Janitorial Contract
Vision Statement
Provide requirements for Janitorial Service Contract
1. Introduction
The Contractor shall provide all labor, cleaning supplies, equipment, transportation, and all other necessary supplies not identified as being supplied by the Government. The contractor will provide all services identified in this contact for the USDA, Agricultural Research Service (ARS), Knipling-Bushland U.S. Livestock Insects
Research (KUBLIRL), Kerrville, Texas. All services will be performed in accordance with the terms, conditions, and statements and specifics of work contained herein.
1.1 Mission - Reserved

1.3 Scope
The Contractor in accordance with the requirements of these specifications shall perform the services specified in the Matrix of Services. Such services shall include providing all labor, supervision, equipment, tools, and other items or services necessary for the performance of the work unless otherwise specified herein. The Government has not made and will not make any efforts at determining square footages. It is the responsibility of the contractor to visit the site and make appropriate determinations of size of areas and services required within each area. The Contractor accepts existing conditions and is responsible for ensuring all areas will meet the standards as defined in the performance requirements.
Periods of Performance
This contract will provide janitorial service for the USDA, Agricultural Research Service (ARS), Knipling-
Bushland U.S. Livestock Insects Research (KUBLIRL), in Kerrville, Texas.

Site Visit
A site visit is scheduled for June 5, 2015 at 10:00 a.m. Central Time at the site where services shall be provided.

Bidders are advised to visit the site and fully inform themselves as to the location of the work, verify areas to be cleaned and the conditions under which the work is to be performed prior to submitting a quotation. Failure to do so will not relieve the successful quote of their responsibility under the resulting contract.

Exercise of Options
The Government anticipates the award of this contract for janitorial services for the first period (beginning
07/01/2015 and ending on 09/30/2015). Upon satisfactory completion of the year’s services, the Government may elect to issue a contract modification to exercise the Government’s right to extend the period of services for the second period and upon satisfactory completion of each successive year’s services, thereafter until the full term of the contract has expired. The Bidder shall furnish a lump sum total price for each service period, for fulfilling the requirements of this contract. Service Contract Act provisions apply to this contract, and annual changes will be made by modification to the Contract. Award will be made to the responsive/responsible bidder indicating the lowest prices considering all three periods of performance as well as the price of each individual period. Additional references will be verified for past performance
2. General Requirements
The Contractor shall be directly responsible for work performance specified in the contract. All areas served by this contract are indicated on the attached floor plans of each building where services are provided. The
Contractor shall provide adequate supervision at all times while his/her employees are performing work on the contract. The Contractor will ensure that all discrepancies reported are corrected in a timely manner.
The Contractor shall establish a written quality control program to assure the requirements of the contract are provided as specified. A copy of the program will be provided to the Government. The program shall include, but is not limited to, the following:
1. A monthly inspection system performed by the on-site Manager covering all services being performed with a written copy (electronic or hard) provided to the Facilities Representative.
2. A method of identifying deficiencies in the quality of services before the level of performance is unacceptable.
3. A means of correcting deficiencies in a prompt and efficient manner.
2.1 Non-Personal Services
The Government shall neither supervise contractor employees nor control the method by which the contractor performs the required tasks. Under no circumstances shall the Government assign tasks to, or prepare work schedules for, individual contractor employees. It shall be the responsibility of the contractor to manage its employees and to guard against any actions that are of the nature of personal services, or give the perception of personal services. If the contractor believes that any actions constitute, or are perceived to constitute personal services, it shall be the contractor's responsibility to notify the
Facilities Representative or the Contracting Officer.

