Justification for Other Than Full and Open Competition (JOFOC) Advanced Sourcing Optimizer (Unlimited Users)

1. Identification of the agency and the contracting activity:

USDA, AMS, Cotton and Tobacco Program 3275 Appling Road Memphis, TN 38133

2. Nature and/or description of the action being approved: Procure services for bid evaluation and optimization for procurement of USDA Foods and International food aid assistance supporting the Web-Based Supply Chain Management (WBSCM) program.

3. A description of the supplies or services required to meet the agency’s needs (including the estimated value): The Advanced Sourcing Optimizer (ASO) Software provided by SciQuest is critical part of the WBSCM Program. The SciQuest service was implemented in WBSCM to replace an aging bid evaluation component of the legacy application. The SciQuest solution was procured in a competitive procurement during the architecture design and development of WBSCM. SciQuest provides technical resource support for their service that was customized for USDA to meet our procurement method requirements. This service is not available commercially due to the significant amount of customization applied.

The estimated value per year is $865,934

4. An identification of the statutory authority permitting other than full and open competition: This acquisition is being conducted under the authority of 41 U.S.C.

253(c)(1) as implemented by Federal Acquisition Regulation (FAR) 6.302-1, Only One Responsible Source and no Other Supplies or Services Will Satisfy Agency Requirements.

The brand name item peculiar to one manufacturer proposed to be acquitted is essential to the Government’s requirements, thereby precluding consideration of a product manufactured by another company.

5. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited:

This WBSCM-SAP Supplier Relationship Management (SRM) component is integrated directly with the SciQuest ASO system to receive bid data, deliver optimization for bid evaluation and award decisions for commodity and freight procurements. Additionally, ASO provides comprehensive functionality to support USDA’s process, including standard reporting and analytic capabilities, pre-populated procurement best practices, and extensive flexibility in modifying and updating optimization business rules and constraints through user-friendly interfaces across each category of Procurement:

Domestic, International, and Long-Term Contracts (LTC).

6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by subpart 5.2 and, if not, which exception under 5.202 applies:

A notice will be synopsized in FedBizOpps pursuant to FAR 5.2, Synopses of Proposed Contract Actions. Responses will be evaluated for future acquisitions.

7. A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable:

The Contracting Officer will determine that the anticipated cost to the Government will be fair and reasonable by comparing offered prices to the company’s General Services Administration (GSA) Federal Supply Schedule (FSS) contract prices and to the prices paid for similar software acquired for other USDA programs.

8. A description of the market research conducted (see Part 10) and the results or a statement of the reason market research was not conducted.

A market survey was not performed because the product is already in use within the WBSCM architecture. The WBSCM program is not considering replacement of the product.

9. Any other facts supporting the use of other than full and open competition:

The ASO benefits the International procurement functions in WBSCM by allowing buyers to select the set of vendor bids which allows USDA to realize the lowest landed cost of procurement while respecting vendor and port capacity constraints, federal regulatory requirements such as small and disadvantaged business set aside rules, and other USDA defined parameters and constraints.

10. A listing of the sources, if any, that expressed, in writing, an interest in the acquisition: At this time no sources have expressed, in writing, an interest in the solicitation.

11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required:

• No actions will be taken given the complexity of the SAP application and integrated nature of the SAP and SciQuest Products.

• This procurement will be a sole-source because of the tight integration with WBSCM and support for customization that only SciQuest personnel can maintain for their software. The ASO solution cannot be replaced without significant coast and impact to business operations for the Agricultural Marketing Service (AMS) and our ongoing efforts to stabilize and improve WBSCM.

12. Statement of Delivery Requirements: September 30, 2015 – September 29, 2020

13. Total estimated dollar value of the acquisition covered by this JOFOC:

$4,500,000 over five years. First year is $865,934.03
