Design-Build Services are required for Architectural, Structural, Civil, Mechanical, Plumbing and Fire Protection, and Electrical Systems. The scope of the project consists of constructing approximately 255,000 GSF of laboratory, office, and animal poultry research space in five buildings. This will require that approximately

67,000 GSF of existing buildings will be demolished at various stages of construction to make room for the new buildings while allowing SEPRL to continue full operation throughout construction. This is a Two-Phase Design-Build

Acquisition. One Solicitation covers both phases. Phase I is the pre-selection phase in which the Government will "Shortlist" maximum of (4) of the most highly qualified offerors. Only those firms selected in Phase I will be allowed to continue to the

Phase II. Detailed design criteria will then be added by amendment to the solicitation to start the phase II stage of the Request for Proposals. Each firm selected for participation in Phase II will then submit a Design-Build technical proposal and price proposal. The estimated cost range for this procurement is

$100,000,000 - $150,000,000. Any contract award resulting from this solicitation will be Firm-Fixed-Priced, made on a full and open basis. Phase I does not require providing performance and payment bonds. Phase II will require bid bonds to be

The BDs include a suggested sequence, timeline and requirement for temporary facilities. However, the DB Contractor is not required to follow the suggested sequence plan as long as the DB Contractor’s plan can meet the overall contract duration and SEPRL can remain fully operational as it currently operates at the time of award.

DB design services are required to complete the design provided in BDs for, but not limited to, architectural, civil, structural, mechanical, plumbing and fire protection, and electrical systems.

DB construction services are required to provide but is not limited to the following activities:

CLAUSE

NUMBER DATE TITLE

52.246-12 AUG 1996 INSPECTION OF CONSTRUCTION

E.2 INSPECTION AND ACCEPTANCE (DESIGN)

Each deliverable shall be reviewed by the Government to ensure compliance with the project requirements. The Government may include, as part of its review, the services of another A-E firm to perform design review services and/or value engineering.

Acceptability of deliverables shall be based on the Government’s satisfaction that the Project Requirements have been fulfilled in accordance with the terms and conditions of the contract. Construction of items not supported by the completed design or a design submittal accepted by the Government are performed at the DB Contractor’s risk.

E.3 INSPECTION AND ACCEPTANCE

(AGAR 452.246-70) (FEB 1988)

(a) The Contracting Officer or the Contracting Officer's duly authorized representative will inspect and accept all design and construction and/or services to be provided under this contract.

(b) Inspection and acceptance will be performed at:

SEPRL in Athens, Georgia.

E.4 FINAL INSPECTION

(a) A final inspection shall be made for each building (B45, B46, B47, and B49) and pavements/landscaping when all the materials have been furnished and all the http://farsite.hill.af.mil/vffara.htm http://farsite.hill.af.mil/VFagara.HTM

Solicitation # AG-3K25-S-17-0003 Page 17 work required by BDs has been completed as required in accordance with the terms of the contract. If, upon examination by the Contracting Officer and/or Government inspection personnel, the building is determined to be not sufficiently completed to have warranted a final inspection and/or material and workmanship are not ready at the time specified by the DB Contractor for its inspection, the DB Contractor may be charged with any additional cost of re-inspection.

(b) The DB Contractor shall give the Contracting Officer 15 calendar days advance notice, in writing, of the date the work will be fully completed and ready for final inspection.

(c) The DB Contractor’s request for final inspection will not be approved unless documentation below, at a minimum, has been provided to the Contracting Officer, in addition to all other contract requirements:

o As-built drawings o Balancing reports - air and hydraulic system balance o Commissioning Report o Special equipment testing certifications o Record of or definite schedule for systems demonstrations o Operating manuals and instructions for equipment items o Keys/Keying schedule o Guarantees and warranty schedule and contacts o Certificates of inspections o Training of appropriate Government personnel o Certified payroll records for all prime and subcontractor employees

(d) As soon as practicable following final inspection, the Contracting Officer will inform the DB Contractor, in writing, of any discrepancies and/or omissions noted at the final inspection. The Contracting Officer will state the time allowable for replacement of material and performance or re-performance of any unsatisfactory work necessary for final acceptance.

E.5 FINAL ACCEPTANCE PER BUILDING AND PAVEMENTS/LANDSCAPING

Upon written notification that all deficiencies identified during the final inspection have been corrected, the Contracting Officer will schedule a final acceptance inspection of the work. If all construction required by the contract is determined to be complete and all requisite contract deliverables (e.g., certified payroll records, operation & maintenance manuals, as-built drawings, warranty documents, all work identified in drawings, specifications and solicitation for this contract, etc.) have been submitted and approved by the Government, the Contracting Officer shall notify the DB Contractor in writing of such acceptance. Acceptance shall be final and conclusive except for latent defects, fraud, gross mistakes amounting to fraud, or the Government’s rights under any warranty or guarantee. The following exceptions apply for this DB contract with regards to acceptance:

The systems located in the basement switchgear room and IT room in B49 that

Solicitation # AG-3K25-S-17-0003 Page 18 support the infrastructure of the SEPRL campus will not be accepted or taken possession of by the Government with the final acceptance of B49. These systems will be accepted as part of the final acceptance for B47.

The new campus utilities up to 5 feet outside of a building and the new campus generators will be accepted or possession taken as part of the final acceptance for B47.

B45 and B47 must be fully operational before the demolition of several buildings to make room for the construction of B46. B47 must be accepted by the Government a minimum of 6 months prior to the acceptance of B45. This requirement will allow the Government the time needed to get approval to operate B47 at a BSL-3 level.

Government will only provide acceptance or take possession of new landscaping, new campus lighting, new pavements, or roads when DB Contractor is complete with all work in the area to be accepted.

F.4 TIME EXTENSIONS

(FAR 52.211-13) (SEPT 2000)

However, no adjustment shall be made under this clause for any suspension, delay, or interruption to the extent that performance would have been so suspended, delayed, or interrupted by any other cause, including the fault or negligence of the DB Contractor, or for which an equitable adjustment is provided for or excluded under any other term or condition of this contract.

(c) A claim under this clause shall not be allowed-

(1) For any costs incurred more than 20 days before the DB Contractor shall have notified the Contracting Officer in writing of the act or failure to act involved (but this requirement shall not apply as to a claim resulting from a suspension order); and