The contractor shall successfully integrate and coordinate all activity needed to execute the requirement. The contractor shall manage the timeliness, completeness, and quality of problem identification. The contractor shall provide corrective action plans, proposal submittals, timely identification of issues, and effective management of subcontractors. The contractor shall seek to ensure customer satisfaction and professional and ethical behavior of all contractor personnel.
2.3 Contract Administration and Management
Prior to commencement of services, the Contractor shall furnish to the Facilities Representative, a list of employees they propose to use in the performance of the on-site work required and designate the on-site
Manager who will be responsible for supervision of such employees. The Manager shall:
1. Be the Contractors primary on-site representative, having the Contractors full authority to act on matters pertaining to the performance of services under this contract.
2. Be on-site or on-call whenever the Contractors workforce on the site is performing work.
3. Notify and secure approval from the Facilities Representative for any work proposed to be done on other than normally scheduled workdays.
4. Ensure that care is used when working around doors so as not to hit or scrape them and ensure that carts are not used to push open doors.
4. Report damage to Government property, loss of keys, personal injuries, and/or hazardous conditions, to the Facilities Representative within twenty-four (24) hours after the occurrence.
5. Arrange to meet with Facilities Representative prior to commencement of any work to allow for the identification of any hazards located throughout the Complex.
2.3.1 Contract Management
The contractor shall establish clear organizational lines of authority and responsibility to ensure effective management of the resources assigned to the requirement. The contractor must maintain continuity between the support operations at the USDA, ARS, Knipling-Bushland U.S. Livestock
Insects Research Laboratory.
2.3.2 Contract Administration
The contractor shall establish processes and assign appropriate resources to effectively administer the requirement. The contractor shall respond to Government requests for contractual actions in a timely fashion. The contractor shall have a single point of contact between the Government and
Contractor personnel assigned to support contracts or task orders. The contractor shall assign work effort and maintaining proper and accurate time keeping records of personnel assigned to work on the requirement.
2.3.3 Personnel Administration
The contractor shall provide the following management and support as required. The contractor shall provide for employees during designated Government non-work days or other periods where

Government offices are closed due to weather, budget, or security conditions. The contractor shall maintain the currency of their employees by providing initial and refresher training as required to meet the PWS requirements. The contractor shall make necessary travel arrangements for employees. The contractor shall provide necessary infrastructure to support contract tasks. The contractor shall provide administrative support to employees in a timely fashion (time keeping, leave processing, pay, emergency needs).
2.4 Subcontract Management
The contractor shall be responsible for any subcontract management necessary to integrate work performed on this requirement and shall be responsible and accountable for subcontractor performance on this requirement. The prime contractor will manage work distribution to ensure there are no
Organizational Conflict of Interest (OCI) considerations. Contractors may add subcontractors to their team after formal notification to and approval by the Facilities Representative.
2.5 Contractor Personnel, Disciplines, and Specialties
The contractor shall accomplish the assigned work by employing and utilizing qualified personnel with appropriate combinations of education, training, and experience. The contractor shall match personnel skills to the work or task with a minimum of under/over employment of resources. The contractor shall ensure labor rates are adhered to in accordance with the Service Contract Act, Wage Determination 2005-
2521 (See Attachment V).
The Contractor shall provide the necessary resources and infrastructure to manage, perform, and administer the contract. The Contractor will have adequate staff to provide service when regular staff is out sick or on annual leave.
2.6 Location and Hours of Work
Accomplishment of the results contained in this PWS requires work at the USDA, ARS, Knipling-
Bushland U.S. Livestock Insects Research Laboratory with facilities normal workdays are Monday through Friday except US Federal Holidays. Workers typically work eight (8) hours per day, 40 hours per week. With the exception of stripping and waxing floor, services shall be performed during the time period of 0800 hours through 1630 hours (4:30pm). Contractor shall, in consultation with the Facilities
Representative, establish when work will be scheduled. Only in unusual circumstances (such as stripping and waxing floors), and only after prior approval of the Facilities Representative, shall the Contractor perform work other than on the regularly scheduled workday(s). Cleaning of exterior building glass shall be done during daylight hours (M-F) on days/times proposed by the Contractor and concurred upon by the Facilities Representative. The Government reserves the right to modify the requirement such that routine janitorial services will be required to be performed after normal working hours; however, at this time the Government does not anticipate this action will be necessary. If changes in the working hours are required, the Government will provide the contractor with at least thirty (30) days’ notice but no change in contract price will be permitted.

