies the offeror's name and address exactly as stated in the offer. The DUNS number will be used by the Contracting Officer to verify that the offeror is registered in the CCR database.
(c) If the offeror does not have a DUNS number, it should contact Dun and Bradstreet directly to obtain one.
(1) An offeror may obtain a DUNS number-
(i) If located within the United States, by calling Dun and Bradstreet at 1-866-705-5711 or via the Internet at http://www.dnb.com; or
(ii) If located outside the United States, by contacting the local Dun and Bradstreet office.
(2) The offeror should be prepared to provide the following information:
(i) Company legal business.
(ii) Tradestyle, doing business, or other name by which your entity is commonly recognized.
(iii) Company Physical Street Address, City, State, and Zip Code.
(iv) Company Mailing Address, City, State and Zip Code (if separate from physical).
(v) Company Telephone Number.
(vi) Date the company was started.
(vii) Number of employees at your location.
(viii) Chief executive officer/key manager.

(d) If the Offeror does not become registered in the CCR database in the time prescribed by the Contracting Officer, the Contracting Officer will proceed to award to the next otherwise successful registered Offeror.
(e) Processing time, which normally takes 48 hours, should be taken into consideration when registering. Offerors who are not registered should consider applying for registration immediately upon receipt of this solicitation.
(f) The Contractor is responsible for the accuracy and completeness of the data within the CCR database, and for any liability resulting from the Government's reliance on inaccurate or incomplete data. To remain registered in the CCR database after the initial registration, the Contractor is required to review and update on an annual basis from the date of initial registration or subsequent updates its information in the CCR database to ensure it is current, accurate and complete. Updating information in the CCR does not alter the terms and conditions of this contract and is not a substitute for a properly executed contractual document.
(g) (1) (i) If a Contractor has legally changed its business name, "doing business as" name, or division name (whichever is shown on the contract), or has transferred the assets used in performing the contract, but has not completed the necessary requirements regarding novation and change-of-name agreements in Subpart 42.12, the Contractor shall provide the responsible Contracting Officer a minimum of one business day's written notification of its intention to (A) change the name in the CCR database; (B) comply with the requirements of Subpart 42.12 of the FAR; and (C) agree in writing to the timeline and procedures specified by the responsible Contracting Officer. The Contractor must provide with the notification sufficient documentation to support the legally changed name.
(ii) If the Contractor fails to comply with the requirements of paragraph (g)(1)(i) of this clause, or fails to perform the agreement at paragraph (g)(1)(i)(C) of this clause, and, in the absence of a properly executed novation or change-of-name agreement, the CCR information that shows the Contractor to be other than the Contractor indicated in the contract will be considered to be incorrect information within the meaning of the "Suspension of Payment" paragraph of the electronic funds transfer (EFT) clause of this contract.
(2) The Contractor shall not change the name or address for EFT payments or manual payments, as appropriate, in the CCR record to reflect an assignee for the purpose of assignment of claims (see FAR Subpart 32.8, Assignment of Claims). Assignees shall be separately registered in the CCR database. Information provided to the Contractor's CCR record that indicates payments, including those made by EFT, to an ultimate recipient other than that Contractor will be considered to be incorrect information within the meaning of the "Suspension of payment" paragraph of the EFT clause of this contract.

FAR 52.216-18 Ordering (OCT 1995)
(a) Any supplies and services to be furnished under this contract shall be ordered by issuance of delivery orders or task orders by the individuals or activities designated in the Schedule. Such orders may be issued from 1 February 2013 or date of award whichever is later through 31 January 2014. Option I: 1 February 2014 through 31 January 2015. Option II: 1 February 2015 through 31 January 2016.
(b) All delivery orders or task orders are subject to the terms and conditions of this contract. In the event of conflict between a delivery order or task order and this contract, the contract shall control.
(c) If mailed, a delivery order or task order is considered "issued" when the Government deposits the order in the mail. Orders may be issued orally, by facsimile, or by electronic commerce methods only if authorized in the Schedule.
FAR 52.216-19 Order Limitations (OCT 1995)
(a) Minimum order. When the Government requires supplies or services covered by this contract in an amount of less $1000.00 Government is not obligated to purchase, nor is the Contractor obligated to furnish, those supplies or services under the contract.
(b) Maximum order. The Contractor is not obligated to honor—
(1) Any order for a single item in excess of $250,000.00.,
(2) Any order for a combination of items in excess of $500,000.00; or
(3) A series of orders from the same ordering office within 5 days that together call for quantities exceeding the limitation in subparagraph (b)(1) or (2) of this section.
