FAR 52.212-2 Evaluation – Commercial Items (JAN 1999)
Manual Forest / Silvicultural Services IDIQ- NFsAL AG-4146-S-12-0012
REVISED APR 15, 2015 19
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.
The following factors shall be used to evaluate offers: Price, technical capability and past performance
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced.
Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
ADDENDA to 52.212-2 EVALUATION –COMMERCIAL ITEMS (JAN 1999)
(d) BASIS FOR CONTRACT AWARD: The basis for award will be an integrated assessment based on tradeoff between past performance and price. The Government will award the contract to the offeror who represents the best value to the Government in terms of past performance, technical capability, and price.
1. PRICE:
(1) Completeness: The proposed prices for the initial project(s) will be evaluated to ensure the proposed price(s) covers all requirements indicated in the respective specifications/statement of work and other attachments, exhibits, etc., applicable for the projects(s). Pricing does not have to be provided for all items. The contractor must provide pricing for one of the projects to be considered for award.
(2) Reasonableness: Prices are reasonable in comparison to estimates, prior prices paid, and competition and can be supported by suitable estimating techniques. The Government reserves the right to perform a price realism analysis to determine whether an offeror’s proposed prices are realistic for the work to be performed. If a price is determined unreasonably low to realistically perform the work for the proposed price; the offer will not be considered for contract award.
(3) Initial Project(s): The initial project(s) will be awarded as a task order to the offeror(s) who provide(s) the overall best value to the Government using the evaluation factors specified for the basic contract award. Award might be made to other than the low offer based upon best value criteria specified herein and to meet contract minimum guaranteed amounts. Successful offerors will not necessarily be awarded a task order for an initial project at the time of IDIQ contract award.
2. PAST PERFORMANCE: Past performance assessments shall be accomplished for all offerors in the competitive range
(expanded as needed). Each offeror shall be assigned one of the following ratings:
RATING DEFINITION
Exceptional/High
Confidence
Based on the offeror’s performance record, essentially no doubt exists that the offeror will successfully perform the required effort.
Very Good/Significant
Based on the offeror’s performance record, little doubt exists that the offeror will successfully perform the required effort.
Satisfactory/Confidence Based on the offeror’s performance record, some doubt exists that the offeror will successfully perform the required effort.
Neutral/Unknown
No performance record identifiable (see FAR 15.305(a)(2) (iii) and (iv)).
Marginal/Little Confidence Based on the offeror’s performance record, substantial doubt exists that the offeror will successfully perform the required effort. Changes to the offeror’s existing processes may be necessary in order to achieve contract requirements.
Manual Forest / Silvicultural Services IDIQ- NFsAL AG-4146-S-12-0012
REVISED APR 15, 2015 20
Unsatisfactory/No
Based on the offeror’s performance record, extreme doubt exists that the offeror will successfully perform the required effort.
(1) A number of past performance references provided by offerors may be selected and investigated. Any derogatory past performance information obtained will be presented to the affected offeror, and that offeror will have an opportunity to respond with any mitigating facts. The final determination of past performance ratings shall rest with the contracting officer.
(2) An offeror with limited or no recent or relevant past performance will receive a rating of Neutral/Unknown
Confidence, and will not be rated favorably or unfavorably on past performance.
(3) Past performance shall be evaluated on the basis of the following subfactors of equal importance:
i. Contract Performance in relevant projects of the same size and scope .
ii. Quality of Service.
iii. Timeliness of Performance.
3. TECHNICAL CAPABILITY: Technical capability assessments shall be accomplished for all offerors, and each offeror shall be assigned one of the following ratings:
EXCEPTIONAL (E) The proposal exceeds the requirements of the RFP and provides an exceptional or outstanding approach that fully satisfies the Government’s requirements.
ACCEPTABLE (A) The proposal fully satisfies the requirements of the RFP and demonstrates a good understanding of the solicitation. The offeror has adequately addressed the Government’s requirements..
MARGINAL (M) The proposal does not fully meet the requirements of the RFP. Weaknesses are identified which would indicate an insufficient understanding of the Government’s requirements. With minor revisions or clarifications, the proposal has a reasonable chance of becoming technically acceptable.
UNACCEPTABLE (U) The proposal fails to satisfy requirements of the RFP and the approach contains an unacceptable level of risk to the Government. Major deficiencies have been identified in the proposal, which are either not correctable or would require major revision/rewrite to the proposal, without which the proposal doesn't have a reasonable chance of becoming technically acceptable.
Technical capability shall be evaluated on the basis of the following sub factors to determine minimum acceptability and identify any strengths or weaknesses. All other sub factors are of equal importance.
(1). Contractor has experience in performing the various types of manual forest / vegetation manaement/silvicultural services to be performed on this contract. A contractor with experience in multiple disciplines (i.e. herbicide application, chain saw/ brush saws. handtools) will be rated higher than a contractor with experience in onlyone type of service.
(2) Contractor has personnel with the necessary experience for contract performance.
(3) Ability to obtain a license in Alabama for herbicide applications or in a state with a reciprocal agreement. (To be awarded the task order for herbicide application, the contractor needs to be obtain necessary AL licenses ASAP but no later than 10 days after notification. 5. The government reserves the right to award the contract to other than the lowest priced offeror.
(e) AWARD WITHOUT DISCUSSIONS. The Contracting Officer will only clarify the offerors’ information; no discussions are contemplated in accordance with FAR 15.306. Offerors may be given the opportunity to clarify relevance or adverse past performance to which the offeror has not previously had an opportunity to respond. Clarifications are limited exchanges between the
Government and offerors that may occur when award without discussions is contemplated. If discussions are determined to be necessary the procedures described in FAR 15.306 will be used.