3. Performance Requirements
The following section specifies the Performance Objectives and Performance Elements for the contract. A site plan showing the general layout of the KBUSLIRL USDA, ARS, Knipling-Bushland U.S. Livestock Insects
Research Laboratory, 2700 Fredericksburg Rd. Kerrville, TX 78028 is provided, Appendix B. Work specified in this contract will be performed in the following Bldgs.; 1, 2, 3, 4, 5, 6, 7, 8, 9, 28, 13, 21, 23, 29, 30, 35, 36, 37, 38, 39, 40 (see special considerations for bldgs. 5, 13, 21, 35, 37, 38, 40). These buildings consist of offices, laboratories, restrooms, conference rooms, break/lunch room, and miscellaneous support rooms. Bidder shall take the total occupancy of this facility into account in estimating the time and work load.
Flooring in restrooms varies from ceramic tile, vinyl floor tile, to concrete floor. The Contractor accepts the existing condition of all flooring and is responsible for the flooring adhering to the existing standards.
The Government routinely renovates areas to meet the changing needs of research. The Contractor at no additional cost to the government will accommodate renovations that result in relatively simple changes, such as vinyl to carpet or carpet to vinyl. Occasionally, the renovation will involve the removal or addition of space.
Upon the completion of each renovation project, an evaluation of any additional services required will be performed by the Facilities Representative. The evaluation will include the removal of any services no longer required. The Facilities Representative will discuss any necessary changes with the Contractor. If the evaluation determines there will be significant additional burden upon the Contractor, the contract may be modified to provide reasonable compensation to the Contractor.
MATRIX OF SERVICES (Appendix A.)
Services vary from building to building. All the services identified below may or may not be required daily;
however, all areas defined in the contract must satisfy the requirements defined in the performance section. At the completion of any service in a building, the janitorial area in that building will be left in a clean and orderly manner. This will include, but is not limited to, all supplies off the floor, mop sink clean and floors swept and mopped.
The contractor will perform the following weekly, services as required to satisfy the standards described in the performance section.
See Appendix A. for Building Square Footage.
3.1 Clean Restrooms
Deliverables
3.1.1 The contractor shall empty trash cans for all restrooms.

Std: Free of trash, trash bag replaced.
3.1.2 The contractor shall sweep, mop, and scrub floors for restrooms.

3.1.3 The contractor shall clean and sanitize urinals, toilets, and showers for restrooms.

Std: All toilet bowls, urinals, and showers completely cleaned (inside and out) and disinfected. After cleaning, receptacles will be free of mineral deposits, dirt, streaks, mold, mildew, and odors.
3.1.4 The contractor shall clean sinks and metal polished surfaces for restrooms.
Performance Standards
Std: All porcelain and polished metal surfaces completely cleaned, disinfected and polished. After cleaning, equipment will be free of debris, dirt, streaks, and odor and will have a uniform glossy appearance
3.1.5 The contractor shall clean and polish countertops, partition walls, mirrors, walls, and entry doors for restrooms.

Std: Free of dirt, dust, spots, streaks, graffiti, bugs, and all foreign residue. All surfaced sanitized with a uniform glossy appearance.
3.1.6 The contractor shall fill paper towel dispensers, toilet paper dispensers, and soap dispensers for restrooms.

3.1.7 The contractor shall clean mirrors for restrooms.
Std: Free of all stains and water marks and streaks
3.2 Clean Offices

Page | 7 their original location prior to the start of each work day. Trash liner will be replaced as appropriate. Obviously soiled or torn plastic liners will be replaced. Boxes or papers placed near trash container and marked "trash" shall be removed. All empty boxes in the hallways are to be considered trash and shall be removed. Trash receptacle shall be clean, free of foreign matter, and free of odors. The trash shall be deposited in the nearest outside trash dumpster to the building. Recycling items will be deposited in the appropriate recycling dumpster.
3.2.2 The contractor shall vacuum carpeted floors for offices.
Performance Standards
Std: Free of visible dirt, debris, litter, and other foreign matter. Any spots remove by carpet manufacturer's approved methods. Move chairs and trash cans to vacuum beneath but do not move/disturb any other items on the floor.
3.2.4 The contractor shall sweep and mop vinyl tile floors for offices.
Performance Standards
Std: Free of dirt, dust, spots, streaks, graffiti, bugs, and all foreign residue. Floors will have glossy appearance free of water streaks
3.3 Clean Laboratory