(c) If this is a requirements contract (i.e., includes the Requirements clause at subsection 52.216-21 of the Federal Acquisition Regulation (FAR)), the Government is not required to order a part of any one requirement from the Contractor if that requirement exceeds the maximum-order limitations in paragraph (b) of this section.
(d) Notwithstanding paragraphs (b) and (c) of this section, the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within 5 days after issuance, with written notice stating the Contractor's intent not to ship the item (or items) called for and the reasons. Upon receiving this notice, the Government may acquire the supplies or services from another source.
FAR 52.216-22 Indefinite Quantity (OCT 1995)
(a) This is an indefinite-quantity contract for the supplies or services specified, and effective for the period stated, in the Schedule. The quantities of supplies and services specified in the Schedule are estimates only and are not purchased by this contract.
(b) Delivery or performance shall be made only as authorized by orders issued in accordance with the Ordering clause. The Contractor shall furnish to the Government, when and if ordered, the supplies or services specified in the Schedule up to and including the quantity designated in the Schedule as the "maximum." The Government shall order at least the quantity of supplies or services designated in the Schedule as the "minimum."
(c) Except for any limitations on quantities in the Order Limitations clause or in the Schedule, there is no limit on the number of orders that may be issued. The Government may issue orders requiring delivery to multiple destinations or performance at multiple locations.
(d) Any order issued during the effective period of this contract and not completed within that period shall be completed by the Contractor within the time specified in the order. The contract shall govern the Contractor's and Government's rights and obligations with respect to that order to the same extent as if the order were completed during the contract's effective period; provided, that the Contractor shall not be required to make any deliveries under this contract after 31 May 2014. (Base) Option I – 31 May 2015, Option II – 31 May 2016, FAR 52.217-8 Option to Extend Services (NOV 1999) The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days.
FAR 52.217-9 Option to Extend the Term of the Contract (MAR 2000)
(a) The Government may extend the term of this contract by written notice to the Contractor within 30 days provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension.
(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.
(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 3 years.
AGRICULTURE ACQUISITION REGULATIONS (48 CFR CHAPTER 4) CLAUSES
AGAR 452.211-75 Effective Period of the Contract (FEB 1988) The effective period of this contract is from 1 June 2013 or date of award whichever is later through 31 May 2014. Option I: 1 June 2014 through 31 May 2015. Option II: 1 June 2015 through 31 May 2016.
AGAR 452.215-73 Post Award Conference (NOV 1996) A post award conference with the successful offeror is required. It will be scheduled within 10 days after the date of contract award. Site, date and time to be determined by the Contracting Officer AGAR 452.216-73 Minimum and Maximum Contract Amounts (FEB 1988) During the period specified in FAR clause 52.216-18, ORDERING, the Government shall place orders totaling a minimum of $2,000.00 and the maximum amount to be awarded under this contract is $500,000.00. The minimum amount applies to the entire life of the contract.
452.237-74 Key Personnel. (FEB 1988)
(a) The Contractor shall assign to this contract the following key personnel: Contractor’s Representative , Foreman, Tractor Operator, and Quality Control Person.
(b) During the first ninety (90) days of performance, the Contractor shall make no substitutions of key personnel unless the substitution is necessitated by illness, death, or termination of employment. The Contractor shall notify the Contracting Officer within 15 calendar days after the occurrence of any of these events and provide the information required by paragraph (c) below. After the initial 90-day period, the Contractor shall submit theinformation required by paragraph (c) to the Contracting Officer at least 15 days prior to making any permanent substitutions.
(c) The Contractor shall provide a detailed explanation of the circumstances necessitating the proposed substitutions, complete resumes for the proposed substitutes, and any additional information requested by the Contracting Officer. Proposed substitutes should have comparable qualifications to those of the persons being replaced. The Contracting Officer will notify the Contractor within 15 calendar days after receipt of all required information of the decision on substitutions. The contract will be modified to reflect any approved changes of key personnel.

INTRODUCTION
Cultural Resources Services on the Francis Marion and Sumter National Forests
Scope of Work
Authority. The services performed under this Scope of Work are initiated and influenced by a number of Federal requirements. These requirements include, but are not limited to National Historic Preservation Act of 1966, as amended (NHPA); the National Environmental Policy Act (NEPA); Executive Order 11593 (Protection and Enhancement of the Cultural Environment); the Archeological and Historic Preservation Act of 1974; the Native American Graves Protection and Repatriation Act (NAGPRA); the Archaeological Resources Protection Act Of 1979, as amended (ARPA); and the Memorandum of Understanding (MOU) between the Francis Marion and Sumter National Forests, the Advisory Council on Historic Preservation, and the South Carolina State Historic Preservation Office.
