1. FACTOR 2 - SPECIAL EXPERIENCE & TECHNICAL

COMPETENCY: The first paragraph of RFP page 104 indicates that Offerors shall describe “…experience with design-build contracting of a similar scope, complexity, and size to the requirement.” This suggests that all featured past experience projects must be design-build projects. While we fully support the utilization of design-build methodology for the proposed project, historically, there have been relatively few design-build research laboratory projects. In order for the government to have the opportunity to evaluate the best project examples from the largest pool of highly experienced design-build teams, we strongly recommend that projects utilizing any type of delivery method be allowed as past project experience in Factor 2 of proposals.

We respectfully request that the first sentence under

Factor 2 be reworded as follows: “The Offeror shall describe projects it has performed as either a design-build team, prime, subcontractor or joint venture that indicates its experience with design-build contracting the delivery of a similar scope, complexity, and size to the requirement, using any type of project delivery method.”

Page 102 Factor 2- Special Experience and Technical Competency, is hereby amended as follows:

2. FACTOR 3 - PAST PERFORMANCE: The second paragraph of Factor 3 – Past Performance, page 105, indicates that “Completed PPQ's (Attachment L1) must be submitted directly by the client reference to the Government's Point of Contact”. In recent years, other federal agencies have allowed offerors to submit PPQs without sealed envelopes and include them as part of the proposal document. Furthermore, offeror’s have frequently been allowed to submit copies of completed PPQs that have been previously submitted with other proposals. This approach has proven to be much more convenient to customers because it streamlines the evaluation process, simplifies the logistics of sending PPQs, and reduces the number of times offerors need to impose on their customers to fill out PPQs.

We respectfully request that the government adopt this well-established and effective approach to providing customer past performance evaluation. Please confirm that it is acceptable to submit federal PPQs (e.g., DoD

PPQ-0 format) previously submitted in other proposals in lieu of Attachment L1 and without sealed envelopes.

Response to Amendment #001, Question 15, stated:

“No. PPQ’s must be submitted in the format attached in the solicitation.

Previously completed PPQ’s are not permitted for re-submission.“

3. General Proposal Requirements (Reduce font size):

Paragraph (iv) on RFP page 101 states, “…elite font, 12 pitch type (or equivalent) …”. Our experience has been that 12-point font is much larger than needed for acceptable readability and consumes much more page space than smaller point sizes. We respectfully request that the font size minimum be reduced to 10 point.

12 Pitch requirement shall remain unchanged, however, the Elite font that is currently required is not a standard MS Word font, so additional choices have been added. See change below.

Page 99 Volume 2- Binder, is hereby amended as follows:

From:

“The proposal shall be typed, have one inch margins, using elite font, 12 pitch type (or equivalent) and printed, unreduced in size, on 8 1/2" by 11" paper, double sided. Diagrammatic information that cannot fit this format may be printed on 11”X17” and folded. Total number of pages submitted for Volume 2 Technical Proposal shall not exceed 50 pages (25 Sheets maximum). This does not include cover sheet, tables, tabs, bonding letters, appendices, etc.…”

4. L.13 PROPOSAL SUBMISSION

REQUIREMENTS/INSTRUCTIONS PHASE 1:

Paragraph (c) on RFP page 98 states, “The offeror shall elect to submit SF330 forms for design firm qualifications subject to the same presentation format and content requirements of the Solicitation.” Please confirm if an SF330 is in fact a phase I requirement or are offerors to simply following the proposal submission requirements (including design firm qualifications), outline starting on RFP page 100, (d) Overall Arrangement of Proposal Phase 1.

If an SF330 is required in phase 1, please clarify where it should be located within the Phase I proposal (Volume 1 or Volume 2). Please note that the addition of a completed SF330 will greatly exceed the 50-page limitation of Volume 2 Technical Proposal stated in paragraph (iv) on RFP page 101.

Providing the SF330 in Phase 1 of the Solicitation is no longer a requirement, however the SF330, Part 1, Section F, format may be used to present the Design Teams three (3) projects and will be part of the 50 page count and provided in Volume 2, Technical Proposal. A completed SF330 is a requirement of Phase 2 and shall be provided in Volume 4 Binder, Design Build Project Team. Projects presented in Phase 1 are not required to be the same projects presented in Phase 2.

This response also covers the response to Amendment #004, Question 12 and Question 19.