The trash shall be deposited in the nearest outside trash dumpster to the building. Recycling items will be deposited in the appropriate recycling dumpster.
3.3.2 The contractor shall sweep and mop vinyl tile floors for laboratories.

3.4.2 The contractor shall sweep, mop, and vinyl tile floors for hallways.

3.4.3 The contractor shall clean walls for hallways.

3.5 Clean Common Areas

The trash shall be deposited in the nearest outside trash dumpster to the building. Recycling items will be deposited in the appropriate recycling dumpster.
3.5.2 The contractor shall mop, sweep, and buff vinyl tile floors for foyers, lobbies, conference rooms, and break rooms.

3.6 Clean Interior Entrances
3.6.1 The contractor shall empty trash cans for entrances.

Std: All waste trash containers and other trash containers shall be emptied and returned to their original location prior to the start of each work day. Trash liner will be replaced as appropriate. Obviously soiled or torn plastic liners will be replaced. Boxes or papers placed near trash container and marked "trash" shall be removed. All empty boxes in the hallways are to be considered trash and shall be removed. Trash receptacle shall be clean, free of foreign matter, and free of odors. The trash shall be deposited in the nearest outside trash dumpster to the building. Recycling items will be deposited in the appropriate recycling dumpster.
3.6.2 The contractor shall clean walls, floors, and doors for entrances.

Std: Free of dirt, dust, spots, streaks, graffiti, bugs, and all foreign residue. Remove all spider cobwebs. All surfaces will have a uniform appearance.

3.7 Clean Windows
3.7.1 The contractor shall clean windows and window frames for all buildings.

3.8 Bi-Annual Floor Clean

3.8.1 Strip, Wax, and Buff Vinyl Tile Floors for Hallways

Std: Free of dirt, dust, spots, streaks, graffiti, bugs, and all foreign residue. Floors will have glossy appearance.
3.8.2 The contractor shall deep clean carpeted floors for offices.
Performance Standards
Std: Deep clean carpets by steam/shampoo or other appropriate method to remove residual dirt and stains. Remove stubborn stains in accordance with standard commercial practices. After cleaning, carpeted areas will be uniform in appearance and free of stains and discoloration. All cleaning solutions shall be removed from baseboards, furniture, trash receptacles, chairs and other similar items. All furniture returned to original location.
SPECIAL CONSIDERATIONS
1. The contractor shall be responsible for ensuring that his employees do not disturb, unplug, or alter laboratory apparatus or otherwise disturb laboratory experiments in progress, and that they do not disturb papers on desks, open drawers or cabinets, or use telephones except for emergency calls to police or fire departments.
They shall also be instructed not to eat in offices and laboratory work areas because of possible radiation or chemical hazard to health.
2. Contractor may not enter areas that are posted "AUTHORIZED PERSONNEL ONLY" without prior authorization from the individual responsible for the safety and maintenance for that area.
3. Buildings 11 - The building is unoccupied at present. Services are to resume when the building becomes occupied. Estimated date is 8/1/2015.
4. Building 37, Rooms 5, 9, 11, & 12 - Maintain floor and empty trash from trash cans only.