Purpose. To assist the USDA Forest Service in meeting its obligations, including but not limited to Sections 106 and 110 of National Historic Preservation Act (NHPA), Archeological Resources Protection Act (ARPA) and the National Environmental Policy Act (NEPA), to identify, protect and enhance cultural resources located on national forest system lands in South Carolina.
General Requirements. The Contractor shall provide all personnel, supervision, equipment, tools, supplies, materials, transportation, facilities, and incidentals necessary to perform the work specified by individual Task Orders.

Description of Services. The USDA Forest Service, Francis Marion and Sumter National Forests, is in need of professional cultural resource management services for a wide variety of activities on national forest lands in South Carolina. Tasks include, but are not limited to:
archeological survey, evaluation, and excavation artifact analysis and collections management cultural resource recording, cultural resource site monitoring cultural resource site relocation and marking report preparation prehistoric and historic synthesis, historical research, cultural resources overviews cultural resource management plans and historic preservation plans archeological and historical interpretation other cultural resource planning documents preparation of National Register of Historic Places (NRHP) nominations historic buildings inventory, evaluation, and recording documents written for the lay audience
The Contractor shall demonstrate knowledge and use of global positioning systems (GPS) and geographical information systems (GIS) mapping, digital image processing, scanning, digitizing, and other technical competencies.
Personnel
For cultural resource surveys, the Contractor must insure all personnel performing the work meet the following:
Principal Investigator: The minimum professional qualifications for the Principal Investigator are: 1) a graduate degree in anthropology with an archaeology emphasis; 2) demonstrated ability to carry out research to completion as evidenced by timely completion of previous contracts undertaken within the past three years and no current contracts which are past their completion dates; 3) one year of full-time professional experience in archaeological administration, research or management relevant to South Carolina archeology; 4) supervisory field and analytical experience; 5) meet any current requirements of the South Carolina State Historic Preservation Officer (SHPO) for a person functioning as a Principal Investigator;
Field Supervisors/Crew Chiefs: A minimum of a bachelor's degree in anthropology, archaeology, history, or a closely related field with a minimum of six months general archaeological field experience including a field school and one year of previous field archeological supervisory experience conducting similar work;
Field or Laboratory Crew: Completion of or satisfactory progress toward a bachelor’s degree in anthropology, archeology, history or a closely related field, or six months previous experience in archeological field or laboratory work. Completion of an archeological field school is considered satisfactory qualification for an initial position (first archeological job) if that individual will be constantly supervised by a higher qualified individual;
Changes in primary Contractor personnel: Changes must be approved by the Contracting Officer (CO). The CO reserves the right to reject any proposed personnel that do not meet the requirements as stated herein. The Contractor shall submit a written request accompanied by a description of the duties of proposed personnel and the vitae of any new personnel to the CO. Written approval from the CO must be received by the Contactor prior to new personnel beginning work under this contract.
Changes in Field or Laboratory Crew: The Contractor shall submit the vitae of new crew personnel to the COR when new crew personnel are hired and before they begin work.
For all projects the following will be identified:
Contract Manager. The Contractor shall provide a contract manager who shall be responsible for the performance of the work. The name of this person and an alternate(s) who shall act for the Contractor when the manager is absent shall be designated in writing to the Contracting Officer. The contract manager or alternate shall have full authority to act for the Contractor on all contract matters relating to daily operations of this contract. The Contractor manager or alternate shall be available during normal duty hours within three hours to meet on the National Forest with government personnel designated by the Contracting Officer to discuss problems areas.
Key Personnel. The Contractor shall assign to this contract key personnel who meet the minimum criteria established in the Department of Interior’s Guidelines for Professional Qualifications and/or Archaeological Resources Protection Act of 1979 (36CFR296). The contract proposal must include curriculum vitae for the Principal Investigator, Project Archeologist, and the Field Director in support of their academic qualifications and experience. If consultants have not been identified at the time of contract proposal, vitae on these positions may be omitted until such time as they are identified. Employment under the terms of this contract for all individuals not identified at the time of the contract proposal is subject to approval of the Contracting Officer's Representative.