This response supersedes the responses with respect to SF330 requirements for:

5. FACTOR 2 - SPECIAL EXPERIENCE & TECHNICAL

COMPETENCY: RFP Section L.14 (Evaluation Factors – Phase 1) on RFP page 104 defines projects of a similar size to include “Project duration of five or more years.”.

RFP Section M.3 (Factors for Evaluating Phase 1 Proposals) on RFP page 131 defines projects of a similar size to include “Project duration of four or more years.”.

Please clarify this project size definition.

See the response to Question 6, Amendment 003.

6. FACTOR 2 - SPECIAL EXPERIENCE & TECHNICAL

COMPETENCY: RFP Section L.14 (Evaluation Factors – Phase 1) on RFP page 104 defines projects of a similar size to include “Single Construction contract with aggregate contract value exceeding $50,000,000.”. RFP Section M.3 (Factors for Evaluating Phase 1 Proposals) on RFP page 131 defines projects of a similar size to include “Single Construction contract with aggregate contract value exceeding $100,000,000.”. Please clarify this project size definition.

See the response to Question 6, Amendment 003.

7. FACTOR 3 - PAST PERFORMANCE: Given the December holidays and the need to coordinate with past project customers (e.g., confirming accurate project references and obtaining past performance evaluations), we respectfully request a due date extension from January 23, 2017 to February 8, 2017.

Date is extended to Thursday, January 26th by 3:00 pm EST.

11. L.13 PROPOSAL SUBMISSION

REQUIREMENTS/INSTRUCTIONS PHASE 1 – If our proposal is submitted by overnight delivery using a commercial delivery service (e.g., UPS, FedEx), are there any special instructions for delivering packages at the USDA ARS FD Modernization Branch office in Beltsville.

While UPS and FedEx have access to GWCC, special directions shall be provided to require delivery directly to Michael Wigfall or Michael Thompson at Mailstop 5123. Signatures shall be required.

12. Please clarify all required sections of the SF330 our design partner is required to submit. Our original interpretation was that only 3 projects in the 330 format of

Section F was required for our design partner to show.

Info required in Sections A-C are provided elsewhere in the submittal, D, F and G reference personnel which will be provided in Phase 2, and H is additional info.

See response to Question 4 of this Amendment.

13. Please confirm that our design partners must also have clients submit a PPQ for their three project examples.

Confirmed. See RFP, page 103, Factor 3 – PAST PERFORMANCE.

14. A client had sent in a completed PPQ prior to the release of Amendment 1. Based on our interpretation of the instructions, we had filled in Section I with that client’s specific project info instead of SEPRL info as clarified by the answer to question 40 of Amendment 1. Do we need to have that client resubmit the PPQ with the corrected info for Section I?

No, resubmission is not required.

15. Please clarify all required attachments referenced in Section J – List of Attachments the offeror is to provide in Volume 1. Also clarify if copies of any required attachments are to be completed by the design partner along with the prime contractor’s.

No, the list provided in section J.1 identifies the attachments to the Solicitation.

These are not needed for Phase 1 of the Solicitation.

16. Additional request per our question 3 below. If a corrected PPQ must be resubmitted, is it possible for the offeror to do so on behalf of the client?

Factual data my be corrected and resubmitted by the Offeror, but no evaluation ratings may be altered. The Offeror should clearly identify where factual data has been corrected. The corrected PPQs will be cross referenced with the original submitted by the clients.

17. Reps & Cert - Sect K – Amendment 3 – Question #19

Question #19 in Amendment #3, response states, "Reference to FAR 52.219-22 is not invalid. Please refer to full text in FAR or the following link. Sections that are marked "reserved" are done by the FAR council for future use and not by individual Government Agencies. 52.219- 19 - 52.219.26 were not marked "reserved" by USDA-

ARS.”

We have referenced the full text in FAR and the link provided. FAR 52.219-22 is marked “reserved” and is therefore an invalid FAR clause reference. Please reference a FAR clause that is valid or remove. Please note, we understand that the FAR is maintained by the FAR council but we don’t understand the relevance of that statement. The fact that FAR 52.219-22 was not marked “reserved” by USDA-ARS is also not relevant. In an effort to provide you with additional information, note that FAR 52.219-22 was a valid reference up to October 14, 2014.