5. Building 38, Rooms 3, 4, 5, 6, - These rooms are not to be disturbed, dusted or cleaned.
Orientation to be given by Dr. Felix Guerrero at pre-site visit.
6. No container or article marked with a radiation symbol is to be disposed of as trash regardless of where it is located. Notify the LAO or Location Radiation Safety Officer of any such items which appear to be out of place.
7. Building 13 - Clean restroom only.
8. Building 40 - Sweep, mop, and empty trash just once a week only.
9. Building 35 - Sweep, mop, and empty trash once a month.
10. Building 4 - Sweep and wet mop only no detergents to be used in this building
4. Security and Safety
Security of all Government facilities and property is essential. All contractor personnel must be United States citizens or have proper documentation to work in the United States. The Contractor shall be responsible for background checks on their employees prior to being allowed to work on site. The contractor will provide a police report on each employee to the LSM prior to bringing that employee on site. The Government reserves the right to deny access to any person who it determines is not in the best interest of the Government. Contractor personnel will ensure that all exterior building doors are kept closed and locked after normal working hours. Only contractor personnel are allowed in the facilities. Contractor personnel will not provide access to any other persons including persons claiming to be Government employees all authorized Government employees have keys to the areas they are allowed to have access.
Contractor personnel shall comply with all policies pertaining to the conduct of persons on Government property. They shall not disturb papers on desks, open desks or cabinets, or use office equipment. Use of the telephone is allowed only for emergency calls. All Contractor personnel shall be easily identifiable as being a member of the janitorial crew. Acceptable means of identification shall include wearing uniforms with company’s name or utilizing name badges clipped to the front of an outer clothing garment or other method as approved by the Location Site Manager (LSM). All contractor personnel shall use the same form of identification and the method of identification is to be agreed upon by the LSM prior to services being provided. The
Government reserves the right to require all contractor personnel to wear Government issued ID badges. Contractor personnel shall utilize energy conservation policies by not adjusting heating or cooling devices; and by turning off lights in unoccupied areas, unless otherwise directed. Doors shall be left in the state encountered (opened/unopened; locked/unlocked). Contractor shall not enter any area where janitorial services are not to be rendered under the contract.
The Contractor will check out any necessary keys daily from the Facilities Representative or other designated employee. The Contractor shall establish and implement methods of ensuring that keys issued to the Contractor personnel by the Government are not lost, misplaced, or used by unauthorized personnel. This key shall not be duplicated. If the master key is lost, all locks affected by that key will be re-keyed by the Government; the
Government will procure a full complement of new individual building and room keys, and the total cost will be
Page | 12 deducted from payment due to the Contractor. It is anticipated that such costs as charged to the Contractor will be in excess of $5,000.00
Contractor will provide a safe working environment for contractor personnel and will ensure all personnel practice safe working techniques. The contractor shall follow, but is not limited to, the following safety precautions:
1. Providing safety-warning devices and ensuring they are used as necessary (e.g., wet floor signs).
2. Providing all Contractor personnel with proper personal protective equipment as necessary.
3. Ensuring all Contractor personnel are aware of the various hazards located throughout the facility.
4. The Government, upon request by the Contractor through the Facilities Representative, will provide site-hazard awareness training for Contractor personnel once per year (not to exceed one hour and to be scheduled at the convenience of the Government).
5. Ensuring that all Contractor personnel are familiar with the hazards of cleaning supplies used.
6. Ensuring that only green (environmentally friendly) cleaning products are used when a suitable product is available.
7. Providing the Government with copies of MSDS for any hazardous material brought or used on-site.
8. Ensuring all machinery brought on-site is routinely inspected and is in safe working order and meets all
Occupational Safety & Health Administration (OSHA) regulations.
9. Removing from service any machinery found to be unsafe. Any equipment deemed unsafe will be removed from the site to prevent inadvertent use. Additionally, any equipment deemed to be unsafe by the Facilities
Representative must be promptly removed from service.
10. Contractor will ensure all employees are familiar with precautions to be taken to protect themselves from exposure to the flu and how to minimize the spread at the jobsite. In the event of a flu outbreak, the Government may implement additional cleaning requirements. Assessment of additional duties will be made between the
Contractor and the Government and the Facilities Representative will determine if additional compensation for any additional services is warranted.
4.1 Transition - Reserved
4.2 Government Furnished Materials
The Government shall furnish without cost to the Contractor, electricity and water to facilitate
Contractors work. Government will furnish toiletry items to include toilet tissue, towels, deodorizers, dispenser soap, and trash liners. Government will store these items on-site in an area agreed upon after award of the contract. Contractor will inform Government at least two weeks in advance when supplies need to be ordered. Contractor is responsible for neatly storing material in areas provided. These storage
Page | 13 areas will be kept neat and clean at all times (i.e., all material off of floors, empty boxes removed, floor swept and mopped).
4.3 Contractor Furnished Materials
The contractor shall furnish the following equipment:
One High Speed buffing and polishing machine with 2000 rpm minimum.
One Vacuum cleaning Machine (for carpet areas).
One Carpet Shampoo Machine.
Mops and mop buckets.
All Cleaning materials (Glass cleaner, soap, wax, etc.)(All supplies will be (Biobased).
All equipment shall have bumpers and guards to prevent marking or scratching fixtures, furniture, or building surfaces.
All equipment shall have the necessary safety protection and be UL approved. Equipment must be operated using existing circuits.
Equipment deemed to be inadequate or unsafe for the purpose intended shall be ordered removed by the
Contracting Officer and replaced with safe and satisfactory equipment.
4.4 Environmental Requirements
The contractor shall take every precaution to prevent damage to the environment. The contractor shall only use only cleaning material as determined to be bio-based. See clause in contract document for bio-based requirements.
4.5 Applicable Directives
The contractor shall comply with all documents listed in the contract document.
5. Biobased Products Requirement
This procurement requires the use of biobased products to the extent that such products are reasonably available, meet agency or relevant industry performance standards, and are reasonably priced. Where available, these products should first be acquired from among qualified products that fall under the umbrella of items designated through the USDA BioPreferred SM Program
The Contractor must comply with the Agricultural Act of 2014; the Food, Conservation and Energy Act of
2008 (FCEA), 7 U.S.C. 8102; the Farm Security and Rural Investment Act of 2002 (FSRIA), 7 U.S.C.
8102; the Federal Acquisition Regulation; Executive Order (EO) 13514, “Federal Leadership in
Environmental, Energy and Economic Performance,” dated October 5, 2009; EO 13423, “Strengthening
Federal Environmental, Energy, and Transportation Management,” dated January 24, 2007; and Presidential
Memorandum, “Driving Innovation and Creating Jobs in Rural America through Biobased and Sustainable
Product Procurement,” dated February, 2012 to provide biobased products.
The Contractor shall utilize products and material made from biobased materials (e.g. biobased greases;
biobased hydraulic fluids, biobased absorbents) to the maximum extent possible without jeopardizing the intended end use or detracting from the overall quality delivered to the end user. All supplies and materials
Page | 14 shall be of a type and quality that conform to applicable Federal specifications and standards. All supplies and materials to be used in the performance of work described herein are subject to the approval of the LSM.
The following is an example list of products that may be used in this contract for custodial services for which biobased products are available. The list is not all inclusive. It is desirable that vendors be able to supply the greatest number of biobased products listed meeting the health and environmental specifications.
All-purpose cleaner, Heavy duty cleaner, Carpet shampoo, Gum remover, Degreaser/cleaner, Deodorizer, Floor finish, Floor finish restorer, Disinfectant sanitizer, Extraction fluid, Floor stripper, Floor sealer, Furniture polish, Glass cleaner, Neutral cleaner (liquid), Stain remover, Air freshener including dispenser, Bathroom cleaner, Brass polish/cleaner, Chrome polish/cleaner, Liquid hand soap including dispenser, Lime and scale remover (tub and tile cleaner), Grout sealer, Stainless steel polish, Toilet bowl cleaner, White board cleaner, Wood floor cleaner, Laundry detergent, Cream cleaner, Solvent.
Biobased products that are designated for preferred procurement under USDAs' BioPreferred program must meet the required minimum biobased content as stated in the USDA Final Rule available at www.biopreferred.gov. The Contractor should provide data for their biobased products such as biobased content.
In addition to the biobased products designated by the U.S. Department of Agriculture in the BioPreferred
Program, the Contractor is encouraged to use other biobased products.
The Contractor shall submit with the initial proposal a complete list of biobased products, indicating the name of the manufacturer, cost of each material, and the intended use of each of the materials that are to be used in carrying out the requirements of the contract. Additionally, the winning Contractor on each anniversary date of the contract shall compile a complete list of biobased products, including the information above, purchased to carry out the contract requirements. The Contractor shall list volume to be used and total cost for each individual product. This information will be used for reporting purposes.
The Contractor shall comply with tile provision at FAR 52.223-1, Biobased Product Certification.
The Contractor shall comply with the clause at FAR 52.223-2, Affirmative Procurement of Biobased Products under Service and Construction Contracts.
Within thirty (30) days of contract award, the Contractor shall submit an Operations and Maintenance Plan.
This submittal shall be approved by the LSM in writing. The Contractor shall not commence work until this submittal is approved by the LSM in writing.
The Plan must be reviewed and updated annually, and as required by the LSM. The Plan must contain and define the following elements:
The Contractor's written policy stating its commitment to the use of biobased products, employee health and safety, and sound environmental management practices.
Detail on how the Contractor intends to keep abreast of the development and increasing availability of biobased products and how any new or improved products will be incorporated on an ongoing basis into contract performance.