As of October 14, 2014, FAR 52.219-22 is marked

FAR 52.219-19, Small Disadvantage Business Status, is no longer an applicable certification. This will be removed from the Solicitation.

“reserved” and is therefore invalid. This is evidenced by the prescription clause at FAR 19.309 which also no longer make reference to FAR 52.219-22 as of October 14, 2014. Additionally, per FAR 1.108(d)(1) which reads “Application of FAR changes to solicitations and contracts.

Unless otherwise specified. (1) FAR changes apply to solicitations issued on or after the effective date of the change”. For this reason, we must use the FAR that is in effect as of the date of this solicitation. We do not believe it is the government’s intent to use the FAR that was in effect prior to October 14, 2014. If the applicable clause is part of a USDA-ARS regulation, then please reference the applicable clause from that regulation rather than the

FAR.

18. Volume 1 - Business information

On Page 100, Volume 1 Binder is to include acknowledgments.

Acknowledgment forms will be provided in this Amendment for this and all prior Amendments. Acknowledgment forms will be required with signature in Volume 1.

19. Amendment 3 - Question

The response to question 20 in Amendment 3, indicates the design team is required to submit a SF330 response to supplement the RFQ response with the exception of Section D & E. However, the SF330 Section F requires 10 relevant projects instead of the requested three projects per the solicitation. Section G is similar to section

D & E for Key Personnel. The design team is also required to respond to the SF330 Section H, which is a written response to specific questions traditionally posed in the solicitation. The solicitation does not request specific questions of the design team separate from the design build team, so there is uncertainty regarding what to highlight in a Section H response. A complete SF330 submission for the design team will likely be 80 to 100 pages. Due to the complexity of the SF330 response, AE firms are usually given more time from the solicitation issue to deadline than stipulated for the SEPRA Phase I (five to six weeks) to respond.

Please confirm:

1 - If the SF330 must be submitted with the Phase 1 proposal, if so 2 - Please considered extending the proposal due date by 2 weeks if the SF330 is required.

3 - Confirm the project requirements for Section F are only the 3 projects provided in Factor 2 4 - Confirm Section G is not required for the Phase 1 submission 5 - Please confirm the SF330 Part 1 Section H is not a required part of the Phase 1 solicitation requirement and, if it is, please provide questions to be addressed in section H.

Criteria in Section F.7, 5-h does not clearly clarify intent.

21. Part I - Section B- Supplies or Services and Price/Costs

Page 10 lists HVAC commissioning under responsibility of D-B contractor. Is the D-B contractor responsible for developing test scripts and other verification requirements or is this limited to supporting an independent Cx agent's activities?

The Commission Agent (CxA) will develop the Pre-Functional checklists, systems test forms, and integrated systems test forms based upon the construction documents finalized by the Design Build Contractor (DBC). The DBC will actually perform the Commissioning Activities. The CxA will monitor the testing. The CxA is an independent agent of the Government.

22. Part I - Section B- Supplies or Services and Price/Costs

Page 10 lists LEED Certification of B45, B46 and B47 as a requirement. Can the D-B team assume the bridging documents already incorporate all necessary requirements, such as systems or specification requirements?

To be addressed in Phase 2 of the Solicitation.

23. Part I - Section F.7, paragraph A-

If the design-build team may have to update the LCCA will the design-build team be provided with the data files for the energy consumption and the LCCA? Or will be design-build team be responsible for recreating the energy model and LCCA calculations? (Also applies to sub-paragraph 5-b.)

Yes, the LCCA data and Energy Report will be provided to the selected DBC, however the DBC is required to finalize LCCA data and Energy Report to correspond to final design/construction requirements.

24. Part I - Section F.7, paragraph A- 5, sub-paragraph h

Is the design-team responsible for providing the USDA the necessary information for submitting for air quality and waste discharge permits? Or is the design-build team responsible for gathering the data, preparing the permit applications and submitting to relevant authorities? If design-build team totally responsible will USDA provide relevant data for existing facilities and equipment that impact the permit?

The DBC will be responsible for submitting all information required for the Government to secure all necessary permits. The Government will be responsible for obtaining the permits.

Please consider adding an additional week to the current 1/23/17 response date because of the changes in the past amendments. These amendments have adjusted the proposal requirements for the Prime in that more and different information is allowed at this time thus requiring more time to provide a quality response to the RFP

Date is extended to Thursday, January 26th by 3:00 pm EST.