Proposed biobased custodial products which must be selected in accordance with the criteria included above. At a minimum, the Plan must identify products by brand name for each of the product types.
NOTE: A Contractor may propose more than one product within a product category and/or propose a product or products addressing more than one product category.
The product guides which define standard operating procedures for instructing staff in the proper use, storage, and disposal of biobased products; proper maintenance of equipment; and other procedures/instructions to accomplish work under this contract.
The Contractor shall provide data on the quantity and dollar values of biobased products used in this contract.
The data will be submitted to the LSM quarterly. A demonstration of proper use, an effective training program, and technical assistance are essential to the success of the purchase and use of some biobased products that may function differently than a conventional product. Therefore we will look for a Contractor who will 1) demonstrate products, and 2) when selected, offer any necessary training to all of the construction staff and 3) be available with technical assistance to trouble shoot problems.

INSPECTIONS
To assure compliance with specifications, terms, and conditions, the Facilities Representative will make quarterly inspections of parts of the buildings for which services are provided. The Facilities
Representative will receive, check, and verify complaints related to non-compliance; and re-inspect those areas to assure corrective action has taken place.
The results of the Facility Representative inspection shall be recorded on the form entitled "Quality
Assurance Surveillance Report" and submitted to the Contractor and the Contracting Officer. This document shall be used to determine whether the provisions of the Deduction Clause apply. This determination will be made by the Contracting Officer. Failure of the Contractor to agree with the decision of the Contracting Officer will result in a dispute and will be disposed of in accordance with the contract General Provisions entitled "Disputes

DEDUCTIONS
Clean and well-maintained buildings is the Government's goal and while the deduction provision for work omitted or improperly performed is designed to protect the Government's interest, it is not a desirable substitute for accomplishing the job through normal processes. It is designed only to assure that the Government pays only for the services rendered.
The Deduction Table will be used by the Government in determining deductions for nonperformance of work or for deficiencies in the work performed.
The following deductions will be made from the Contractor's monthly invoice for instance of less than satisfactory performance or nonperformance of services required under the contract. The Contractor is advised that the
Government's application of deductions specified below in no way limit the Government's rights under the termination provision of this contract or any other provisions or rights to which the Government is entitled under law.

For nonperformance of an entire bi-weekly period, a deduction of 1/12 of the monthly rate will be taken.

The Contractor must present their reasons why any or all of the proposed deductions are not warranted within ten
(10) working days thereafter. If the Contracting Officer decides that any or all of the proposed deductions are not warranted, the Contractor will be notified and the Contractor shall be paid accordingly.
